  1  4 RELATING TO SUBJECT MATTER UNDER THE REGULATORY AUTHORITY
  1  5    OF THE LABOR COMMISSIONER, INCLUDING THE CONSTRUCTION
  1  6    CONTRACTORS LAW, AND MAKING NONSUBSTANTIVE CODE
  1  7    CORRECTIONS RELATING TO THE CHILD LABOR LAW.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  Section 91C.1, subsection 1, Code 1997, is
  1 12 amended to read as follows:
  1 13    1.  As used in this chapter, unless the context otherwise
  1 14 requires, "contractor" means a person who engages in the
  1 15 business of construction, as the term "construction" is
  1 16 defined in section 345-3.82 (96), the Iowa Administrative
  1 17 Code, for purposes of the Iowa employment security law.
  1 18 However, a person who earns less than one thousand dollars
  1 19 annually or who performs work or has work performed on the
  1 20 person's own property is not a contractor for purposes of this
  1 21 chapter.  The state, its boards, commissions, agencies,
  1 22 departments, and its political subdivisions including school
  1 23 districts and other special purpose districts, are not
  1 24 contractors for purposes of this chapter.
  1 25    Sec. 2.  Section 91C.7, subsection 5, Code 1997, is amended
  1 26 to read as follows:
  1 27    5.  If it is determined that this section may cause denial
  1 28 of federal funds which would otherwise be available, or would
  1 29 is otherwise be inconsistent with requirements of federal law,
  1 30 this subsection section shall be suspended, but only to the
  1 31 extent necessary to prevent denial of the funds or to
  1 32 eliminate the inconsistency with federal requirements.
  1 33    Sec. 3.  Section 92.9, unnumbered paragraph 1, Code 1997,
  1 34 is amended to read as follows:
  1 35    The provisions of sections 92.8 and 92.10 shall not apply
  2  1 to pupils working under an instructor in a manual training an
  2  2 industrial arts department in the public schools of the state
  2  3 or under an instructor in a school shop, or industrial plant,
  2  4 or in a course of vocational education approved by the board
  2  5 for vocational education, or to apprentices provided they are
  2  6 employed under all of the following conditions:
  2  7    Sec. 4.  Section 92.9, subsection 3, Code 1997, is amended
  2  8 to read as follows:
  2  9    3.  Such The work is intermittent and for short periods of
  2 10 time and is under the direct and close supervision of a
  2 11 journeyman journeyperson as a necessary part of such
  2 12 apprentice training.
