ONE HUNDRED SIXTH CALENDAR DAY SIXTY-SECOND SESSION DAY Senate Chamber Des Moines, Iowa, Monday, April 22, 1996 The Senate met in regular session at 2:02 p.m., President pro tempore Bisignano presiding. Prayer was offered by the Honorable Merlin E. Bartz, member of the Senate from Worth County, Grafton, Iowa. The Journal of Thursday, April 18, 1996, was approved. HOUSE MESSAGES RECEIVED AND CONSIDERED The following messages were received from the Chief Clerk of the House: MR. PRESIDENT: I am directed to inform your honorable body that the House has on April 18, 1996, amended and passed the following bill in which the concurrence of the Senate is asked: Senate File 2195, a bill for an act relating to the Iowa communications network by providing for state ownership of a Part III connection and for the connection and support of certain Part III users, making appropriations, and providing effective dates (S-5821). ALSO: That the House has on April 22, 1996, passed the following bill in which the concurrence of the Senate is asked: House File 2480, a bill for an act relating to property taxation of property given to the state or a political subdivision upon which a life estate is retained. This bill was read first time and passed on file. ALSO: That the House has on April 22, 1996, concurred in the Senate amendment and passed the following bill in which the concurrence of the House was asked: House File 2491, a bill for an act relating to the care and maintenance of pioneer cemeteries and authorizing a tax levy. QUORUM CALL Senator Judge requested a non record roll call to determine that a quorum was present. The vote revealed 44 present, 6 absent and a quorum present. Senator Hansen took the chair at 2:17 p.m. President pro tempore Bisignano took the chair at 2:31 p.m. President Boswell took the chair at 3:05 p.m. RESOLUTIONS ASSIGNED TO COMMITTEE The Chair announced the assignment of the following resolutions to committee: S.R. 121 State Government H.C.R. 125 Agriculture H.C.R. 129 Judiciary LEAVE OF ABSENCE Leave of absence was granted as follows: Senator McLaren until he arrives on request of Senator Rife. CONSIDERATION OF BILL (Regular Calendar) Senator Horn asked and received unanimous consent to take up for consideration House File 2499. House File 2499 On motion of Senator Flynn, House File 2499, a bill for an act relating to definitions, reporting, and remittance guidelines concerning the disposition of unclaimed property, with report of committee recommending passage, was taken up for consideration. Senator Flynn moved that the bill be read the last time now and placed upon its passage, which motion prevailed by a voice vote, and the bill was read the last time. On the question Shall the bill pass? HOUSE AMENDMENT CONSIDERED Senate File 2370 Senator Gronstal called up for consideration Senate File 2370, a bill for an act relating to energy efficiency and alternate energy programs, electric and gas public utility energy efficiency mandates, and the Iowa energy center and the center for global and regional environmental research and requiring the location of a principal office within the state and providing an effective date and providing an applicability provision, amended by the House in House amendment S-5818 filed April 18, 1996. The Senate stood at ease at 3:15 p.m. until the fall of the gavel for the purpose of a caucus. The Senate resumed session at 3:56 p.m., President Boswell presiding. BUSINESS PENDING Senate File 2370 The Senate resumed consideration of Senate File 2370. Senator Freeman offered amendment S-5826 filed by Senators Freeman, et al., from the floor to House amendment S-5818. Senator Freeman asked and received unanimous consent that action on amendment S-5826 to House amendment S-5818 be deferred. Senator Freeman offered amendment S-5825 filed by Senators Freeman, et al., from the floor to House amendment S-5818 and moved its adoption. A record roll call was requested. On the question Shall amendment S-5825 to House amendment S-5818 be adopted? (S.F. 2370) the vote was: Rule 23, requiring all Senators present to vote except those who express a conflict of interest, was invoked. With the adoption of amendment S-5825 to House amendment S-5818, the Chair ruled the following amendments filed from the floor to House amendment S-5818, out of order: S-5824 filed by Senators Freeman, et al., and S-5823 filed by Senators Fink, et al. The Senate resumed consideration of amendment S-5826 by Senators Freeman, et al., to House amendment S-5818. Senator Gronstal asked and received unanimous consent that action on amendment S-5826 to House amendment S-5818, House amendment S-5818 and Senate File 2370 be deferred. UNFINISHED BUSINESS (Deferred April 17, 1996) House File 2234 The Senate resumed consideration of House File 2234, a bill for an act relating to exempting certain nonresident aliens from land ownership restrictions, amendment S-5514 by the committee on Small Business, Economic Development and Tourism to page 1 of the bill, and division S-5786B by Senator Bennett to amendment S-5514, deferred April 17, 1996 (amendment S-5633 to amendment S-5514 pending). Senator Bennett moved the adoption of division S-5786B to amendment S-5514, which motion prevailed by a voice vote. Senator Priebe offered amendment S-5766 filed by Senators Priebe, et al., on April 15, 1996, to amendment S-5514 and moved its adoption. Amendment S-5766 was adopted by a voice vote. With the adoption of division S-5786B to amendment S-5514, the Chair ruled amendment S-5633 by Senator Bennett to amendment S-5514, reconsidered and pending on April 17, 1996, and amendment S-5698 by Senator Bennett to amendment S-5514, deferred on April 17, 1996, out of order. Senator Hansen moved the adoption of amendment S-5514 as amended, which motion prevailed by a voice vote. Senator Bennett moved that the bill be read the last time now and placed upon its passage, which motion prevailed by a voice vote, and the bill was read the last time.
