  2  2 purposes designated:
  2  3    For operating costs of the Stafford loan program
  2  4 including salaries, support, maintenance,
  2  5 miscellaneous purposes, and for not more than the
  2  6 following full-time equivalent positions:

  2  9    Sec. 3.  The department of revenue and finance
  2 10 shall deposit interest earned on the Pub. L. No. 105-
  2 11 33 recall account within the office of the treasurer
  2 12 of state during the fiscal year ending June 30, 1999,
  2 13 in the fund 61 default reduction account.  Moneys in
  2 14 the fund 61 default reduction account are appropriated
  2 15 to the college student aid commission for the fiscal
  2 16 year beginning July 1, 1999, and ending June 30, 2000,
  2 17 for purposes of issuing emergency loans to assist
  2 18 needy students in avoiding default on a guaranteed or
  2 19 parental loan made under chapter 261.
  2 20    Sec. 4.  REMAINING NATIONAL GUARD TUITION AID
  2 21 PROGRAM BALANCE.  Notwithstanding section 8.33, the
  2 22 unencumbered or unobligated moneys remaining at the
  2 23 end of the fiscal year ending June 30, 1999, from the
  2 24 appropriations made in 1998 Iowa Acts, chapter 1215,
  2 25 section 1, subsection 4, shall not revert but shall be
  2 26 available for expenditure during the subsequent fiscal
  2 27 year for the purposes of the national guard tuition
  2 28 aid program.
  2 29    Sec. 5.  REMAINING INDUSTRIAL TECHNOLOGY FORGIVABLE
  2 30 LOAN PROGRAM BALANCE.  Notwithstanding section 8.33 or
  2 31 section 261.25, subsection 4, Code 1999, or any other
  2 32 provision to the contrary, unencumbered or unobligated
  2 33 funds remaining on June 30, 1999, for purposes of the
  2 34 industrial technology forgivable loan program
  2 35 established in section 261.111, shall be available to
  2 36 the college student aid commission for expenditure for
  2 37 the fiscal year beginning July 1, 1999, and for
  2 38 succeeding fiscal years for the purposes of the
  2 39 teacher shortage forgivable loan program established
  2 40 in section 261.111 if enacted by an Act of the 1999
  2 41 Session.

  2 43    Sec. 6.  There is appropriated from the general
  2 44 fund of the state to the department of cultural
  2 45 affairs for the fiscal year beginning July 1, 1999,

  4 27    From the funds appropriated in this lettered
  4 28 paragraph, up to $2,000,000 shall be used to provide
  4 29 services to persons without regard to an order of
  4 30 selection.  The division shall seek additional local
  4 31 matching funds in an amount sufficient to avoid any
  4 32 loss of federal funds.
  4 33    The division of vocational rehabilitation services
  4 34 shall seek a waiver from the federal government to
  4 35 accept assessments of clients performed by area
  4 36 education agencies or any other governmental
  4 37 subdivision.  The division shall also seek additional
  4 38 federal waivers to improve and increase the
  4 39 availability of supported employment services to
  4 40 Iowans.
  4 41    The division of vocational rehabilitation services
  4 42 shall seek funds other than federal funds, which may
  4 43 include but are not limited to local funds from local
  4 44 provider entities, community colleges, area education
  4 45 agencies, and local education agencies, for purposes
  4 46 of matching federal vocational rehabilitation funds.
  4 47 The funds collected by the division may exceed the
  4 48 amount needed to match available federal vocational
  4 49 rehabilitation funds in an effort to qualify for
  4 50 additional federal funds when such funds become
  5  1 available.
  5  2    Except where prohibited under federal law, the
  5  3 division of vocational rehabilitation services of the
  5  4 department of education shall accept client
  5  5 assessments, or assessments of potential clients,
  5  6 performed by other agencies in order to reduce
  5  7 duplication of effort.
  5  8    Notwithstanding the full-time equivalent position
  5  9 limit established in this lettered paragraph, for the
  5 10 fiscal year ending June 30, 2000, if federal funding
  5 11 is received to pay the costs of additional employees
  5 12 for the vocational rehabilitation services division
  5 13 who would have duties relating to vocational
  5 14 rehabilitation services paid for through federal
  5 15 funding, authorization to hire not more than 4.00
  5 16 additional full-time equivalent employees shall be
  5 17 provided, the full-time equivalent position limit
  5 18 shall be exceeded, and the additional employees shall
  5 19 be hired by the division.
  5 20    The division of vocational rehabilitation services
  5 21 shall enter into a chapter 28E agreement with the
  5 22 creative employment options program at the state
  5 23 university of Iowa, or take whatever other action is
  5 24 necessary, to enable the division to count as a local
  5 25 match the state funds appropriated to the university
  5 26 for purposes of the creative employment options
  5 27 program.
  5 28    b.  For matching funds for programs to enable
  5 29 persons with severe physical or mental disabilities to
  5 30 function more independently, including salaries and
  5 31 support, and for not more than the following full-time
  5 32 equivalent positions:

  5 35    The highest priority use for the moneys
  5 36 appropriated under this lettered paragraph shall be
  5 37 for programs that emphasize employment and assist
  5 38 persons with severe physical or mental disabilities to
  5 39 find and maintain employment to enable them to
  5 40 function more independently.
  5 41    5.  STATE LIBRARY
  5 42    a.  For salaries, support, maintenance,
  5 43 miscellaneous purposes, and for not more than the
  5 44 following full-time equivalent positions:

  5 47    Reimbursement of the institutions of higher
  5 48 learning under the state board of regents for
  5 49 participation in the access plus program during the
  5 50 fiscal year beginning July 1, 1999, and ending June
  6  1 30, 2000, shall not exceed the total amount of
  6  2 reimbursement paid to the regents institutions of
  6  3 higher learning for participation in the access plus
  6  4 program during the fiscal year beginning July 1, 1998,
  6  5 and ending June 30, 1999.
  6  6    b.  For a one-year enrich Iowa pilot program:  
  6  7 .................................................. $    700,000
  6  8    (1)  Funds allocated for purposes of the enrich
  6  9 Iowa pilot program as provided in this lettered
  6 10 paragraph shall be distributed by the division of
  6 11 libraries and information services to eligible public
  6 12 libraries that are in compliance with performance
  6 13 measures adopted by rule by the commission.  The funds
  6 14 allocated as provided in this lettered paragraph shall
  6 15 not be used for the costs of administration by the
  6 16 division.  The amount distributed to each eligible
  6 17 public library shall be based upon the following:
  6 18    (a)  The level of compliance by the eligible public
  6 19 library with the performance measures adopted by the
  6 20 commission as provided in this subsection.
  6 21    (b)  The number of people residing within an
  6 22 eligible library's geographic service area for whom
  6 23 the library provides services.
  6 24    (c)  The amount of other funding the eligible
  6 25 public library received in the previous fiscal year
  6 26 for providing services to rural residents and to
  6 27 contracting communities.
  6 28    (2)  Moneys received by a public library under this
  6 29 lettered paragraph shall supplement, not supplant, any
  6 30 other funding received by the library.
  6 31    (3)  For purposes of this section, "eligible public
  6 32 library" means a public library that meets at least
  6 33 all of the following requirements:
  6 34    (a)  Submits to the division all of the following:
  6 35    (i)  The report provided for under section 256.51,
  6 36 subsection 1, paragraph "h".
  6 37    (ii)  An application and accreditation report, in a
  6 38 format approved by the commission, that provides
  6 39 evidence of the library's compliance with at least one
  6 40 level of the standards established in accordance with
  6 41 section 256.51, subsection 1, paragraph "k".
  6 42    (iii)  Any other application or report the division
  6 43 deems necessary for the implementation of the enrich
  6 44 Iowa program.
  6 45    (b)  Participates in the library resource and
  6 46 information sharing programs established by the state
  6 47 library.
  6 48    (c)  Is a public library established by city
  6 49 ordinance or a county library as provided in chapter
  6 50 336.
  7  1    (4)  Each eligible public library shall maintain a
  7  2 separate listing within its budget for payments
  7  3 received and expenditures made pursuant to this
  7  4 section, and shall annually submit this listing to the
  7  5 division.
  7  6    (5)  By January 15, 2000, the division shall submit
  7  7 a program evaluation report to the general assembly
  7  8 and the governor detailing the uses and the impacts of
  7  9 funds allocated under this lettered paragraph.  It is
  7 10 the intent of the general assembly to address the
  7 11 continuation of the enrich Iowa pilot program during
  7 12 the 2000 legislative session.
  7 13    6.  REGIONAL LIBRARY
  7 14    For state aid:  
  7 15 .................................................. $  1,687,000
  7 16    The division of libraries and information services
  7 17 shall submit a list of current regional library
  7 18 employees and their salaries to the department of
  7 19 management by August 1, 1999.  The list shall be used
  7 20 by the department for purposes of calculating the
  7 21 annual salary increase need, based on the salary
  7 22 increases negotiated by the American federation of
  7 23 state, county, and municipal employees.  The amount
  7 24 calculated by the department for salary need shall be
  7 25 included in the regional library budget request
  7 26 submitted to the governor for the fiscal year
  7 27 beginning July 1, 2000, and ending June 30, 2001.
  7 28    7.  PUBLIC BROADCASTING DIVISION
  7 29    For salaries, support, maintenance, capital
  7 30 expenditures, miscellaneous purposes, and for not more
  7 31 than the following full-time equivalent positions:

  7 34    8.  VOCATIONAL EDUCATION TO SECONDARY SCHOOLS
  7 35    For reimbursement for vocational education

  7 38    Funds appropriated in this subsection shall be used
  7 39 for expenditures made by school districts to meet the
  7 40 standards set in sections 256.11, 258.4, and 260C.14
  7 41 as a result of the enactment of 1989 Iowa Acts,
  7 42 chapter 278.  Funds shall be used as reimbursement for
  7 43 vocational education expenditures made by secondary
  7 44 schools in the manner provided by the department of
  7 45 education for implementation of the standards set in
  7 46 1989 Iowa Acts, chapter 278.
  7 47    9.  SCHOOL FOOD SERVICE
  7 48    For use as state matching funds for federal
  7 49 programs that shall be disbursed according to federal
  7 50 regulations, including salaries, support, maintenance,
  8  1 miscellaneous purposes, and for not more than the
  8  2 following full-time equivalent positions:

  8  6    For deposit in the school ready children grants

  8 11    To provide funds for costs of providing textbooks
  8 12 to each resident pupil who attends a nonpublic school

  8 14 limited to $20 per pupil and shall not exceed the
  8 15 comparable services offered to resident public school
  8 16 pupils:

  8 19    To assist a vocational agriculture youth

  8 28    Notwithstanding section 8.33, funds appropriated
  8 29 for purposes of this section which remain unencumbered
  8 30 or unobligated at the close of the fiscal year, shall
  8 31 not revert but shall be available for expenditure for
  8 32 purposes of issuing national board certification
  8 33 awards during the succeeding fiscal year.
  8 34    14.  EMPLOYABILITY SKILLS ASSESSMENTS
  8 35 REIMBURSEMENTS
  8 36    For reimbursement of school district claims for the
  8 37 costs of acquiring and using employability skills
  8 38 assessment tools as provided in this subsection:  
  8 39 .................................................. $    185,000
  8 40    a.  The department of education shall reimburse
  8 41 school district claims for the costs of acquiring,
  8 42 administering, and scoring assessment tools to assess
  8 43 the employability skills of students.  The director of
  8 44 education shall identify available employability
  8 45 skills assessment tools that school districts may use
  8 46 to meet the claim reimbursement requirements of this
  8 47 subsection.
  8 48    b.  In order to be eligible for reimbursement under
  8 49 this subsection, a school district shall submit a
  8 50 claim on forms provided by the department by July 15,
  9  1 2000, and the claim shall state the actual costs
  9  2 incurred and shall be accompanied by an affidavit of
  9  3 an officer of the school district affirming the
  9  4 accuracy of the claim.
  9  5    c.  A school district that submits to the
  9  6 department a claim for reimbursement in accordance
  9  7 with this subsection shall develop and integrate
  9  8 specific employability skills goals and activities
  9  9 into the comprehensive school improvement plan
  9 10 required under section 256.7, subsection 21, paragraph
  9 11 "a".
  9 12    d.  The department of education shall certify to
  9 13 the department of revenue and finance the amounts of
  9 14 approved claims to be paid, and the department of
  9 15 revenue and finance shall draw warrants payable to
  9 16 school districts with approved claims, taking into
  9 17 consideration the relative budget and cash position of
  9 18 the state resources.
  9 19    e.  Moneys received under this subsection shall not
  9 20 be commingled with state aid payments made under
  9 21 section 257.16 to a school district and shall be
  9 22 accounted for by the school district separately from
  9 23 state aid payments.  Payments made to a school
  9 24 district under this subsection are miscellaneous
  9 25 income for purposes of chapter 257.
  9 26    f.  If the funds appropriated in this subsection
  9 27 are insufficient to pay in full the claims submitted
  9 28 by school districts and approved by the department,
  9 29 the amounts of approved claims shall be prorated among
  9 30 all school districts with approved claims.
  9 31    15.  BEGINNING TEACHER INDUCTION PROGRAM
  9 32    For purposes of the beginning teacher induction
  9 33 program as provided in section 256E.2, if enacted by
  9 34 1999 Iowa Acts, Senate File 232:  
  9 35 .................................................. $    300,000
  9 36    Notwithstanding section 8.33, moneys appropriated
  9 37 in this section that remain unencumbered or
  9 38 unobligated at the close of the fiscal year shall not
  9 39 revert but shall remain available for expenditure for
  9 40 the purposes designated until the close of the
  9 41 succeeding fiscal year.
  9 42    16.  COMMUNITY COLLEGES
  9 43    For general state financial aid, including general
  9 44 financial aid to merged areas in lieu of personal
  9 45 property tax replacement payments, to merged areas as
  9 46 defined in section 260C.2, for vocational education
  9 47 programs in accordance with chapters 258 and 260C:

 10 16    Sec. 8.  DISTRIBUTION OF FUNDS APPROPRIATED.  For
 10 17 the fiscal year beginning July 1, 1999, and ending
 10 18 June 30, 2000, moneys appropriated by the general
 10 19 assembly from the general fund to the department of
 10 20 education for community colleges for a fiscal year
 10 21 shall be allocated to each community college by the
 10 22 department of education in the following manner:
 10 23    1.  BASE FUNDING.  The base funding for a fiscal
 10 24 year shall be equal to the amount each community
 10 25 college received as an allocation from appropriations
 10 26 made from the general fund of the state in the most
 10 27 recent fiscal year.
 10 28    2.  DISTRIBUTION FOR INFLATION.  First priority
 10 29 shall be to give each college an increase based upon
 10 30 inflation.  The inflation increase shall be not less
 10 31 than 2 percent.  However, the inflation increase shall
 10 32 be equal to the national inflation rate, if it exceeds
 10 33 2 percent, if the amount of state aid appropriated is
 10 34 equal to or greater than the national inflation rate.
 10 35    3.  DISTRIBUTION BASED ON PROPORTIONAL SHARE OF
 10 36 ENROLLMENT.  The balance of the growth in state aid
 10 37 appropriations, once the inflation increase has been
 10 38 satisfied, shall be distributed based on each
 10 39 college's proportional share of enrollment.  However,
 10 40 a minimum of one percent of the total growth shall be
 10 41 distributed in this manner.
 10 42    4.  If the total appropriation made by the general
 10 43 assembly is less than 2 percent growth, the entire
 10 44 increase shall be distributed as inflation.
 10 45    Sec. 9.  BOARD OF EDUCATIONAL EXAMINERS LICENSING
 10 46 FEES.  Notwithstanding section 272.10, up to 85
 10 47 percent of any funds received annually resulting from
 10 48 an increase in fees approved and implemented for
 10 49 licensing by the state board of educational examiners
 10 50 after July 1, 1997, shall be available for the fiscal
 11  1 year beginning July 1, 1999, to the state board for
 11  2 purposes related to the state board's duties,
 11  3 including, but not limited to, additional full-time
 11  4 equivalent positions.  The director of revenue and
 11  5 finance shall draw warrants upon the treasurer of
 11  6 state from the funds appropriated as provided in this
 11  7 section and shall make the funds resulting from the
 11  8 increase in fees available during the fiscal year to
 11  9 the state board on a monthly basis.
 11 10    Sec. 10.  FISCAL YEAR 1999-2000 EXTENDED SCHOOL
 11 11 YEAR GRANT MONEYS – DISTRIBUTION.
 11 12    1.  Notwithstanding section 8.33 and section
 11 13 256.22, subsection 4, from the funds appropriated in
 11 14 1998 Iowa Acts, chapter 1216, section 1, subsection 1,
 11 15 to the department of education for extended school
 11 16 year grants, which remain unencumbered or unobligated
 11 17 on June 30, 1999, the sum of $675,000 shall not revert
 11 18 to the general fund of the state and shall not be
 11 19 available for expenditure for the following fiscal
 11 20 year for purposes of extended school year grants, but
 11 21 shall be reallocated by the department as follows:
 11 22    a.  The sum of $200,000 to the board of educational
 11 23 examiners for a one-year pilot program study to assess
 11 24 the performance of teacher education graduates at no
 11 25 charge to the graduates.  The department of education,
 11 26 the board of educational examiners, and the college
 11 27 student aid commission shall determine the number of
 11 28 students that will be tested at each postsecondary
 11 29 institution that provides an approved practitioner
 11 30 preparation program in a manner that will result in a
 11 31 reliable statistical sampling.  It is the intent of
 11 32 the general assembly that if the board recommends
 11 33 statewide implementation of the assessment prior to
 11 34 initial licensure, the costs of an assessment shall be
 11 35 paid by the teacher education graduate applying for
 11 36 initial licensure.
 11 37    b.  The sum of $100,000 to the division of
 11 38 libraries and information services for promotion of
 11 39 the next decennial federal census.
 11 40    c.  The sum of $100,000 to the department of
 11 41 education for distribution to the reading recovery
 11 42 center.
 11 43    d.  The sum of $60,000 to the department of
 11 44 education for support of the family resource center
 11 45 demonstration program established under chapter 256C.
 11 46    e.  The sum of $165,000 to the department of
 11 47 education for reimbursement of school district claims
 11 48 for the costs of acquiring and using employability
 11 49 skills assessment tools as provided in section 7,
 11 50 subsection 14, of this Act.
 12  1    f.  The sum of $50,000 to the department of
 12  2 cultural affairs for the local arts comprehensive
 12  3 educational strategies program (LACES) for contracting
 12  4 with the Iowa alliance for arts education to execute
 12  5 their local arts comprehensive educational strategies.
 12  6 The sum reallocated in this lettered paragraph is in
 12  7 addition to funds appropriated in section 6,
 12  8 subsection 5, of this Act.
 12  9    Sec. 11.  REGIONAL LIBRARIES STUDY.  The
 12 10 legislative council is requested to establish an
 12 11 interim study committee to review the issues
 12 12 concerning making regional library staff state
 12 13 employees.  The interim study committee shall submit a
 12 14 report of recommendations concerning these issues and
 12 15 recommendations for any necessary legislation to the
 12 16 general assembly by December 1, 1999.
 12 17    Sec. 12.  COMMUNITY COLLEGE GOVERNANCE TASK FORCE.
 12 18 The legislative council is requested to establish an
 12 19 interim task force consisting of members of both
 12 20 political parties from both houses of the general
 12 21 assembly, the office of the governor, representatives
 12 22 of the Iowa association of community college trustees,
 12 23 the Iowa association of community college presidents,
 12 24 and the division of community colleges and workforce
 12 25 preparation of the department of education, to
 12 26 identify and study options for restructuring the
 12 27 community college governance system.  The goal of the
 12 28 task force shall be to determine a plan for a
 12 29 community college governance structure that causes
 12 30 community colleges to operate more cooperatively,
 12 31 effectively, and efficiently as a state system, while
 12 32 recognizing the strong local character of community
 12 33 colleges.  The task force shall review the current
 12 34 community college governance system; ongoing
 12 35 collaborative efforts among the community colleges;
 12 36 the relationships between the community colleges and
 12 37 local school districts, accredited nonpublic schools,
 12 38 other accredited postsecondary institutions in Iowa,
 12 39 and the department of education; and changes necessary
 12 40 to enhance the accountability of community colleges.
 12 41 The task force shall submit its findings and
 12 42 recommendations for a plan for a restructuring of the
 12 43 community college governance system that achieves the
 12 44 goals set forth in this section in a report to the
 12 45 chairpersons and ranking members of the senate and
 12 46 house standing committees on education and the joint
 12 47 appropriations subcommittee on education by December
 12 48 1, 1999.  
 12 49                 STATE BOARD OF REGENTS
 12 50    Sec. 13.  There is appropriated from the general
 13  1 fund of the state to the state board of regents for
 13  2 the fiscal year beginning July 1, 1999, and ending

 14 21    The university of Iowa hospitals and clinics shall
 14 22 submit quarterly a report regarding the portion of the
 14 23 appropriation in this lettered paragraph expended on
 14 24 medical education.  The report shall be submitted in a
 14 25 format jointly developed by the university of Iowa
 14 26 hospitals and clinics, the legislative fiscal bureau,
 14 27 and the department of management, and shall delineate
 14 28 the expenditures and purposes of the funds.
 14 29    Funds appropriated in this lettered paragraph shall
 14 30 not be used to perform abortions except medically
 14 31 necessary abortions, and shall not be used to operate
 14 32 the early termination of pregnancy clinic except for
 14 33 the performance of medically necessary abortions.  For
 14 34 the purpose of this lettered paragraph, an abortion is
 14 35 the purposeful interruption of pregnancy with the
 14 36 intention other than to produce a live-born infant or
 14 37 to remove a dead fetus, and a medically necessary

 19 16    Sec. 14.  STATE BOARD OF REGENTS STUDY.  The state
 19 17 board of regents shall, in consultation with the Iowa
 19 18 association of independent colleges and universities
 19 19 and the Iowa coordinating council for post-high school
 19 20 education, complete a study of the number and type of
 19 21 undergraduate and graduate degree programs offered at
 19 22 the satellite locations of all institutions of higher
 19 23 learning under the control of the state board of
 19 24 regents and at the satellite locations of all
 19 25 accredited private postsecondary institutions.  The
 19 26 study shall include a listing of degree programs
 19 27 currently in operation and those the Iowa coordinating
 19 28 council has approved, but which have not yet begun
 19 29 operation.  By January 15, 2000, the state board of
 19 30 regents shall submit a report to the chairpersons and
 19 31 ranking members of the senate and house joint
 19 32 appropriations subcommittee on education, the
 19 33 legislative fiscal bureau, the secretary of the
 19 34 senate, and the chief clerk of the house of
 19 35 representatives, that contains the following
 19 36 information:
 19 37    1.  A listing of all satellite locations where
 19 38 degree programs are offered.
 19 39    2.  A listing of all degree programs offered,
 19 40 identified by satellite location and postsecondary
 19 41 institution.
 19 42    3.  The enrollment in each degree program by
 19 43 resident, nonresident, and the combined enrollment
 19 44 total.
 19 45    4.  The date each degree program was approved by
 19 46 the Iowa coordinating council for post-high school
 19 47 education.
 19 48    5.  The date each degree program actually began
 19 49 operation.
 19 50    For purposes of this section, "satellite" means a
 20  1 facility not attached to the campus of the main
 20  2 postsecondary institution.
 20  3    Sec. 15.  MEDICAL ASSISTANCE – SUPPLEMENTAL
 20  4 AMOUNTS.  For the fiscal year beginning July 1, 1999,
 20  5 and ending June 30, 2000, the department of human
 20  6 services shall continue the supplemental
 20  7 disproportionate share and a supplemental indirect
 20  8 medical education adjustment applicable to state-owned
 20  9 acute care hospitals with more than 500 beds and shall
 20 10 reimburse qualifying hospitals pursuant to that
 20 11 adjustment with a supplemental amount for services
 20 12 provided medical assistance recipients.  The
 20 13 adjustment shall generate supplemental payments
 20 14 intended to equal the state appropriation made to a
 20 15 qualifying hospital for treatment of indigent patients
 20 16 as provided in chapter 255.  To the extent of the
 20 17 supplemental payments, a qualifying hospital shall,
 20 18 after receipt of the funds, transfer to the department
 20 19 of human services an amount equal to the actual
 20 20 supplemental payments that were made in that month.
 20 21 The aggregate amounts for the fiscal year shall not
 20 22 exceed the state appropriation made to the qualifying
 20 23 hospital for treatment of indigent patients as
 20 24 provided in chapter 255.  The department of human
 20 25 services shall deposit the portion of these funds
 20 26 equal to the state share in the department's medical
 20 27 assistance account and the balance shall be credited
 20 28 to the general fund of the state.  To the extent that
 20 29 state funds appropriated to a qualifying hospital for
 20 30 the treatment of indigent patients as provided in
 20 31 chapter 255 have been transferred to the department of
 20 32 human services as a result of these supplemental
 20 33 payments made to the qualifying hospital, the
 20 34 department shall not, directly or indirectly, recoup
 20 35 the supplemental payments made to a qualifying
 20 36 hospital for any reason, unless an equivalent amount
 20 37 of the funds transferred to the department of human
 20 38 services by a qualifying hospital pursuant to this
 20 39 provision is transferred to the qualifying hospital by
 20 40 the department.
 20 41    If the state supplemental amount allotted to the
 20 42 state of Iowa for the federal fiscal year beginning
 20 43 October 1, 1999, and ending September 30, 2000,
 20 44 pursuant to section 1923(f)(3) of the federal Social
 20 45 Security Act, as amended, or pursuant to federal
 20 46 payments for indirect medical education is greater
 20 47 than the amount necessary to fund the federal share of
 20 48 the supplemental payments specified in the preceding
 20 49 paragraph, the department of human services shall
 20 50 increase the supplemental disproportionate share or
 21  1 supplemental indirect medical education adjustment by
 21  2 the lesser of the amount necessary to utilize fully
 21  3 the state supplemental amount or the amount of state
 21  4 funds appropriated to the state university of Iowa
 21  5 general education fund and allocated to the university
 21  6 for the college of medicine.  The state university of
 21  7 Iowa shall transfer from the allocation for the
 21  8 college of medicine to the department of human
 21  9 services, on a monthly basis, an amount equal to the
 21 10 additional supplemental payments made during the
 21 11 previous month pursuant to this paragraph.  A
 21 12 qualifying hospital receiving supplemental payments
 21 13 pursuant to this paragraph that are greater than the
 21 14 state appropriation made to the qualifying hospital
 21 15 for treatment of indigent patients as provided in
 21 16 chapter 255 shall be obligated as a condition of its
 21 17 participation in the medical assistance program to
 21 18 transfer to the state university of Iowa general
 21 19 education fund on a monthly basis an amount equal to
 21 20 the funds transferred by the state university of Iowa
 21 21 to the department of human services.  To the extent
 21 22 that state funds appropriated to the state university
 21 23 of Iowa and allocated to the college of medicine have
 21 24 been transferred to the department of human services
 21 25 as a result of these supplemental payments made to the
 21 26 qualifying hospital, the department shall not,
 21 27 directly or indirectly, recoup these supplemental
 21 28 payments made to a qualifying hospital for any reason,
 21 29 unless an equivalent amount of the funds transferred
 21 30 to the department of human services by the state
 21 31 university of Iowa pursuant to this paragraph is
 21 32 transferred to the qualifying hospital by the
 21 33 department.
 21 34    Continuation of the supplemental disproportionate
 21 35 share and supplemental indirect medical education
 21 36 adjustment shall preserve the funds available to the
 21 37 university hospital for medical and surgical treatment
 21 38 of indigent patients as provided in chapter 255 and to
 21 39 the state university of Iowa for educational purposes
 21 40 at the same level as provided by the state funds
 21 41 initially appropriated for that purpose.
 21 42    The department of human services shall, in any
 21 43 compilation of data or other report distributed to the
 21 44 public concerning payments to providers under the
 21 45 medical assistance program, set forth reimbursements
 21 46 to a qualifying hospital through the supplemental
 21 47 disproportionate share and supplemental indirect
 21 48 medical education adjustment as a separate item and
 21 49 shall not include such payments in the amounts
 21 50 otherwise reported as the reimbursement to a
 22  1 qualifying hospital for services to medical assistance
 22  2 recipients.
 22  3    For purposes of this section, "supplemental
 22  4 payment" means a supplemental payment amount paid for
 22  5 medical assistance to a hospital qualifying for that
 22  6 payment under this section.
 22  7    Sec. 16.  STATE UNIVERSITY OF IOWA – DEPARTMENT OF
 22  8 HUMAN SERVICES.  The department of human services
 22  9 shall transfer to the state university of Iowa for the
 22 10 purposes of the creative employment options program
 22 11 the same amount of moneys in the fiscal year beginning
 22 12 July 1, 1999, and ending June 30, 2000, as was
 22 13 transferred in the fiscal year beginning July 1, 1997,
 22 14 and ending June 30, 1998.
 22 15    Sec. 17.  For the fiscal year beginning July 1,
 22 16 1999, and ending June 30, 2000, the state board of
 22 17 regents may use notes, bonds, or other evidences of
 22 18 indebtedness issued under section 262.48 to finance
 22 19 projects that will result in energy cost savings in an
 22 20 amount that will cause the state board to recover the
 22 21 cost of the projects within an average of six years.
 22 22    Sec. 18.  Notwithstanding section 270.7, the
 22 23 department of revenue and finance shall pay the state
 22 24 school for the deaf and the Iowa braille and sight
 22 25 saving school the moneys collected from the counties
 22 26 during the fiscal year beginning July 1, 1999, for
 22 27 expenses relating to prescription drug costs for
 22 28 students attending the state school for the deaf and
 22 29 the Iowa braille and sight saving school.
 22 30    Sec. 19.  Section 256.22, subsection 2, Code 1999,
 22 31 is amended to read as follows:
 22 32    2.  Grant moneys shall be distributed to qualifying
 22 33 school districts by the department no later than
 22 34 October 15, 1998 1999.  Grant amounts shall be
 22 35 distributed as determined by the department.
 22 36    Sec. 20.  Section 256.44, Code 1999, as amended by
 22 37 1999 Iowa Acts, House File 766, if enacted, is amended
 22 38 by adding the following new subsection:
 22 39    NEW SUBSECTION.  7.  Notwithstanding section 8.33,
 22 40 funds appropriated for purposes of this section which
 22 41 remain unencumbered or unobligated at the close of the
 22 42 fiscal year for which the funds were appropriated
 22 43 shall not revert but shall be available for
 22 44 expenditure for the following fiscal year for purposes
 22 45 of this section.
 22 46    Sec. 21.  NEW SECTION.  256.67A  INSURANCE
 22 47 ELIGIBILITY.
 22 48    Personnel employed by a regional library shall be
 22 49 considered state employees for purposes of eligibility
 22 50 for receiving employee health and dental insurance as
 23  1 provided to state employees by the department of
 23  2 personnel.  If a regional library elects to
 23  3 participate in a state employee health and dental
 23  4 insurance program, the regional library shall continue
 23  5 to pay the costs of employee participation in a
 23  6 program from funds appropriated for purposes of the
 23  7 regional libraries by the general assembly.
 23  8    Sec. 22.  Section 261.2, Code 1999, is amended by
 23  9 adding the following new subsection:
 23 10    NEW SUBSECTION.  15.  Be prohibited from expending
 23 11 interest moneys earned on accounts of the commission
 23 12 located within the office of the treasurer of state
 23 13 unless the general assembly specifically appropriates
 23 14 the interest moneys for use by the commission.  If the
 23 15 general assembly appropriates interest moneys
 23 16 transferred from the Pub. L. No. 105-33 recall account
 23 17 within the office of the treasurer of state to the
 23 18 fund 61 default reduction account, the commission
 23 19 shall adopt rules for the expenditure of the interest
 23 20 moneys for purposes of issuing emergency loans to
 23 21 assist needy students in avoiding default on a
 23 22 guaranteed or parental loan made under this chapter.
 23 23    Sec. 23.  Section 261.12, subsection 1, paragraph
 23 24 b, Code 1999, is amended to read as follows:
 23 25    b.  For the fiscal year beginning July 1, 1998
 23 26 1999, and for each following fiscal year, three
 23 27 thousand six nine hundred fifty dollars.
 23 28    Sec. 24.  Section 261.17, subsection 3, unnumbered
 23 29 paragraph 1, Code 1999, is amended to read as follows:
 23 30    A qualified full-time student may receive
 23 31 vocational-technical tuition grants for not more than
 23 32 four semesters, eight quarters or the trimester or
 23 33 quarter equivalent of two full years of study.  The
 23 34 amount of a vocational-technical tuition grant to a A
 23 35 qualified part-time student enrolled in a course of
 23 36 study including at least three semester hours but
 23 37 fewer than twelve semester hours or the trimester or
 23 38 quarter equivalent shall be equal to the amount of a
 23 39 tuition grant that would be paid to a full-time
 23 40 student times a number which represents the number of
 23 41 hours in which the part-time student is actually
 23 42 enrolled divided by twelve semester hours, may receive
 23 43 vocational-technical tuition grants for not more than
 23 44 eight semesters or the trimester or quarter equivalent
 23 45 of two full years of full-time study.
 23 46    Sec. 25.  Section 261.17, subsection 4, Code 1999,
 23 47 is amended to read as follows:
 23 48    4.  a.  The amount of a vocational-technical
 23 49 tuition grant to a qualified full-time student shall
 23 50 not exceed the lesser of six hundred fifty dollars per
 24  1 year or the amount of the student's established
 24  2 financial need.
 24  3    b.  The amount of a vocational-technical tuition
 24  4 grant to a qualified part-time student enrolled in a
 24  5 course of study including at least three semester
 24  6 hours but fewer than twelve semester hours or the
 24  7 trimester or quarter equivalent shall be equal to the
 24  8 amount of a vocational-technical tuition grant that
 24  9 would be paid to a full-time student, except that the
 24 10 commission shall prorate the amount in a manner
 24 11 consistent with the federal Pell grant program
 24 12 proration.
 24 13    Sec. 26.  Section 261.25, subsections 1 through 3,
 24 14 Code 1999, are amended to read as follows:
 24 15    1.  There is appropriated from the general fund of
 24 16 the state to the commission for each fiscal year the
 24 17 sum of forty-four forty-seven million six hundred
 24 18 sixty-four thousand seven hundred fifty dollars for
 24 19 tuition grants.
 24 20    2.  There is appropriated from the general fund of
 24 21 the state to the commission for each fiscal year the
 24 22 sum of four hundred seventy-four ninety-eight thousand
 24 23 eight five hundred forty dollars for scholarships.
 24 24    3.  There is appropriated from the general fund of
 24 25 the state to the commission for each fiscal year the
 24 26 sum of two million two four hundred forty-four eighty-
 24 27 two thousand one four hundred ninety-seven dollars for
 24 28 vocational-technical tuition grants.
 24 29    Sec. 27.  Section 261.25, subsection 4, Code 1999,
 24 30 is amended by striking the subsection.
 24 31    Sec. 28.  Section 261.38, subsection 1, Code 1999,
 24 32 is amended to read as follows:
 24 33    1.  The commission shall establish a loan reserve
 24 34 account from which any default on a guaranteed student
 24 35 loan shall be paid and an agency operating account as
 24 36 authorized by the federal Higher Education Act of
 24 37 1965.  The commission shall credit to this account
 24 38 these accounts all moneys designated exclusively for
 24 39 the reserve fund provided for the state student loan
 24 40 program by the United States, the state of Iowa, or
 24 41 any of their agencies, departments or
 24 42 instrumentalities, as well as any funds accruing to
 24 43 the program which are not required for current
 24 44 administrative expenses.  The department of management
 24 45 shall determine the actuarially sound reserve
 24 46 requirement for the amount of guaranteed loans
 24 47 outstanding commission may expend moneys in the loan
 24 48 reserve and agency operating accounts as authorized by
 24 49 the federal Higher Education Act of 1965.
 24 50    Sec. 29.  Section 261.38, subsection 2, Code 1999,
 25  1 is amended by striking the subsection.
 25  2    Sec. 30.  Section 261.38, subsections 3, 4, and 5,
 25  3 Code 1999, are amended to read as follows:
 25  4    3.  The payment of any funds for the default on a
 25  5 guaranteed student loan shall be solely from the loan
 25  6 reserve account and agency operating accounts.  The
 25  7 general assembly shall not be obligated to appropriate
 25  8 any moneys to pay for any defaults or to appropriate
 25  9 any moneys to be credited to the loan reserve account.
 25 10 The commission shall not give or lend the credit of
 25 11 the state of Iowa.
 25 12    4.  Funds Notwithstanding section 8.33, funds on
 25 13 deposit in the loan reserve account or in the
 25 14 administrative account and operating accounts shall
 25 15 not revert to the state general fund at the close of
 25 16 any fiscal year.
 25 17    5.  The treasurer of state shall invest any funds,
 25 18 including those in the loan reserve account and
 25 19 operating accounts, and, notwithstanding section
 25 20 12C.7, the interest income earned shall be credited
 25 21 back to the loan reserve appropriate account.
 25 22    Sec. 31.  Section 261.38, subsection 6, Code 1999,
 25 23 is amended by striking the subsection.
 25 24    Sec. 32.  Section 261.38, subsection 7, unnumbered
 25 25 paragraph 1, Code 1999, is amended to read as follows:
 25 26    The commission may expend funds in the reserve
 25 27 account and enter into agreements with the Iowa
 25 28 student loan liquidity corporation in order to
 25 29 increase access for students to education loan
 25 30 programs that the commission determines meet the
 25 31 education needs of Iowa residents.  The agreements
 25 32 shall permit the establishment, funding, and operation
 25 33 of alternative education loan programs, as described
 25 34 in section 144(b)(1)(B) of the Internal Revenue Code
 25 35 of 1986 as amended, as defined in section 422.3, in
 25 36 addition to programs permitted under the federal
 25 37 Higher Education Act of 1965.  In accordance with
 25 38 those agreements, the Iowa student loan liquidity
 25 39 corporation may issue bonds, notes, or other
 25 40 obligations to the public and others for the purpose
 25 41 of funding the alternative education loan programs.
 25 42 This authority to issue such bonds, notes, or other
 25 43 obligations shall be in addition to the authority
 25 44 established in the articles of incorporation and
 25 45 bylaws of the Iowa student loan liquidity corporation.
 25 46    Sec. 33.  Section 261.71, subsection 1, paragraph
 25 47 c, Code 1999, is amended to read as follows:
 25 48    c.  The student practices agrees to practice in an
 25 49 underserved area in the state of Iowa for a period of
 25 50 time to be determined by the commission at the time
 26  1 the loan is awarded.
 26  2    Sec. 34.  Section 261.71, subsections 2 and 3, Code
 26  3 1999, are amended to read as follows:
 26  4    2.  Of the moneys loaned to an eligible student,
 26  5 for each year of up to and including four years of
 26  6 practice in Iowa, an amount equal to twenty-five
 26  7 percent of the original principal and the
 26  8 proportionate share of accrued interest, or one
 26  9 thousand one hundred dollars, whichever is greater,
 26 10 shall be forgiven.  If a student fails to complete a
 26 11 year of practice in the state, as practice is defined
 26 12 by the college student aid commission, the loan amount
 26 13 for that year shall not be forgiven.  The contract for
 26 14 the loan repayment shall stipulate the time period the
 26 15 chiropractor shall practice in an underserved area in
 26 16 this state.  In addition, the contract shall stipulate
 26 17 that the chiropractor repay any funds paid on the
 26 18 chiropractor's loan by the commission if the
 26 19 chiropractor fails to practice in an underserved area
 26 20 in this state for the required period of time.
 26 21 Forgivable loans made to eligible students shall not
 26 22 become due, for repayment purposes, until one year
 26 23 after the student has graduated.  A loan that has not
 26 24 been forgiven may be sold to a bank, savings and loan
 26 25 association, credit union, or nonprofit agency
 26 26 eligible to participate in the guaranteed student loan
 26 27 program under the federal Higher Education Act of
 26 28 1965, 20 U.S.C. } 1071 et seq., by the commission when
 26 29 the loan becomes due for repayment.
 26 30    3.  For purposes of this section "graduate student"
 26 31 means a student who has completed at least ninety
 26 32 semester hours, or the trimester or quarter
 26 33 equivalent, of postsecondary course work at a public
 26 34 higher education institution or at an accredited
 26 35 private institution, as defined under section 261.9.
 26 36 "Underserved area" means a geographical area included
 26 37 on the Iowa governor's health practitioner shortage
 26 38 area list, which is compiled by the center for rural
 26 39 health and primary care of the Iowa department of
 26 40 public health.  The college student aid commission
 26 41 shall adopt rules, consistent with rules used for
 26 42 students enrolled in higher education institutions
 26 43 under the control of the state board of regents, for
 26 44 purposes of determining Iowa residency status of
 26 45 graduate students under this section.  The commission
 26 46 shall also adopt rules which provide standards,
 26 47 guidelines, and procedures for the receipt,
 26 48 processing, and administration of student applications
 26 49 and loans under this section.
 26 50    Sec. 35.  NEW SECTION.  261.86  NATIONAL GUARD
 27  1 EDUCATIONAL ASSISTANCE PROGRAM.
 27  2    1.  A national guard educational assistance program
 27  3 is established to be administered by the college
 27  4 student aid commission for members of the Iowa
 27  5 national guard who are enrolled as undergraduate
 27  6 students in a community college, an institution of
 27  7 higher learning under the state board of regents, or
 27  8 an accredited private institution.  The college
 27  9 student aid commission shall adopt rules pursuant to
 27 10 chapter 17A to administer this section.  An individual
 27 11 is eligible for the national guard educational
 27 12 assistance program if the individual meets all of the
 27 13 following conditions:
 27 14    a.  Is a resident of the state and a member of an
 27 15 Iowa army or air national guard unit while receiving
 27 16 educational assistance pursuant to this section.
 27 17    b.  Satisfactorily completed required initial
 27 18 active duty training.
 27 19    c.  Maintains satisfactory performance of duty upon
 27 20 return from initial active duty training, including
 27 21 attending a minimum ninety percent of scheduled drill
 27 22 dates and attending annual training.
 27 23    d.  Is enrolled as an undergraduate student in a
 27 24 community college as defined in section 260C.2, an
 27 25 institution of higher learning under the control of
 27 26 the board of regents, or an accredited private
 27 27 institution as defined in section 261.9, and is
 27 28 maintaining satisfactory academic progress.
 27 29    e.  Provides proper notice of national guard status
 27 30 to the community college or institution at the time of
 27 31 registration for the term in which tuition benefits
 27 32 are sought.
 27 33    f.  Submits an application to the adjutant general
 27 34 of Iowa, on forms prescribed by the adjutant general,
 27 35 who shall determine eligibility and whose decision is
 27 36 final.
 27 37    2.  The amount of educational assistance received
 27 38 by a national guard member pursuant to this section
 27 39 shall be determined by the adjutant general and shall
 27 40 not exceed the resident tuition rate established for
 27 41 institutions of higher learning under the control of
 27 42 the state board of regents.  If the amount
 27 43 appropriated in a fiscal year for purposes of this
 27 44 section is insufficient to provide educational
 27 45 assistance to all national guard members who apply for
 27 46 the program and who are determined by the adjutant
 27 47 general to be eligible for the program, the adjutant
 27 48 general shall determine the amount of educational
 27 49 assistance each eligible guard member shall receive.
 27 50 However, educational assistance paid to an eligible
 28  1 national guard member shall not be less than an amount
 28  2 equal to fifty percent of the resident tuition rate
 28  3 established for institutions of higher learning under
 28  4 the control of the state board of regents.  The
 28  5 adjutant general shall not determine educational
 28  6 assistance amounts based upon a national guard
 28  7 member's unit, the location at which drills are
 28  8 attended, or whether the eligible individual is a
 28  9 member of the Iowa army or air national guard.
 28 10    3.  An eligible member of the national guard,
 28 11 attending an institution as provided in subsection 1,
 28 12 paragraph "d", as a full-time student, shall not
 28 13 receive educational assistance under this section for
 28 14 more than eight semesters, or if attending as a part-
 28 15 time student for not more than sixteen semesters, of
 28 16 undergraduate study, or the trimester or quarter
 28 17 equivalent.  A national guard member who has met the
 28 18 educational requirements for a baccalaureate degree is
 28 19 ineligible for educational assistance under this
 28 20 section.
 28 21    4.  The eligibility of applicants and amounts of
 28 22 educational assistance to be paid shall be certified
 28 23 by the adjutant general of Iowa to the college student
 28 24 aid commission, and all amounts that are or become due
 28 25 to a community college, accredited private
 28 26 institution, or institution of higher learning under
 28 27 the control of the state board of regents under this
 28 28 section shall be paid to the college or institution by
 28 29 the college student aid commission upon receipt of
 28 30 certification by the president or governing board of
 28 31 the educational institution as to accuracy of charges
 28 32 made, and as to the attendance and academic progress
 28 33 of the individual at the educational institution.  The
 28 34 college student aid commission shall maintain an
 28 35 annual record of the number of participants and the
 28 36 dollar value of the educational assistance provided.
 28 37    5.  For purposes of this section, unless otherwise
 28 38 required, "educational assistance" means the same as
 28 39 "cost of attendance" as defined in Title IV, part B,
 28 40 of the federal Higher Education Act of 1965 as
 28 41 amended.
 28 42    Sec. 36.  Section 261.111, Code 1999, is amended by
 28 43 striking the section and inserting in lieu thereof the
 28 44 following:
 28 45    261.111  TEACHER SHORTAGE FORGIVABLE LOAN PROGRAM.
 28 46    1.  A teacher shortage forgivable loan program is
 28 47 established to be administered by the college student
 28 48 aid commission.  An individual is eligible for the
 28 49 forgivable loan program if the individual is a
 28 50 resident of this state who is enrolled as a sophomore,
 29  1 junior, senior, or graduate student in an approved
 29  2 practitioner preparation program in a designated area
 29  3 in which teacher shortages are anticipated, at an
 29  4 institution of higher learning under the control of
 29  5 the state board of regents or an accredited private
 29  6 institution as defined in section 261.9.
 29  7    2.  The director of the department of education
 29  8 shall annually designate the areas in which teacher
 29  9 shortages are anticipated.  The director shall
 29 10 periodically conduct a survey of school districts,
 29 11 accredited nonpublic schools, and approved
 29 12 practitioner preparation programs to determine current
 29 13 shortage areas and predict future shortage areas.
 29 14    3.  Each applicant shall, in accordance with the
 29 15 rules of the commission, do the following:
 29 16    a.  Complete and file an application for a teacher
 29 17 shortage forgivable loan.  The individual shall be
 29 18 responsible for the prompt submission of any
 29 19 information required by the commission.
 29 20    b.  File a new application and submit information
 29 21 as required by the commission annually on the basis of
 29 22 which the applicant's eligibility for the renewed
 29 23 forgivable loan will be evaluated and determined.
 29 24    4.  Forgivable loans to eligible students shall not
 29 25 become due until after the student graduates or leaves
 29 26 school.  The individual's total loan amount, including
 29 27 principal and interest, shall be reduced by twenty
 29 28 percent for each year in which the individual remains
 29 29 an Iowa resident and is employed in Iowa by a school
 29 30 district or an accredited nonpublic school as a
 29 31 practitioner in the teacher shortage area for which
 29 32 the loan was approved.  If the commission determines
 29 33 that the person does not meet the criteria for
 29 34 forgiveness of the principal and interest payments,
 29 35 the commission shall establish a plan for repayment of
 29 36 the principal and interest over a ten-year period.  If
 29 37 a person required to make the repayment does not make
 29 38 the required payments, the commission shall provide
 29 39 for payment collection.
 29 40    5.  The amount of a teacher shortage forgivable
 29 41 loan shall not exceed three thousand dollars annually,
 29 42 or the amount of the student's established financial
 29 43 need, whichever is less.
 29 44    6.  The commission shall prescribe by rule the
 29 45 interest rate for the forgivable loan.
 29 46    7.  A teacher shortage forgivable loan repayment
 29 47 fund is created for deposit of payments made by
 29 48 forgivable loan recipients who do not fulfill the
 29 49 conditions of the forgivable loan program and any
 29 50 other moneys appropriated to or received by the
 30  1 commission for deposit in the fund.  Notwithstanding
 30  2 section 8.33, moneys deposited in the fund shall not
 30  3 revert to the general fund of the state at the end of
 30  4 any fiscal year but shall remain in the forgivable
 30  5 loan repayment fund and be continuously available to
 30  6 make additional loans under the program.
 30  7 Notwithstanding section 12C.7, subsection 2, interest
 30  8 or earnings on moneys deposited in the fund shall be
 30  9 credited to the fund.
 30 10    8.  For purposes of this section, unless the
 30 11 context otherwise requires, "teacher" means the same
 30 12 as defined in section 272.1.
 30 13    Sec. 37.  Section 294A.25, subsections 6, 11, and
 30 14 12, Code 1999, are amended to read as follows:
 30 15    6.  For the fiscal year beginning July 1, 1997
 30 16 1999, and ending June 30, 1998 2000, from phase III
 30 17 moneys the amount of fifty thousand dollars to the
 30 18 department of education for the geography alliance.
 30 19    11.  For the fiscal year beginning July 1, 1998
 30 20 1999, and ending June 30, 1999 2000, to the department
 30 21 of education from phase III moneys the amount of one
 30 22 million two hundred fifty thousand dollars for support
 30 23 for the operations of the new Iowa schools development
 30 24 corporation and for school transformation design and
 30 25 implementation projects administered by the
 30 26 corporation.  Of the amount provided in this
 30 27 subsection, one hundred fifty thousand dollars shall
 30 28 be used for the school and community planning
 30 29 initiative.
 30 30    12.  For the fiscal year beginning July 1, 1998
 30 31 1999, and ending June 30, 2000, to the department of
 30 32 education from phase III moneys the amount of one
 30 33 hundred fifty thousand dollars to the Iowa public
 30 34 broadcasting division for overnight transmitter feeds.
 30 35    Sec. 38.  Section 294A.25, Code 1999, is amended by
 30 36 adding the following new subsections:
 30 37    NEW SUBSECTION.  13.  For the fiscal year beginning
 30 38 July 1, 1999, and ending June 30, 2000, to the
 30 39 department of education from phase III moneys the
 30 40 amount of fifty thousand dollars for participation in
 30 41 the national assessment of education progress.
 30 42    NEW SUBSECTION.  14.  For the fiscal year beginning
 30 43 July 1, 1999, and ending June 30, 2000, to the
 30 44 department of education from phase III moneys the
 30 45 amount of fifty thousand dollars for the Iowa
 30 46 mathematics and science coalition.
 30 47    Sec. 39.  Section 303.16, Code 1999, is amended by
 30 48 adding the following new subsection:
 30 49    NEW SUBSECTION.  10.  a.  The general assembly
 30 50 finds that the country school that served Iowa's
 31  1 educational needs for much of its history offered a
 31  2 unique opportunity to students and communities,
 31  3 providing for multigenerational attendance, high
 31  4 educational performance, a safe environment, a focus
 31  5 for community support, and a caring, attentive
 31  6 environment.
 31  7    b.  A country schools historical resource
 31  8 preservation grant program is therefore established to
 31  9 be administered by the historical division for the
 31 10 preservation of one-room and two-room buildings once
 31 11 used as country schools.  In developing grant approval
 31 12 criteria, the division shall place a priority on the
 31 13 educational uses planned for the country school
 31 14 building, which may include, but are not limited to,
 31 15 historical interpretation and use as a teaching museum
 31 16 or as an operational classroom accessible to a school
 31 17 district or accredited nonpublic school for
 31 18 provisional instructional purposes.
 31 19    c.  Notwithstanding any other provision of this
 31 20 section, the amount of a grant shall not exceed
 31 21 twenty-five thousand dollars and applicants shall
 31 22 match grant funding on a dollar-for-dollar basis, of
 31 23 which at least one-half of the local match must be in
 31 24 cash.
 31 25    Sec. 40.  EMERGENCY RULES.  The commission of
 31 26 libraries shall adopt emergency rules under section
 31 27 17A.4, subsection 2, and section 17A.5, subsection 2,
 31 28 paragraph "b", adopting the performance measures
 31 29 referred to in 286 IAC 3.6 and implement the
 31 30 provisions of section 7, subsection 5, paragraph "b",
 31 31 of this Act, and the rules shall be effective
 31 32 immediately upon filing unless a later date is
 31 33 specified in the rules.  Any rules adopted in
 31 34 accordance with this section shall also be published
 31 35 as a notice of intended action as provided in section
 31 36 17A.4.
 31 37    Sec. 41.  Sections 261.21 and 261.112, Code 1999,
 31 38 are repealed.
 31 39    Sec. 42.  EFFECTIVE DATES.
 31 40    1.  Section 4 of this Act, relating to the
 31 41 remaining national guard tuition aid balance, being
 31 42 deemed of immediate importance, takes effect upon
 31 43 enactment.
 31 44    2.  Section 5 of this Act, relating to the
 31 45 remaining industrial technology forgivable loan
 31 46 program balance, being deemed of immediate importance,
 31 47 takes effect upon enactment.
 31 48    3.  Section 9 of this Act, relating to board of
 31 49 educational examiners licensing fees, being deemed of
 31 50 immediate importance, takes effect upon enactment.
 32  1    4.  Section 10 of this Act, relating to the
 32  2 distribution of FY 1999-2000 extended school year
 32  3 grant moneys, being deemed of immediate importance,
 32  4 takes effect upon enactment.
 32  5    5.  Section 40 of this Act, relating to emergency
 32  6 rules, being deemed of immediate importance, takes
 32  7 effect upon enactment."
