SIXTY-FIFTH CALENDAR DAY THIRTY-EIGHTH SESSION DAY Senate Chamber Des Moines, Iowa, Tuesday, March 18, 1997 The Senate met in regular session at 9:19 a.m., President Kramer presiding. Prayer was offered by Father Eugene Murray, pastor of the Holy Family Parish, Emmetsburg, Iowa. The Journal of Monday, March 17, 1997, was approved. SPECIAL GUESTS Senator Kibbie presented Colm Hilliard, T.D., member of the Irish Parliament, and his wife, the former Margaret Quinn, who are in Iowa as the guests of the Saint Patrick's Association of Emmetsburg, Iowa. Mr Hilliard addressed the Senate briefly and introduced the Irish Dancers present in the northwest balcony, students from West Bend-Mallard, Emmetsburg Middle School and Emmetsburg Catholic School: Amanda Brown, Laura Fog, Melissa Hinners, Abbie Lang, Valerie Mattice, Stephanie Peterson, Brie Ann Reedy and Denise Stafford. They will be performing in the Capitol rotunda later in the day. QUORUM CALL Senator Iverson requested a non record roll call to determine that a quorum was present. The vote revealed 42 present, 8 absent and a quorum present. Senator McKibben moved that the resolution be read the last time now and placed upon its passage, which motion prevailed by a voice vote, and the resolution was read the last time. BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: Section 1. The following amendment to the Constitution of the State of Iowa is proposed: Article I of the Constitution of the State of Iowa is amended by adding the following new section which shall be applicable to criminal proceedings occurring after ratification of this amendment by the electorate: RIGHTS OF VICTIMS OF CRIME. Sec. 10A. Victims of crime, as the General Assembly may by law define, are entitled to be treated with fairness, respect, and dignity; to have a timely disposition made of the criminal proceedings against the accused; to communicate with the prosecution; and to be informed of, to be present at, and to be heard from when relevant at all critical stages of the criminal proceedings against the accused. The rights of victims of crime under this section are provided only to the extent that these rights do not interfere with the constitutional rights of the accused. Sec. 2. The foregoing amendment to the Constitution of the State of Iowa is referred to the General Assembly to be chosen at the next general election for members of the General Assembly, and the Secretary of State is directed to cause the same to be published for three consecutive months previous to the date of that election as provided by law.
