PAG LIN 1 1 Section 1. Section 152B.2, subsection 5, unnumbered 1 2 paragraph 3, Code 1997, is amended to read as follows: 1 3 "Respiratory care protocols" as used in this section means 1 4 policies and procedures developed by an organized health care 1 5 system through consultation, when appropriate, with 1 6 administrators, licensed physicians and surgeons,certified1 7 licensed registered nurses, licensed physical therapists, 1 8 licensed respiratory care practitioners, and other licensed 1 9 health care practitioners. 1 10 Sec. 2. Section 152B.7A, subsection 3, Code 1997, is 1 11 amended by striking the subsection and inserting in lieu 1 12 thereof the following: 1 13 This chapter is not intended to limit, preclude, or 1 14 otherwise interfere with the practice of other health care 1 15 providers not otherwise licensed under this chapter who are 1 16 licensed and certified by this state to administer respiratory 1 17 care procedures. 1 18 Sec. 3. Section 152B.11, Code 1997, is amended by adding 1 19 the following new unnumbered paragraph: 1 20 NEW UNNUMBERED PARAGRAPH. Except for those licensed by the 1 21 board, this section does not apply to persons who are licensed 1 22 to practice a health profession covered by chapter 147, when 1 23 the licensee's performance of respiratory care practices falls 1 24 within the scope of practice, as permitted by their respective 1 25 licensing board. 1 26 EXPLANATION 1 27 This bill provides for certain modifications to the 1 28 provisions of Code chapter 152B regarding respiratory care. 1 29 The bill changes the term "certified registered nurse" to 1 30 "licensed registered nurse" regarding consultation by licensed 1 31 registered nurses with organized health care systems 1 32 concerning respiratory care policies and procedures, and 1 33 provides that the chapter is not intended to limit, preclude, 1 34 or otherwise interfere with the practice of respiratory care 1 35 by other health care providers licensed and certified by the 2 1 state other than pursuant to Code chapter 152B. The bill also 2 2 provides that continuing education requirements specified in 2 3 Code section 152B.11 do not apply to other health care 2 4 providers, not licensed pursuant to Code chapter 152B, who are 2 5 covered under Code chapter 147 and performing respiratory care 2 6 within their respective scopes of practice. 2 7 LSB 2708XC 77 2 8 rn/jj/8
