PAG LIN 1 1 Section 1. Section 29C.17, subsection 5, Code 1997, is 1 2 amended to read as follows: 1 3 5. Subject to chapter 24, the commission shall adopt, 1 4 certify, and submit a budget, on or before February 28 of each 1 5 year, to the county board of supervisors and the cities for 1 6 the ensuing fiscal year which will include an itemized list of 1 7 the number of emergency management personnel, their salaries 1 8 and cost of personnel benefits, travel and transportation 1 9 costs, fixed costs of operation, and all other anticipated 1 10 emergency management expenses. The increase in the agency's 1 11 annual budget is limited to an allowable growth rate. The 1 12 salaries and compensation of agency personnelcoming under1 13 subject to the merit system as determined by the commission 1 14willshall include salary schedules for classes in which the 1 15 salary of a class is based on merit qualifications for the 1 16 positions. 1 17 For purposes of this subsection, "allowable growth rate" 1 18 means the percent change, computed to two decimal places, 1 19 between the preliminary price index for the third quarter of 1 20 the calendar year ending just prior to the beginning of the 1 21 fiscal year for which the index is determined and the revised 1 22 price index for the third quarter of the calendar year 1 23 immediately prior to that calendar year, as published in the 1 24 same issue in which such preliminary third quarter price index 1 25 is first published. The price index used shall be the state 1 26 and local government chain-type price index used in the 1 27 quantity and price indexes for gross domestic product, as 1 28 published by the bureau of economic analysis of the United 1 29 States department of commerce in the national income and 1 30 products accounts as published in the survey of current 1 31 business. 1 32 Sec. 2. Section 444.25A, subsection 2, paragraph d, Code 1 33 1997, is amended by striking the paragraph. 1 34 Sec. 3. Section 444.25B, subsection 2, paragraph d, Code 1 35 1997, is amended by striking the paragraph. 2 1 Sec. 4. NEW SECTION. 444.29 EXCEPTION FOR LOCAL 2 2 EMERGENCY MANAGEMENT FUND. 2 3 Moneys, including property tax revenues, which are obtained 2 4 from any source in connection with the county emergency 2 5 management program and which are to be deposited in the local 2 6 emergency management fund pursuant to section 29C.17, shall 2 7 not be limited by the provisions of section 444.25B. 2 8 Sec. 5. This Act applies to budgets certified for the 2 9 fiscal years beginning on or after July 1, 1998. 2 10 EXPLANATION 2 11 This bill limits the annual increase in the budget of a 2 12 county emergency management agency to the same price index 2 13 defined under the county property tax limitation. 2 14 The bill also exempts from the property tax limitation 2 15 provisions of chapter 444 any moneys deposited into a local 2 16 emergency management fund which is used to fund the county 2 17 emergency management program. 2 18 The bill applies to budgets certified for fiscal years 2 19 beginning on or after July 1, 1998. 2 20 LSB 2383SS 77 2 21 sc/cf/24.1
