PAG LIN 1 1 SENATE FILE 395 1 2 1 3 AN ACT 1 4 RELATING TO THE DEPARTMENT OF WORKFORCE DEVELOPMENT 1 5 CONCERNING THE OFFSETTING OF UNEMPLOYMENT COMPENSATION 1 6 BENEFITS, UNEMPLOYMENT COMPENSATION FOR INMATES, 1 7 DEPARTMENTAL LIABILITY FOR THE RELEASE OF UNEMPLOYMENT 1 8 COMPENSATION RECORDS, THE VOLUNTARY SHARED WORK PROGRAM, 1 9 AND WORKFORCE DEVELOPMENT SERVICES EMPLOYEES, AND 1 10 PROVIDING FOR AN EFFECTIVE DATE. 1 11 1 12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 13 1 14 Section 1. Section 96.3, Code 1997, is amended by adding 1 15 the following new subsection: 1 16 NEW SUBSECTION. 11. OVERISSUANCE OF FOOD STAMP BENEFITS. 1 17 The department shall collect any overissuance of food stamp 1 18 benefits by offsetting the amount of the overissuance from the 1 19 benefits payable under this chapter to the individual. This 1 20 subsection shall only apply if the department is reimbursed 1 21 under an agreement with the department of human services for 1 22 administrative costs incurred in recouping the overissuance. 1 23 The provisions of section 96.15 do not apply to this 1 24 subsection. 1 25 Sec. 2. Section 96.11, subsection 6, Code 1997, is amended 1 26 by adding the following new paragraph: 1 27 NEW PARAGRAPH. h. LIABILITY FOR RELEASE OF INFORMATION. 1 28 The department and its employees shall not be liable for any 1 29 acts or omissions resulting from the release of information to 1 30 any person pursuant to this subsection. 1 31 Sec. 3. Section 96.19, subsection 18, paragraph a, 1 32 subparagraph (6), subparagraph subdivision (f), Code 1997, is 1 33 amended by striking the subparagraph subdivision. 1 34 Sec. 4. Section 96.19, subsection 18, paragraph g, Code 1 35 1997, is amended by adding the following new subparagraph: 2 1 NEW SUBPARAGRAPH. (8) Services performed by an inmate of 2 2 a correctional institution. 2 3 Sec. 5. Section 96.40, subsection 9, Code 1997, is amended 2 4 by adding the following new unnumbered paragraph: 2 5 NEW UNNUMBERED PARAGRAPH. An employer may provide as part 2 6 of the plan a training program the employees may attend during 2 7 the hours that have been reduced. If the employer is able to 2 8 show that the training program will provide a substantive 2 9 increase in the workplace and employability skills of the 2 10 employee so as to reduce the potential for future periods of 2 11 unemployment, the department shall relieve the employer of 2 12 charges for benefits paid to the individual attending training 2 13 under the plan. The employee may attend the training at the 2 14 work site utilizing internal resources, provided the training 2 15 is outside of the normal course of employment, or in 2 16 conjunction with an educational institution. 2 17 Sec. 6. 1996 Iowa Acts, chapter 1186, section 25, is 2 18 amended by adding the following new unnumbered paragraph: 2 19 NEW UNNUMBERED PARAGRAPH. If approved by the community 2 20 college and the department of workforce development, an 2 21 employee of a community college who currently provides 2 22 workforce development services under a contract with the 2 23 department of workforce development which was in existence as 2 24 of July 1, 1996, may become a state employee with the 2 25 department subject to the requirements of this paragraph. The 2 26 hiring provisions of chapter 19A and the provisions of any 2 27 collective bargaining agreement made pursuant to chapter 20 2 28 shall not apply to the initial placement of a new employee 2 29 into state service pursuant to this paragraph. A new state 2 30 employee employed pursuant to this paragraph shall retain any 2 31 vacation and sick leave hours previously accrued and their 2 32 accrued years of service. However, accrued years of service 2 33 shall not be used for the purpose of calculating years of 2 34 service for a retirement allowance under the Iowa public 2 35 employees' retirement system unless the employee was covered 3 1 under the system for those years of service. A new state 3 2 employee employed pursuant to this paragraph shall not suffer 3 3 any loss in salary unless the salary would exceed the current 3 4 allowable state salary for a position of comparable worth. 3 5 Except as provided in this paragraph, a new state employee 3 6 employed pursuant to this paragraph shall be entitled to 3 7 benefits offered to all state employees, but shall not be 3 8 entitled to benefits offered to an employee of a community 3 9 college but not to a state employee. For the purposes of 3 10 health benefits for a new state employee employed pursuant to 3 11 this paragraph, the eleven-month preexisting condition waiting 3 12 period is waived. For purposes of group health, dental, life, 3 13 and long-term disability coverage for a new state employee 3 14 employed pursuant to this paragraph, the thirty-day new 3 15 employee waiting period is waived. 3 16 Sec. 7. EFFECTIVE DATE REPEAL. Section 6 of this Act, 3 17 amending 1996 Iowa Acts, chapter 1186, being deemed of 3 18 immediate importance, takes effect upon enactment and is 3 19 repealed effective July 1, 1999. 3 20 3 21 3 22 3 23 MARY E.
