90 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

120 Section 1. Section 461A.25, Code 1997, is amended by
150 adding the following new unnumbered paragraph:
160 NEW UNNUMBERED PARAGRAPH. The commission shall adopt rules
170 providing for granting easements to political subdivisions and
180 utility companies on state land under the jurisdiction of the
190 department. An applicant for an easement shall provide the
200 director with information setting forth the need for the
210 easement, availability of alternatives, and measures proposed
220 to prevent or minimize adverse impacts on the affected
230 property. An easement shall be executed by the director,
240 approved as to form by the attorney general, and if granted
250 for a term longer than five years, approved by the commission.
