  1  1    Section 1.  DEPARTMENT OF EDUCATION.  There is appropriated
  1  2 from the general fund of the state to the department of
  1  3 education for the fiscal year beginning July 1, 1999, and
  1  4 ending June 30, 2000, the following amount, or so much thereof
  1  5 as is necessary, to be used for the purpose designated:
  1  6    For purposes of the beginning teacher induction program as
  1  7 provided in section 256E.2:  
  1  8 .................................................. $    300,000
  1  9    Notwithstanding section 8.33, moneys appropriated in this
  1 10 section that remain unencumbered or unobligated at the close
  1 11 of the fiscal year shall not revert but shall remain available
  1 12 for expenditure for the purposes designated until the close of
  1 13 the succeeding fiscal year.
  1 14    Sec. 2.  NEW SECTION.  256E.1  DEFINITIONS.
  1 15    As used in this chapter, unless the context otherwise
  1 16 requires:
  1 17    1.  "Beginning teacher" means an individual serving under
  1 18 an initial provisional or conditional license, issued by the
  1 19 board of educational examiners under chapter 272, who is
  1 20 assuming a position as a classroom teacher.
  1 21    2.  "Board" means the board of directors of a school
  1 22 district or a collaboration of boards of directors of school
  1 23 districts.
  1 24    3.  "Classroom teacher" means an individual who holds a
  1 25 valid practitioner's license and who is employed by a school
  1 26 district under sections 279.13 through 279.19 in a school
  1 27 district or area education agency in this state to provide
  1 28 instruction to students.
  1 29    4.  "Department" means the department of education.
  1 30    5.  "Director" means the director of the department of
  1 31 education.
  1 32    6.  "District facilitator" means a licensed professional
  1 33 pursuant to chapter 272 who is appointed by a board to serve
  1 34 as the liaison between the board and the department for the
  1 35 beginning teacher induction program.
  2  1    7.  "Mentor" means an individual employed by a school
  2  2 district or area education agency as a classroom teacher who
  2  3 holds a valid license to teach issued under chapter 272.  The
  2  4 individual must have a record of four years of successful
  2  5 teaching practice, must be employed as a classroom teacher on
  2  6 a nonprobationary basis, and must demonstrate professional
  2  7 commitment to the improvement of teaching and learning, and
  2  8 the development of beginning teachers.
  2  9    Sec. 3.  NEW SECTION.  256E.2  BEGINNING TEACHER INDUCTION
  2 10 PROGRAM ESTABLISHED – GRANTS.
  2 11    1.  If the general assembly appropriates moneys for
  2 12 purposes of teacher induction, the department of education
  2 13 shall coordinate a beginning teacher induction program to
  2 14 promote excellence in teaching, build a supportive environment
  2 15 within school districts, increase the retention of promising
  2 16 beginning teachers, and promote the personal and professional
  2 17 well-being of teachers.
  2 18    2.  The department shall adopt rules concerning the grant
  2 19 application and award process, including reasonable cost
  2 20 estimates for beginning teacher induction programs.  The
  2 21 department may disapprove a plan submitted by a board if the
  2 22 plan does not meet the minimum criteria set forth in section
  2 23 256E.3, subsection 2, or the plan exceeds the reasonable costs
  2 24 as determined by the department.  If the cost estimates
  2 25 submitted by a board exceed reasonable cost estimates as
  2 26 determined by the department, the department shall work with
  2 27 the board to identify measures for reducing plan costs.  If
  2 28 the department determines that moneys appropriated by the
  2 29 general assembly are insufficient to meet the grant requests
  2 30 for all approved beginning teacher induction program plans,
  2 31 the department shall award grants based on the geographic
  2 32 location and district population of the school districts with
  2 33 approved plans.  Grants may be awarded in subsequent years
  2 34 based upon the most recent plan on file with the department.
  2 35 It is the intent of the general assembly that the department
  3  1 approve plans that incorporate local innovation and take into
  3  2 consideration local needs.
  3  3    Sec. 4.  NEW SECTION.  256E.3  DISTRICT FACILITATOR AND
  3  4 PLAN.
  3  5    1.  An area education agency shall prepare a model
  3  6 beginning teacher induction program plan and shall provide the
  3  7 model plan to each school district within its area.  The plan
  3  8 shall include a model evaluation component by which a school
  3  9 district may measure the effectiveness of its program.  Any
  3 10 modifications to the model plan shall be submitted to school
  3 11 districts as soon as practical.  A board that wishes to
  3 12 participate in the program shall adopt a beginning teacher
  3 13 induction program plan and written procedures for the program,
  3 14 and may use, alter, or revise the model plan provided by the
  3 15 area education agency at the board's discretion.
  3 16    2.  A board that wishes to participate in the beginning
  3 17 teacher induction program shall appoint a district
  3 18 facilitator, whose duties shall include, but are not limited
  3 19 to, overseeing the implementation of a plan for meeting the
  3 20 goals of the program as set forth in section 256E.2.  The plan
  3 21 shall, at a minimum, provide the process for the selection of
  3 22 and the number of mentors; the mentor training process; the
  3 23 timetable by which the plan shall be implemented; placement of
  3 24 mentors and beginning teachers; the minimum amount of contact
  3 25 time between mentors and beginning teachers; the minimum
  3 26 amount of release time for mentors and beginning teachers for
  3 27 meetings for planning, demonstration, observation, feedback,
  3 28 and workshops; the process for dissolving mentor and beginning
  3 29 teacher partnerships; and the process for measuring the
  3 30 results of the program.
  3 31    3.  The district facilitator shall submit the plan, and the
  3 32 proposed costs of implementing the plan, to the board, which
  3 33 shall consider the plan and, once approved, submit the plan
  3 34 and a reasonable cost proposal to the department of education.
  3 35    4.  The district facilitator is encouraged to work with
  4  1 area education agencies and postsecondary institutions in the
  4  2 preparation and implementation of a plan.
  4  3    5.  The district facilitator shall place beginning teachers
  4  4 participating in the program in a manner that provides the
  4  5 greatest opportunity to work with the largest number of
  4  6 mentors.
  4  7    Sec. 5.  NEW SECTION.  256E.4  BEGINNING TEACHER INDUCTION
  4  8 STATE SUBSIDY – FUND.
  4  9    1.  A mentor in a beginning teacher induction program
  4 10 approved under this chapter shall be eligible for an award of
  4 11 five hundred dollars per semester, at a minimum, for
  4 12 participation in the program, which shall be paid from moneys
  4 13 received pursuant to this chapter by the school district
  4 14 employing the mentor.
  4 15    2.  Moneys received by a school district pursuant to this
  4 16 chapter shall be expended to provide mentors with awards in
  4 17 accordance with subsection 1, to implement the plan, to
  4 18 provide for a stipend for the district facilitator, and to pay
  4 19 any applicable costs of the employer's share of contributions
  4 20 to federal social security and the Iowa public employees'
  4 21 retirement system or a pension and annuity retirement system
  4 22 established under chapter 294, for such amounts paid by the
  4 23 district.
  4 24    3.  Moneys received by a school district under this chapter
  4 25 are miscellaneous income for purposes of chapter 257 or are
  4 26 considered encumbered.  A school district shall maintain a
  4 27 separate listing within its budget for payments received and
  4 28 expenditures made pursuant to this section.
  4 29    4.  A beginning teacher induction fund is established in
  4 30 the office of the treasurer of state to be administered by the
  4 31 department.  Moneys appropriated by the general assembly for
  4 32 deposit in the fund shall be used to provide funding to school
  4 33 districts pursuant to this section.
  4 34    Sec. 6.  NEW SECTION.  256E.5  REPORTS.
  4 35    The board implementing an approved beginning teacher
  5  1 induction program as provided in this chapter shall submit an
  5  2 assessment of the program's results by July 1 of the fiscal
  5  3 year succeeding the year in which the school district received
  5  4 moneys under this chapter.  The department shall annually
  5  5 report the statewide results of the program to the
  5  6 chairpersons and the ranking members of the senate and house
  5  7 education committees by January 1.
  5  8    Sec. 7.  EMERGENCY RULES.  The department of education may
  5  9 adopt emergency rules under section 17A.4, subsection 2, and
  5 10 section 17A.5, subsection 2, paragraph "b", to implement the
  5 11 provisions of this Act and the rules shall be effective
  5 12 immediately upon filing unless a later date is specified in
  5 13 the rules.  Any rules adopted in accordance with this section
  5 14 shall also be published as a notice of intended action as
  5 15 provided in section 17A.4.
