1 20 sections the words "secretary of state" and inserting in lieu
1 21 thereof the words "lieutenant governor", and by striking from
1 22 the sections the words "secretary" and "secretary's" when the
1 23 words are used to refer to the secretary of state and
1 24 inserting in lieu thereof the words "lieutenant governor" and
1 25 "lieutenant governor's", as appropriate.
1 26 2. The Code editor is directed to substitute the words
1 27 "lieutenant governor" for the words "secretary of state" and
1 28 the words "lieutenant governor" or "lieutenant governor's" for
1 29 the words "secretary" or "secretary's", as appropriate, in
1 30 chapters 9, 9A, 9C, 9D, 9E, 9F, 9G, 9H, 261B, 461B, 487, 490,
1 31 490A, 491, 497, 498, 499, 504A, 515, 524, 534, 548, 554, 567,
1 32 and 591, Code 1997, when the words are used to refer to the
1 33 secretary of state.
1 34 3. The Code editor is directed to substitute the words
1 35 "lieutenant governor" for the words "secretary of state" and
2 1 the words "lieutenant governor" or "lieutenant governor's" for
2 2 the words "secretary" or "secretary's", as appropriate, in
2 3 provisions of the Code not otherwise specified in subsections
2 4 1 and 2, when the words are used to refer to the secretary of
2 5 state and there appears to be no doubt that the references are
2 6 to duties which are transferred to the lieutenant governor
2 7 pursuant to subsections 1 and 2.
2 8 Sec. 2. EFFECTIVE DATES – IMPLEMENTATION – TRANSFER OF
2 9 RECORDS.
2 10 1. Section 1 of this Act takes effect January 1, 1998.
2 11 2. In order to implement this Act, upon enactment of this
2 12 Act, the secretary of state, in consultation with the
2 13 lieutenant governor, shall coordinate the transfer to the
2 14 lieutenant governor of any books, accounts, records, forms,
2 15 filings, or similar documents maintained by the secretary of
2 16 state in the performance of the secretary's duties prior to
2 17 the transfer of those duties in accordance with this Act.
2 18 3. This section, being deemed of immediate importance,
2 19 takes effect upon enactment.
2 20 EXPLANATION
2 21 This bill reassigns statutory duties currently assigned to
2 22 the secretary of state that do not have a basis in the Iowa
2 23 Constitution and transfers them to the lieutenant governor.
2 24 The bill provides for the secretary of state to coordinate
2 25 with the lieutenant governor concerning the transfer of
2 26 records pertaining to duties that are transferred under the
2 27 bill, and the provision takes effect upon enactment. The
2 28 remainder of the bill takes effect January 1, 1998.
2 29 Conforming amendments to the Code may be necessary.
