ONE HUNDRED FIRST CALENDAR DAY SIXTIETH SESSION DAY Senate Chamber Des Moines, Iowa, Wednesday, April 17, 1996 The Senate met in regular session at 10:45 a.m., President Boswell presiding. Prayer was offered by the Reverend Douglas Swarthout, pastor of the Bennezette Wesleyan Methodist Church, Bristow, Iowa. The Journal of Tuesday, April 16, 1996, was approved. HOUSE MESSAGES RECEIVED The following messages were received from the Chief Clerk of the House: MR. PRESIDENT: I am directed to inform your honorable body that the House has on April 17, 1996, passed the following bill in which the concurrence of the House was asked: Senate File 2321, a bill for an act relating to the nonconfidentiality of information regarding the qualifications of interpreters for the deaf services division of the department of human rights. ALSO: That the House has on April 17, 1996, concurred in the Senate amendment and passed the following bill in which the concurrence of the House was asked: House File 230, a bill for an act relating to procedural requirements for the enforcement of certain copyrights. INTRODUCTION OF RESOLUTION Senate Resolution 120, by Kibbie, Husak, Priebe, Giannetto, Boswell, Jensen, Iverson, and Drake, a senate resolution urging the Commission of Veterans Affairs to provide for the establishment of a state veterans cemetery in central Iowa. Read first time and passed on file. ADOPTION OF RESOLUTIONS (Regular Calendar) Senator Horn asked and received unanimous consent to take up for consideration Senate Concurrent Resolution 124 and House Concurrent Resolution 110. Senate Concurrent Resolution 124 On motion of Senator Dvorsky, Senate Concurrent Resolution 124, a concurrent resolution honoring Ms. Jorie Graham, the 1996 Pulitizer Prize winner in the field of poetry, was taken up for consideration. Senator Dvorsky moved the adoption of Senate Concurrent Resolution 124, which motion prevailed by a voice vote. House Concurrent Resolution 110 On motion of Senator Dearden, House Concurrent Resolution 110, a concurrent resolution requesting the State Department of Transportation to establish a scenic route designation, with report of committee recommending passage, was taken up for consideration. Senator Giannetto offered amendment S-5801 filed by him on April 16, 1996, to pages 1 and 2 of the resolution and moved its adoption. Amendment S-5801 was adopted by a voice vote. Senator Dearden moved the adoption of House Concurrent Resolution 110 as amended, which motion prevailed by a voice vote. HOUSE AMENDMENTS CONSIDERED Senate File 2301 Senator Dvorsky called up for consideration Senate File 2301, a bill for an act relating to lead abatement and inspection, training and certification requirements, and providing penalties, amended by the House, and moved that the Senate concur in House amendment S-5789 filed April 16, 1996. The motion prevailed by a voice vote and the Senate concurred in the House amendment. Senate File 2298 Senator Vilsack called up for consideration Senate File 2298, a bill for an act relating to the awarding of costs to a prevailing taxpayer in a proceeding against the department of revenue and finance under the state tax procedures and practices Act and providing an effective date, amended by the House, and moved that the Senate concur in House amendment S-5744 filed April 12, 1996. The motion lost by a voice vote and the Senate refused to concur in the House amendment. Senate File 2207 Senator Szymoniak called up for consideration Senate File 2207, a bill for an act relating to excuse from jury service and the reimbursement of jurors and witnesses for transportation and mileage expenses, amended by the House, and moved that the Senate concur in House amendment S-5788 filed April 12, 1996. CONSIDERATION OF BILL (Ways and Means Calendar) Senate File 2463 On motion of Senator Connolly, Senate File 2463, a bill for an act relating to estate issues by modifying certain exemptions and tax rates for inheritance taxes, the jurisdiction of the probate court on certain testamentary trusts, fees payable on certain trusts, claims against estates for medical assistance payments, registration of securities in a transfer-on-death form, and including an applicability provision, was taken up for consideration. Senator Bennett asked and received unanimous consent that action on amendment S-5694 filed by him on April 9, 1996, be deferred. Senator Bennett offered amendment S-5695 filed by him on April 9, 1996, to pages 3 and 13 of the bill. Senator Connolly asked and received unanimous consent that action on amendment S-5695 and Senate File 2463 be deferred.
