1 3 as follows:
1 4 #1. Page 1, line 35, by striking the figure "3."
1 5 and inserting the following: "3 and inserting the
1 6 following:
1 7 "Sec. . It is the intent of the general
1 8 assembly that an energy supplier who has proceeded in
1 9 good faith under the terms and conditions of chapter
1 10 476 not suffer economic loss as a result of action or
1 11 inaction taken by the state. These persons shall be
1 12 reimbursed by the utilities for their reasonable good
1 13 faith costs as determined by the Iowa utilities board.
1 14 An energy supplier shall be deemed to have proceeded
1 15 in good faith if the supplier has filed a petition by
1 16 January 1, 1996, which requests enforcement of the
1 17 provisions of sections 476.43 and 476.44 by requiring
1 18 an electric utility to enter into a potential contract
1 19 with the energy supplier and an action is currently
1 20 pending before the Iowa utilities board.""
