1 4 RELATING TO INFORMATION CENTERS AND REST AREAS ON INTERSTATE
1 5 OR PRIMARY HIGHWAYS AND PROVIDING EFFECTIVE AND RETROACTIVE

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. Section 306C.21, Code 1997, is amended to read
1 11 as follows:
1 12 306C.21 INFORMATION CENTERS AND REST AREAS.
1 13 The department may establish or enter into agreements with
1 14 private persons, firms, or corporations for the establishment
1 15 of information centers in rest areas on the interstate,
1 16 freeway primary, and primary highways, subject to the approval
1 17 of the appropriate authority of the federal government. After
1 18 January 1, 1997, private persons, firms, or corporations
1 19 entering into an agreement with the department under this
1 20 section shall not develop, establish, or own any commercial
1 21 business located on land adjacent to the rest area which is
1 22 subject to the agreement. An interstate rest area shall be
1 23 located entirely on the interstate right-of-way, including,
1 24 but not limited to, all entrance and exit ramps, all rest area
1 25 buildings including information centers, and all parking
1 26 facilities. Department money and resources shall not be used
1 27 for any other type of interstate rest area. Whenever an
1 28 interstate rest area is reconstructed, the area available for
1 29 parking shall be equal to or more than the area available for
1 30 parking prior to the reconstruction.
1 31 Sec. 2. EFFECTIVE AND RETROACTIVE APPLICABILITY DATES.
1 32 This Act, being deemed of immediate importance, takes effect
1 33 upon enactment and applies retroactively to January 1, 1997.
