1 2 reprinted by the Senate, as follows:
1 3 #1. By striking everything after the enacting
1 4 clause and inserting the following:
1 5 "Section 1. There is appropriated from the general
1 6 fund of the state to the Iowa communications network
1 7 fund created in section 8D.14 for the fiscal year
1 8 beginning July 1, 1996, and ending June 30, 1997, the
1 9 following amount, or so much thereof as is necessary,
1 10 to be used for the purpose designated:
1 11 For debt service:
1 12 .................................................. $ 12,754,000
1 13 Upon the appropriation of the funds in this section
1 14 to the Iowa communications network fund, the Iowa
1 15 telecommunications and technology commission shall
1 16 immediately transfer $12,754,000 of the appropriated
1 17 amount to a separate fund established in the office of
1 18 the treasurer of state, to be used solely for debt
1 19 service for the Iowa communications network. The
1 20 commission shall certify to the treasurer of state
1 21 when a debt service payment is due, and upon receipt
1 22 of the certification the treasurer shall make the
1 23 payment. The commission shall pay any additional
1 24 amount due from funds deposited in the Iowa
1 25 communications network fund.
1 26 Sec. 2. PART III RELATED APPROPRIATIONS.
1 27 1. PART III AUTHORIZED USERS.
1 28 a. There is appropriated from the rebuild Iowa
1 29 infrastructure fund of the state created in section
1 30 8.57, subsection 5, to the Iowa communications network
1 31 fund under the control of the Iowa telecommunications
1 32 and technology commission for the fiscal year
1 33 beginning July 1, 1996, and ending June 30, 1997, the
1 34 following amount, or so much thereof as is necessary,
1 35 to be used for the purpose designated:
1 36 For the connection of a minimum of 110 Part III
1 37 authorized users as determined by the commission and
1 38 communicated to the general assembly:
1 39 .................................................. $ 19,600,095
1 40 b. It is the intent of the general assembly that
1 41 the connection of the authorized user sites pursuant
1 42 to this subsection be awarded based upon the Part III
1 43 contracts executed in 1995.
1 44 c. Notwithstanding the fact that funds
1 45 appropriated pursuant to this subsection will not be
1 46 made available prior to July 1, 1996, the Iowa
1 47 telecommunications and technology commission is
1 48 authorized to negotiate and enter into contracts for
1 49 ordering necessary equipment related to the completion
1 50 of the connections authorized in paragraph "a" as
2 1 deemed appropriate by the commission upon the
2 2 effective date of this paragraph.
2 3 2. PART III NETWORK COSTS – SUBSIDIZATION FUND.
2 4 There is appropriated from the general fund of the
2 5 state to the Iowa communications network fund created
2 6 in section 8D.14 for the fiscal year beginning July 1,
2 7 1996, and ending June 30, 1997, the following amount,
2 8 or so much thereof as is necessary, to be used for the
2 9 purposes designated in this subsection:
2 10 For the subsidization of video rates for authorized
2 11 users as determined by the commission and consistent
2 12 with chapter 8D:
2 13 .................................................. $ 2,400,000
2 14 ............................................... FTEs 57.00
2 15 3. PART III NETWORK COSTS – MAINTENANCE AND LEASE
2 16 COSTS.
2 17 a. There is appropriated from the rebuild Iowa
2 18 infrastructure fund of the state created in section
2 19 8.57, subsection 5, to the Iowa communications network
2 20 fund under the control of the Iowa telecommunications
2 21 and technology commission for the fiscal year
2 22 beginning July 1, 1996, and ending June 30, 1997, the
2 23 following amount, or so much thereof as is necessary,
2 24 to be used for the purpose designated:
2 25 For maintenance costs and recurring lease costs as
2 26 provided in this subsection:
2 27 .................................................. $ 1,199,905
2 28 b. As a condition of the appropriation in this
2 29 subsection, $209,298 of the amount appropriated shall
2 30 be expended by the Iowa telecommunications and
2 31 technology commission for maintenance costs associated
2 32 with Part III connections of the network.
2 33 c. As a further condition of the appropriation in
2 34 this subsection, $990,607 of the amount appropriated
2 35 shall be expended by the Iowa telecommunications and
2 36 technology commission for recurring lease costs
2 37 associated with Part III connections of the network.
2 38 Sec. 3. LEGISLATIVE INTENT.
2 39 1. It is the intent of the general assembly that
2 40 the Iowa telecommunications and technology commission
2 41 direct the telecommunications advisory committee
2 42 established in section 8D.7, in consultation with the
2 43 department of management, to develop recommendations
2 44 concerning the expenses which should be recovered in
2 45 the rates established by the commission for use of the
2 46 network, and any necessary subsidies. The commission
2 47 shall develop the commission's budget recommendations
2 48 for the fiscal year beginning July 1, 1997, after
2 49 consideration of these recommendations.
2 50 2. It is also the intent of the general assembly
3 1 that the commission conduct a study concerning the
3 2 possibility of allowing Internet service providers to
3 3 petition the commission to provide Internet service to
3 4 authorized users in areas of the state where there is
3 5 no local Internet service, if permitting such Internet
3 6 service providers to provide such service will result
3 7 in Internet service being available to areas where the
3 8 authorized user is located.
3 9 3. It is also the intent of the general assembly
3 10 that the commission establish a waiver process for
3 11 site-based charges to permit an authorized user to
3 12 recover the authorized user's cost of providing the
3 13 use of the authorized user's facility to another
3 14 person.
3 15 4. It is also the intent of the general assembly
3 16 that the education telecommunications council and the
3 17 regional telecommunications councils give priority to
3 18 network video usage during the normal school hours for
3 19 grades prekindergarten through twelve at those video
3 20 sites which are located within school district
3 21 facilities. The commission, in consultation with the
3 22 education telecommunications council, shall establish
3 23 a policy for flexibility of use for educational video
3 24 classrooms during normal school hours for events
3 25 unrelated to network use.
3 26 Sec. 4. CONTRACT MODIFICATION. Notwithstanding
3 27 section 8D.13, the commission is authorized to
3 28 negotiate a contract with Sooland Cable involving the
3 29 connection of five Part III sites, to provide for a
3 30 lump-sum payment at the time of installation and
3 31 activation of the circuit which will result in a real
3 32 savings within a range of $23,400 up to $27,000 per
3 33 site when compared to the original contract price.
3 34 Sec. 5. ADDITIONAL CONNECTIONS.
3 35 1. LEWIS CENTRAL HIGH SCHOOL. Notwithstanding
3 36 section 8D.13, subsection 5, the state may own and the
3 37 Iowa telecommunications and technology commission
3 38 shall provide for the construction and connection to
3 39 the Iowa communications network of the Lewis Central
3 40 high school, located in Council Bluffs and contiguous
3 41 to the school for the deaf established under chapter
3 42 270.
3 43 2. ADDITIONS TO PART III. The Iowa
3 44 telecommunications and technology commission may
3 45 contract for construction relating to connections to
3 46 the Iowa communications network for the following
3 47 authorized users which were not identified in the
3 48 original Part III request for proposals, but which
3 49 meet the definition of a Part III user pursuant to
3 50 section 8D.13, subsection 2, paragraph "c":
4 1 a. Wall LakeView middle school, Wall Lake.
4 2 b. Meservey-Thornton community school district,
4 3 Thornton.
4 4 c. Eldora state training school, Eldora.
4 5 d. Iowa juvenile home, Toledo.
4 6 e. Any other public school district, identified by
4 7 the commission, which does not have a connection to
4 8 the network.
4 9 Sec. 6. EFFECTIVE DATE.
4 10 1. Section 2, subsection 1, paragraph "c", of this
4 11 Act, which authorizes the Iowa telecommunications and
4 12 technology commission to begin negotiations for
4 13 ordering necessary equipment prior to the availability
4 14 of funding, being deemed of immediate importance,
4 15 takes effect upon enactment.
4 16 2. Section 5, subsection 1, of this Act, which
4 17 authorizes the state to construct and own the Iowa
4 18 communications network connection to Lewis Central
4 19 high school, being deemed of immediate importance,
4 20 takes effect upon enactment."
