PAG LIN 1 1 SENATE FILE 240 1 2 1 3 AN ACT 1 4 APPROPRIATING FEDERAL FUNDS MADE AVAILABLE FROM FEDERAL 1 5 BLOCK GRANTS AND OTHER FEDERAL GRANTS, ALLOCATING 1 6 PORTIONS OF FEDERAL BLOCK GRANTS, AND PROVIDING 1 7 PROCEDURES IF FEDERAL FUNDS ARE MORE OR LESS THAN 1 8 ANTICIPATED OR IF FEDERAL BLOCK GRANTS ARE MORE OR LESS 1 9 THAN ANTICIPATED. 1 10 1 11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 12 1 13 Section 1. SUBSTANCE ABUSE APPROPRIATION. 1 14 1. There is appropriated from the fund created by section 1 15 8.41 to the Iowa department of public health for the federal 1 16 fiscal year beginning October 1, 1997, and ending September 1 17 30, 1998, the following amount: 1 18 .................................................. $ 11,945,086 1 19 a. Funds appropriated in this subsection are the 1 20 anticipated funds to be received from the federal government 1 21 for the designated federal fiscal year under 42 U.S.C., 1 22 chapter 6A, subchapter XVII, which provides for the substance 1 23 abuse prevention and treatment block grant. The department 1 24 shall expend the funds appropriated in this subsection as 1 25 provided in the federal law making the funds available and in 1 26 conformance with chapter 17A. 1 27 b. Of the funds appropriated in this subsection, an amount 1 28 not exceeding 5 percent shall be used by the department for 1 29 administrative expenses. 1 30 c. The department shall expend no less than an amount 1 31 equal to the amount expended for treatment services in state 1 32 fiscal year beginning July 1, 1996, for pregnant women and 1 33 women with dependent children. 1 34 d. Of the funds appropriated in this subsection, an amount 1 35 not exceeding $24,585 shall be used for audits. 2 1 e. Of the funds appropriated in this subsection, an amount 2 2 not exceeding $438,275 shall be used for current and former 2 3 recipients of federal supplemental security income (SSI). 2 4 2. The funds remaining from the appropriation made in 2 5 subsection 1 shall be allocated as follows: 2 6 a. At least 20 percent of the allocation shall be for 2 7 prevention programs. 2 8 b. At least 35 percent of the allocation shall be spent on 2 9 drug treatment and prevention activities. 2 10 c. At least 35 percent of the allocation shall be spent on 2 11 alcohol treatment and prevention activities. 2 12 3. The substance abuse block grant funds received from the 2 13 federal government in excess of the amount of the anticipated 2 14 federal fiscal year 1997-1998 award appropriated in subsection 2 15 1 shall be distributed at least 50 percent to treatment 2 16 programs and 50 percent to prevention programs except that, 2 17 based upon federal guidelines, the total amount of the excess 2 18 awarded to prevention programs shall not exceed $1,000,000. 2 19 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION. 2 20 1. a. There is appropriated from the fund created by 2 21 section 8.41 to the Iowa department of human services for the 2 22 federal fiscal year beginning October 1, 1997, and ending 2 23 September 30, 1998, the following amount: 2 24 .................................................. $ 2,740,750 2 25 b. Funds appropriated in this subsection are the 2 26 anticipated funds to be received from the federal government 2 27 for the designated federal fiscal year under 42 U.S.C., 2 28 chapter 6A, subchapter XVII, which provides for the community 2 29 mental health services block grant. The department shall 2 30 expend the funds appropriated in this subsection as provided 2 31 in the federal law making the funds available and in 2 32 conformance with chapter 17A. 2 33 c. The administrator of the division of mental health and 2 34 developmental disabilities shall allocate not less than 95 2 35 percent of the amount of the block grant to eligible community 3 1 mental health services providers for carrying out the plan 3 2 submitted to and approved by the federal substance abuse and 3 3 mental health services administration for the fiscal year 3 4 involved. 3 5 2. An amount not exceeding 5 percent of the funds 3 6 appropriated in subsection 1 shall be used by the department 3 7 of human services for administrative expenses. From the funds 3 8 set aside by this subsection for administrative expenses, the 3 9 division of mental health and developmental disabilities shall 3 10 pay to the auditor of state an amount sufficient to pay the 3 11 cost of auditing the use and administration of the state's 3 12 portion of the funds appropriated in subsection 1. The 3 13 auditor of state shall bill the division of mental health and 3 14 developmental disabilities for the costs of the audits. 3 15 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS. 3 16 1. There is appropriated from the fund created by section 3 17 8.41 to the Iowa department of public health for the federal 3 18 fiscal year beginning October 1, 1997, and ending September 3 19 30, 1998, the following amount: 3 20 .................................................. $ 6,871,361 3 21 The funds appropriated in this subsection are the funds 3 22 anticipated to be received from the federal government for the 3 23 designated federal fiscal year under 42 U.S.C., chapter 7, 3 24 subchapter V, which provides for the maternal and child health 3 25 services block grant. The department shall expend the funds 3 26 appropriated in this subsection as provided in the federal law 3 27 making the funds available and in conformance with chapter 3 28 17A. 3 29 Of the funds appropriated in this subsection, an amount not 3 30 exceeding $45,700 shall be used for audits. 3 31 Funds appropriated in this subsection shall not be used by 3 32 the university of Iowa hospitals and clinics for indirect 3 33 costs. 3 34 2. An amount not exceeding $150,000 of the funds 3 35 appropriated in subsection 1 to the Iowa department of public 4 1 health shall be used by the Iowa department of public health 4 2 for administrative expenses in addition to the amount to be 4 3 used for audits in subsection 1. 4 4 The departments of public health, human services, and 4 5 education and the university of Iowa's mobile and regional 4 6 child health specialty clinics shall continue to pursue to the 4 7 maximum extent feasible the coordination and integration of 4 8 services to women and children. 4 9 3. a. Sixty-three percent of the remaining funds 4 10 appropriated in subsection 1 shall be allocated to supplement 4 11 appropriations for maternal and child health programs within 4 12 the Iowa department of public health. Of these funds, 4 13 $284,548 shall be set aside for the statewide perinatal care 4 14 program. 4 15 b. Thirty-seven percent of the remaining funds 4 16 appropriated in subsection 1 shall be allocated to the 4 17 university of Iowa hospitals and clinics under the control of 4 18 the state board of regents for mobile and regional child 4 19 health specialty clinics. The university of Iowa hospitals 4 20 and clinics shall not receive an allocation for indirect costs 4 21 from the funds for this program. Priority shall be given to 4 22 establishment and maintenance of a statewide system of mobile 4 23 and regional child health specialty clinics. 4 24 4. Those federal maternal and child health services block 4 25 grant funds transferred from the federal preventive health and 4 26 health services block grant funds in section 4, subsection 4 4 27 of this Act for the federal fiscal year beginning October 1, 4 28 1997, are transferred to the maternal and child health 4 29 programs and to the university of Iowa's mobile and regional 4 30 child health specialty clinics according to the percentages 4 31 specified in subsection 3. 4 32 5. The Iowa department of public health shall administer 4 33 the statewide maternal and child health program and the 4 34 crippled children's program by conducting mobile and regional 4 35 child health specialty clinics and conducting other activities 5 1 to improve the health of low-income women and children and to 5 2 promote the welfare of children with actual or potential 5 3 handicapping conditions and chronic illnesses in accordance 5 4 with the requirements of Title V of the federal Social 5 5 Security Act. 5 6 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES 5 7 APPROPRIATIONS. 5 8 1. There is appropriated from the fund created by section 5 9 8.41 to the Iowa department of public health for the federal 5 10 fiscal year beginning October 1, 1997, and ending September 5 11 30, 1998, the following amount: 5 12 .................................................. $ 1,939,595 5 13 Funds appropriated in this subsection are the funds 5 14 anticipated to be received from the federal government for the 5 15 designated federal fiscal year under 42 U.S.C., chapter 6A, 5 16 subchapter XVII, which provides for the preventive health and 5 17 health services block grant. The department shall expend the 5 18 funds appropriated in this subsection as provided in the 5 19 federal law making the funds available and in conformance with 5 20 chapter 17A. 5 21 Of the funds appropriated in this subsection, an amount not 5 22 exceeding $5,522 shall be used for audits. 5 23 2. An amount not exceeding $94,670 of the remaining funds 5 24 appropriated in subsection 1 shall be used by the Iowa 5 25 department of public health for administrative expenses in 5 26 addition to the amount to be used for audits in subsection 1. 5 27 3. Of the remaining funds appropriated in subsection 1, 5 28 the specific amount of funds stipulated by the notice of block 5 29 grant award shall be allocated for services to victims of sex 5 30 offenses and for rape prevention education. 5 31 4. Of the remaining funds appropriated in subsection 1, 7 5 32 percent is transferred within the special fund in the state 5 33 treasury established under section 8.41, for use by the Iowa 5 34 department of public health as authorized by 42 U.S.C., 5 35 chapter 33, subchapter III, and section 3 of this Act. 6 1 5. After deducting the funds allocated and transferred in 6 2 subsections 1, 2, 3, and 4, the remaining funds appropriated 6 3 in subsection 1 shall be used by the department for healthy 6 4 people 2000/healthy Iowans 2000 program objectives, preventive 6 5 health advisory committee, and risk reduction services, 6 6 including nutrition programs, health incentive programs, 6 7 chronic disease services, emergency medical services, 6 8 monitoring of the fluoridation program and start-up 6 9 fluoridation grants, and acquired immune deficiency syndrome 6 10 services. The moneys specified in this subsection shall not 6 11 be used by the university of Iowa hospitals and clinics or by 6 12 the state hygienic laboratory for the funding of indirect 6 13 costs. Of the funds used by the department under this 6 14 subsection, an amount not exceeding $90,000 shall be used for 6 15 the monitoring of the fluoridation program and for start-up 6 16 fluoridation grants to public water systems, and at least 6 17 $50,000 shall be used to provide chlamydia testing. 6 18 Sec. 5. DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM 6 19 APPROPRIATION. 6 20 1. There is appropriated from the fund created in section 6 21 8.41 to the office of the governor for the drug enforcement 6 22 and abuse prevention coordinator for the federal fiscal year 6 23 beginning October 1, 1997, and ending September 30, 1998, the 6 24 following amount: 6 25 .................................................. $ 5,556,000 6 26 Funds appropriated in this subsection are the anticipated 6 27 funds to be received from the federal government for the 6 28 designated fiscal year under 42 U.S.C., chapter 46, subchapter 6 29 V, which provides for the drug control and system improvement 6 30 grant program. The drug enforcement and abuse prevention 6 31 coordinator shall expend the funds appropriated in this 6 32 subsection as provided in the federal law making the funds 6 33 available and in conformance with chapter 17A. 6 34 2. An amount not exceeding 7 percent of the funds 6 35 appropriated in subsection 1 shall be used by the drug 7 1 enforcement and abuse prevention coordinator for 7 2 administrative expenses. From the funds set aside by this 7 3 subsection for administrative expenses, the drug enforcement 7 4 and abuse prevention coordinator shall pay to the auditor of 7 5 state an amount sufficient to pay the cost of auditing the use 7 6 and administration of the state's portion of the funds 7 7 appropriated in subsection 1. 7 8 Sec. 6. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM 7 9 APPROPRIATION. 7 10 1. There is appropriated from the fund created in section 7 11 8.41 to the office of the governor for the drug enforcement 7 12 and abuse prevention coordinator for the federal fiscal year 7 13 beginning October 1, 1997, and ending September 30, 1998, the 7 14 following amount: 7 15 .................................................. $ 1,886,000 7 16 Funds appropriated in this subsection are the anticipated 7 17 funds to be received from the federal government for the 7 18 designated fiscal year under 42 U.S.C., chapter 46, subchapter 7 19 XII-H, which provides for grants to combat violent crimes 7 20 against women. The drug enforcement and abuse prevention 7 21 coordinator shall expend the funds appropriated in this 7 22 subsection as provided in the federal law making the funds 7 23 available and in conformance with chapter 17A. 7 24 2. An amount not exceeding 5 percent of the funds 7 25 appropriated in subsection 1 shall be used by the drug 7 26 enforcement and abuse prevention coordinator for 7 27 administrative expenses. From the funds set aside by this 7 28 subsection for administrative expenses, the drug enforcement 7 29 and abuse prevention coordinator shall pay to the auditor of 7 30 the state an amount sufficient to pay the cost of auditing the 7 31 use and administration of the state's portion of the funds 7 32 appropriated in subsection 1. 7 33 Sec. 7. LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION. 7 34 1. There is appropriated from the fund created in section 7 35 8.41 to the office of the governor for the drug enforcement 8 1 and abuse prevention coordinator for the federal fiscal year 8 2 beginning October 1, 1997, and ending September 30, 1998, the 8 3 following amount: 8 4 .................................................. $ 333,497 8 5 Funds appropriated in this subsection are the funds 8 6 anticipated to be received from the federal government for the 8 7 designated federal fiscal year under the federal Omnibus 8 8 Consolidated Recissions and Appropriations Act of 1996, Pub. 8 9 L. No. 104-134, which provides for grants to reduce crime and 8 10 improve public safety. The drug enforcement and abuse 8 11 prevention coordinator shall expend the funds appropriated in 8 12 this subsection as provided in the federal law making the 8 13 funds available and in conformance with chapter 17A. 8 14 2. An amount not exceeding 3 percent of the funds 8 15 appropriated in subsection 1 shall be used by the drug 8 16 enforcement and abuse prevention coordinator for 8 17 administrative expenses. From the funds set aside by this 8 18 subsection for administrative expenses, the drug enforcement 8 19 and abuse prevention coordinator shall pay to the auditor of 8 20 state an amount sufficient to pay the cost of auditing the use 8 21 and administration of the state's portion of the funds 8 22 appropriated in subsection 1. 8 23 Sec. 8. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE 8 24 PRISONERS FORMULA GRANT PROGRAM. There is appropriated from 8 25 the fund created in section 8.41 to the office of the governor 8 26 for the drug enforcement and abuse prevention coordinator for 8 27 the federal fiscal year beginning October 1, 1997, and ending 8 28 September 30, 1998, the following amount: 8 29 .................................................. $ 208,726 8 30 Funds appropriated in this subsection are the funds 8 31 anticipated to be received from the federal government for the 8 32 designated federal fiscal year under 42 U.S.C., chapter 136, 8 33 which provides grants for substance abuse treatment programs 8 34 in state and local correctional facilities. The drug 8 35 enforcement and abuse prevention coordinator shall expend the 9 1 funds appropriated in this subsection as provided in the 9 2 federal law making the funds available and in conformance with 9 3 chapter 17A. 9 4 Sec. 9. COMMUNITY SERVICES APPROPRIATIONS. 9 5 1. a. There is appropriated from the fund created by 9 6 section 8.41 to the division of community action agencies of 9 7 the department of human rights for the federal fiscal year 9 8 beginning October 1, 1997, and ending September 30, 1998, the 9 9 following amount: 9 10 .................................................. $ 5,292,291 9 11 Funds appropriated in this subsection are the funds 9 12 anticipated to be received from the federal government for the 9 13 designated federal fiscal year under 42 U.S.C., chapter 106, 9 14 which provides for the community services block grant. The 9 15 division of community action agencies of the department of 9 16 human rights shall expend the funds appropriated in this 9 17 subsection as provided in the federal law making the funds 9 18 available and in conformance with chapter 17A. 9 19 b. The administrator of the division of community action 9 20 agencies of the department of human rights shall allocate not 9 21 less than 96 percent of the amount of the block grant to 9 22 eligible community action agencies for programs benefiting 9 23 low-income persons. Each eligible agency shall receive a 9 24 minimum allocation of no less than $100,000. The minimum 9 25 allocation shall be achieved by redistributing increased funds 9 26 from agencies experiencing a greater share of available funds. 9 27 The funds shall be distributed on the basis of the poverty- 9 28 level population in the area represented by the community 9 29 action areas compared to the size of the poverty-level 9 30 population in the state. 9 31 2. An amount not exceeding 4 percent of the funds 9 32 appropriated in subsection 1 shall be used by the division of 9 33 community action agencies of the department of human rights 9 34 for administrative expenses. From the funds set aside by this 9 35 subsection for administrative expenses, the division of 10 1 community action agencies of the department of human rights 10 2 shall pay to the auditor of state an amount sufficient to pay 10 3 the cost of auditing the use and administration of the state's 10 4 portion of the funds appropriated in subsection 1. The 10 5 auditor of state shall bill the division of community action 10 6 agencies for the costs of the audits. 10 7 Sec. 10. COMMUNITY DEVELOPMENT APPROPRIATIONS. 10 8 1. There is appropriated from the fund created by section 10 9 8.41 to the department of economic development for the federal 10 10 fiscal year beginning October 1, 1997, and ending September 10 11 30, 1998, the following amount: 10 12 .................................................. $ 30,400,000 10 13 Funds appropriated in this subsection are the funds 10 14 anticipated to be received from the federal government for the 10 15 designated federal fiscal year under 42 U.S.C., chapter 69, 10 16 which provides for community development block grants. The 10 17 department of economic development shall expend the funds 10 18 appropriated in this subsection as provided in the federal law 10 19 making the funds available and in conformance with chapter 10 20 17A. 10 21 2. An amount not exceeding $1,414,000 for the federal 10 22 fiscal year beginning October 1, 1997, shall be used by the 10 23 department of economic development for administrative expenses 10 24 for the community development block grant. The total amount 10 25 used for administrative expenses includes $707,000 for the 10 26 federal fiscal year beginning October 1, 1997, of funds 10 27 appropriated in subsection 1 and a matching contribution from 10 28 the state equal to $707,000 from the appropriation of state 10 29 funds for the community development block grant and state 10 30 appropriations for related activities of the department of 10 31 economic development. From the funds set aside for 10 32 administrative expenses by this subsection, the department of 10 33 economic development shall pay to the auditor of state an 10 34 amount sufficient to pay the cost of auditing the use and 10 35 administration of the state's portion of the funds 11 1 appropriated in subsection 1. The auditor of state shall bill 11 2 the department for the costs of the audit. 11 3 Sec. 11. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS. 11 4 1. There is appropriated from the fund created by section 11 5 8.41 to the division of community action agencies of the 11 6 department of human rights for the federal fiscal year 11 7 beginning October 1, 1997, and ending September 30, 1998, the 11 8 following amount: 11 9 .................................................. $ 18,143,877 11 10 The funds appropriated in this subsection are the funds 11 11 anticipated to be received from the federal government for the 11 12 designated federal fiscal year under 42 U.S.C., chapter 94, 11 13 subchapter II, which provides for the low-income home energy 11 14 assistance block grants. The division of community action 11 15 agencies of the department of human rights shall expend the 11 16 funds appropriated in this subsection as provided in the 11 17 federal law making the funds available and in conformance with 11 18 chapter 17A. 11 19 2. An amount not exceeding $1,542,229 or 10 percent of the 11 20 funds appropriated in subsection 1, whichever is less, may be 11 21 used for administrative expenses for the low-income home 11 22 energy assistance program. Not more than $290,000 shall be 11 23 used for administrative expenses of the division of community 11 24 action agencies of the department of human rights. From the 11 25 total funds set aside in this subsection for administrative 11 26 expenses for the low-income home energy assistance program, an 11 27 amount sufficient to pay the cost of an audit of the use and 11 28 administration of the state's portion of the funds 11 29 appropriated is allocated for that purpose. The auditor of 11 30 state shall bill the division of community action agencies for 11 31 the costs of the audits. 11 32 3. The remaining funds appropriated in subsection 1 shall 11 33 be allocated to help eligible households, as defined under 42 11 34 U.S.C., chapter 94, subchapter II, to meet the costs of home 11 35 energy. After reserving a reasonable portion of the remaining 12 1 funds not to exceed 10 percent of the funds appropriated in 12 2 subsection 1, to carry forward into the federal fiscal year 12 3 beginning October 1, 1998, at least 15 percent of the funds 12 4 appropriated in subsection 1 shall be used for low-income 12 5 residential weatherization or other related home repairs for 12 6 low-income households. Of this amount, an amount not 12 7 exceeding 10 percent may be used for administrative expenses. 12 8 4. An eligible household must be willing to allow 12 9 residential weatherization or other related home repairs in 12 10 order to receive home energy assistance. If the eligible 12 11 household resides in rental property, the unwillingness of the 12 12 landlord to allow residential weatherization or other related 12 13 home repairs shall not prevent the household from receiving 12 14 home energy assistance. 12 15 5. Not more than 5 percent of the funds appropriated in 12 16 subsection 1 shall be used for assessment and resolution of 12 17 energy problems. 12 18 Sec. 12. SOCIAL SERVICES APPROPRIATIONS. 12 19 1. There is appropriated from the fund created by section 12 20 8.41 to the department of human services for the federal 12 21 fiscal year beginning October 1, 1997, and ending September 12 22 30, 1998, the following amount: 12 23 .................................................. $ 27,014,462 12 24 Funds appropriated in this subsection are the funds 12 25 anticipated to be received from the federal government for the 12 26 designated federal fiscal year under 42 U.S.C., chapter 7, 12 27 subchapter XX, which provides for the social services block 12 28 grant. The department of human services shall expend the 12 29 funds appropriated in this subsection as provided in the 12 30 federal law making the funds available and in conformance with 12 31 chapter 17A. 12 32 2. Not more than $1,717,784 of the funds appropriated in 12 33 subsection 1 shall be used by the department of human services 12 34 for general administration. From the funds set aside in this 12 35 subsection for general administration, the department of human 13 1 services shall pay to the auditor of state an amount 13 2 sufficient to pay the cost of auditing the use and 13 3 administration of the state's portion of the funds 13 4 appropriated in subsection 1. 13 5 3. In addition to the allocation for general 13 6 administration in subsection 2, the remaining funds 13 7 appropriated in subsection 1 shall be allocated in the 13 8 following amounts to supplement appropriations for the federal 13 9 fiscal year beginning October 1, 1997, for the following 13 10 programs within the department of human services: 13 11 a. Local administrative costs 13 16 and other local services: 13 17 .................................................. $ 1,089,616 13 18 d. Volunteers: 13 19 .................................................. $ 119,084 13 20 e. Community-based services: 13 21 .................................................. $ 136,946 13 22 f. MH/MR/DD/BI community service (local purchase): 13 23 .................................................. $ 12,140,032 13 24 Sec. 13. SOCIAL SERVICES BLOCK GRANT PLAN. The department 13 25 of human services during each state fiscal year shall develop 13 26 a plan for the use of federal social services block grant 13 27 funds for the subsequent state fiscal year. 13 28 The proposed plan shall include all programs and services 13 29 at the state level which the department proposes to fund with 13 30 federal social services block grant funds, and shall identify 13 31 state and other funds which the department proposes to use to 13 32 fund the state programs and services. 13 33 The proposed plan shall also include all local programs and 13 34 services which are eligible to be funded with federal social 13 35 services block grant funds, the total amount of federal social 14 1 services block grant funds available for the local programs 14 2 and services, and the manner of distribution of the federal 14 3 social services block grant funds to the counties. The 14 4 proposed plan shall identify state and local funds which will 14 5 be used to fund the local programs and services. 14 6 The proposed plan shall be submitted with the department's 14 7 budget requests to the governor and the general assembly. 14 8 Sec. 14. PROJECTS FOR ASSISTANCE IN TRANSITION FROM 14 9 HOMELESSNESS. Upon receipt of the minimum formula grant from 14 10 the federal alcohol, drug abuse, and mental health 14 11 administration to provide mental health services for the 14 12 homeless, the division of mental health and developmental 14 13 disabilities of the department of human services shall assure 14 14 that a project which receives funds under the formula grant 14 15 from either the federal or local match share of 25 percent in 14 16 order to provide outreach services to persons who are 14 17 chronically mentally ill and homeless or who are subject to a 14 18 significant probability of becoming homeless shall do all of 14 19 the following: 14 20 1. Provide community mental health services, diagnostic 14 21 services, crisis intervention services, and habilitation and 14 22 rehabilitation services. 14 23 2. Refer clients to medical facilities for necessary 14 24 hospital services, and to entities that provide primary health 14 25 services and substance abuse services. 14 26 3. Provide appropriate training to persons who provide 14 27 services to persons targeted by the grant. 14 28 4. Provide case management to homeless persons. 14 29 5. Provide supportive and supervisory services to certain 14 30 homeless persons living in residential settings which are not 14 31 otherwise supported. 14 32 6. Projects may expend funds for housing services 14 33 including minor renovation, expansion and repair of housing, 14 34 security deposits, planning of housing, technical assistance 14 35 in applying for housing, improving the coordination of housing 15 1 services, the costs associated with matching eligible homeless 15 2 individuals with appropriate housing, and one-time rental 15 3 payments to prevent eviction. 15 4 Sec. 15. CHILD CARE AND DEVELOPMENT BLOCK GRANT. There is 15 5 appropriated from the fund created by section 8.41 to the 15 6 department of human services for the federal fiscal year 15 7 beginning October 1, 1997, and ending September 30, 1998, the 15 8 following amount: 15 9 .................................................. $ 25,405,945 15 10 Funds appropriated in this section are the funds 15 11 anticipated to be received from the federal government under 15 12 42 U.S.C., chapter 105, subchapter II-B, which provides for 15 13 the child care and development block grant. The department 15 14 shall expend the funds appropriated in this section as 15 15 provided in the federal law making the funds available and in 15 16 conformance with chapter 17A. 15 17 Sec. 16. PROCEDURE FOR REDUCED FEDERAL FUNDS. 15 18 1. If the funds received from the federal government for 15 19 the block grants specified in this Act are less than the 15 20 amounts appropriated, the funds actually received shall be 15 21 prorated by the governor for the various programs, other than 15 22 for the services to victims of sex offenses and for rape 15 23 prevention education under section 4, subsection 3, of this 15 24 Act, for which each block grant is available according to the 15 25 percentages that each program is to receive as specified in 15 26 this Act. However, if the governor determines that the funds 15 27 allocated by the percentages will not be sufficient to effect 15 28 the purposes of a particular program, or if the appropriation 15 29 is not allocated by percentage, the governor may allocate the 15 30 funds in a manner which will effect to the greatest extent 15 31 possible the purposes of the various programs for which the 15 32 block grants are available. 15 33 2. Before the governor implements the actions provided for 15 34 in subsection 1, the following procedures shall be taken: 15 35 a. The chairpersons and ranking members of the senate and 16 1 house standing committees on appropriations, the appropriate 16 2 chairpersons and ranking members of subcommittees of those 16 3 committees, the director of the legislative service bureau, 16 4 and the director of the legislative fiscal bureau shall be 16 5 notified of the proposed action. 16 6 b. The notice shall include the proposed allocations, and 16 7 information on the reasons why particular percentages or 16 8 amounts of funds are allocated to the individual programs, the 16 9 departments and programs affected, and other information 16 10 deemed useful. Chairpersons notified shall be allowed at 16 11 least two weeks to review and comment on the proposed action 16 12 before the action is taken. 16 13 3. If funds received from the federal government for a 16 14 specific grant number specified in this Act is less than the 16 15 amount appropriated, the amount appropriated shall be reduced 16 16 accordingly. An annual report listing any such appropriation 16 17 reduction shall be submitted to the fiscal committee of the 16 18 legislative council. 16 19 Sec. 17. PROCEDURE FOR INCREASED FEDERAL FUNDS. 16 20 1. If funds received from the federal government in the 16 21 form of block grants exceed the amounts appropriated in 16 22 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess 16 23 shall be prorated to the appropriate programs according to the 16 24 percentages specified in those sections, except additional 16 25 funds shall not be prorated for administrative expenses. 16 26 2. If funds received from the federal government from 16 27 block grants exceed the amount appropriated in section 11 of 16 28 this Act for the low-income home energy assistance program, 15 16 29 percent of the excess shall be allocated to the low-income 16 30 residential weatherization program. 16 31 3. If funds received from the federal government for a 16 32 specific grant number specified in this Act exceeds the amount 16 33 appropriated, the excess amount is appropriated for the 16 34 purpose designated in the appropriation. An annual report 16 35 listing any such excess appropriations shall be submitted to 17 1 the fiscal committee of the legislative council. 17 2 4. If funds received from the federal government from 17 3 community services block grants exceed the amount appropriated 17 4 in section 9 of this Act, 100 percent of the excess is 17 5 allocated to the community services block grant program. 17 6 Sec. 18. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL 17 7 FUNDS. If other federal grants, receipts, and funds and other 17 8 nonstate grants, receipts, and funds become available or are 17 9 awarded which are not available or awarded during the period 17 10 in which the general assembly is in session, but which require 17 11 expenditure by the applicable department or agency prior to 17 12 March 15 of the fiscal year beginning July 1, 1997, and ending 17 13 June 30, 1998, these grants, receipts, and funds are 17 14 appropriated to the extent necessary, provided that the fiscal 17 15 committee of the legislative council is notified within thirty 17 16 days of receipt of the grants, receipts, or funds and the 17 17 fiscal committee of the legislative council has an opportunity 17 18 to comment on the expenditure of the grants, receipts, or 17 19 funds. 17 20 Sec. 19. It 42 19 is the intent of the general assembly that if the governor 42 20 determines federal funds are insufficient to adequately 42 21 provide for certification of eligibility for the low-income 42 22 home energy assistance program by the community action 42 23 agencies during the federal fiscal year which commences 42 24 October 1, 1997, the Iowa utilities board shall issue an order 42 25 prohibiting disconnection of service from November 1 through 42 26 April 1 by a regulated public utility furnishing gas or 42 27 electricity to households whose income falls at or below one 42 28 hundred fifty percent of the federal poverty level as 42 29 established by the United States office of management and 42 30 budget. The board shall promptly adopt rules in accordance 42 31 with section 17A.4, subsection 2, and section 17A.5, 42 32 subsection 2, paragraph "b", to implement this requirement. 42 33 The energy assistance bureau of the department of human 42 34 rights, in consultation with the community action agencies, 42 35 shall certify to the utilities, households that are eligible 43 1 for moratorium protection utilizing the agency's existing 43 2 electronic database. Rules adopted under this section shall 43 3 also be published as a notice of intended action as provided 43 4 in section 17A.4. 43 5 43 6 43 7 43 8 MARY E.
