  1  4 RELATING TO PLACEMENTS FOR ADOPTION AND FOSTER CARE BY
  1  5    PROVIDING FOR A FAMILY RIGHTS AND RESPONSIBILITIES PLAN 
  1  6    AND AGREEMENT.
  1  7 
  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  9 
  1 10    Section 1.  Section 232.2, Code 1997, is amended by adding
  1 11 the following new subsection:
  1 12    NEW SUBSECTION.  42A.  "Preadoptive care" means the
  1 13 provision of parental nurturing on a full-time basis to a
  1 14 child in foster care by a person who has signed a preadoptive
  1 15 placement agreement with the department for the purposes of
  1 16 proceeding with a legal adoption of the child.  Parental
  1 17 nurturing includes but is not limited to furnishing of food,
  1 18 lodging, training, education, treatment, and other care.
  1 19    Sec. 2.  Section 232.88, Code 1997, is amended to read as
  1 20 follows:
  1 21    232.88  SUMMONS, NOTICE, SUBPOENAS, AND SERVICES.
  1 22    After a petition has been filed the court shall issue and
  1 23 serve summons, notice, subpoenas, and other process in the
  1 24 same manner as for adjudicatory hearings in cases of juvenile
  1 25 delinquency as provided in section 232.37.  In addition to the
  1 26 persons required to be provided notice under section 232.37,
  1 27 notice for any hearing under this division shall be provided
  1 28 to the agency, facility, institution, or person, including a
  1 29 foster parent or an individual providing preadoptive care,
  1 30 with whom a child has been placed for the purposes of foster
  1 31 care.
  1 32    Sec. 3.  Section 232.91, subsection 2, Code 1997, is
  1 33 amended to read as follows:
  1 34    2.  An agency, facility, institution, or person, including
  1 35 a foster parent or an individual providing preadoptive care,
  2  1 may petition the court to be made a party to proceedings under
  2  2 this division.
  2  3    Sec. 4.  Section 232.147, subsection 3, Code 1997, is
  2  4 amended by adding the following new paragraph:
  2  5    NEW PARAGRAPH.  g.  The child's foster parent or an
  2  6 individual providing preadoptive care to the child.
  2  7    Sec. 5.  Section 237.3, subsection 2, Code 1997, is amended
  2  8 by adding the following new paragraph:
  2  9    NEW PARAGRAPH.  k.  Elements of a foster care placement
  2 10 agreement outlining rights and responsibilities associated
  2 11 with an individual providing family foster care.
  2 12    Sec. 6.  Section 237.3, Code 1997, is amended by adding the
  2 13 following new subsection:
  2 14    NEW SUBSECTION.  9.  The department shall adopt rules
  2 15 specifying the elements of a preadoptive care agreement
  2 16 outlining the rights and responsibilities associated with a
  2 17 person providing preadoptive care, as defined in section
  2 18 232.2.
  2 19    Sec. 7.  Section 237.20, subsection 1, Code 1997, is
  2 20 amended by adding the following new paragraph:
  2 21    NEW PARAGRAPH.  e.  The compliance of the interested
  2 22 parties with the decision-making rights and responsibilities
  2 23 contained in the family foster care or preadoptive care
  2 24 agreement applicable to a child.
  2 25    Sec. 8.  FOSTER AND PREADOPTIVE CARE.  The department of
  2 26 human services, in conjunction with the foster and adoptive
  2 27 parents association, the state citizen foster care review
  2 28 board, and providers of foster care and adoption services,
  2 29 shall develop clear, concise, and consistent written standards
  2 30 relating to the rights and responsibilities of families who
  2 31 provide foster or preadoptive care.
  2 32    1.  The standards shall include but are not limited to
  2 33 identification of the decision-making responsibility for all
  2 34 of the following:
  2 35    a.  Food.
  3  1    b.  Clothing.
  3  2    c.  Housing.
  3  3    d.  Education.
  3  4    e.  Medical care.
  3  5    f.  Dental care.
  3  6    g.  Mental health care.
  3  7    h.  Cultural activities.
  3  8    i.  Recreational activities.
  3  9    j.  Child day care.
  3 10    k.  Family activities.
  3 11    l.  Life skill training.
  3 12    2.  The standards developed in accordance with this section
  3 13 shall be incorporated into the department's placement
  3 14 agreements for foster care and preadoptive care on or before
  3 15 January 1, 1998.  The standards shall not impose unnecessary
  3 16 paperwork requirements and shall be developed as part of the
  3 17 placement agreements, which shall be attached to children's
  3 18 case permanency plans.
