No. 105-33 recall 2 26 account within the office of the treasurer of state during the 2 27 fiscal year ending June 30, 1999, in the fund 61 default 2 28 reduction account. Moneys in the fund 61 default reduction 2 29 account are appropriated to the college student aid commission 2 30 for the fiscal year beginning July 1, 1999, and ending June 2 31 30, 2000, for purposes of issuing emergency loans to assist 2 32 needy students in avoiding default on a guaranteed or parental 2 33 loan made under chapter 261. 2 34 Sec. 4. REMAINING NATIONAL GUARD TUITION AID PROGRAM 2 35 BALANCE. Notwithstanding section 8.33, the unencumbered or 3 1 unobligated moneys remaining at the end of the fiscal year 3 2 ending June 30, 1999, from the appropriations made in 1998 3 3 Iowa Acts, chapter 1215, section 1, subsection 4, shall not 3 4 revert but shall be available for expenditure during the 3 5 subsequent fiscal year for the purposes of the national guard 3 6 tuition aid program. 3 7 Sec. 5. REMAINING INDUSTRIAL TECHNOLOGY FORGIVABLE LOAN 3 8 PROGRAM BALANCE. Notwithstanding section 8.33 or section 3 9 261.25, subsection 4, Code 1999, or any other provision to the 3 10 contrary, unencumbered or unobligated funds remaining on June 3 11 30, 1999, for purposes of the industrial technology forgivable 3 12 loan program established in section 261.111, shall be 3 13 available to the college student aid commission for 3 14 expenditure for the fiscal year beginning July 1, 1999, and 3 15 for succeeding fiscal years for the purposes of the teacher 3 16 shortage forgivable loan program established in section 3 17 261.111 if enacted by an Act of the 1999 Session. 3 18 DEPARTMENT OF CULTURAL AFFAIRS 3 19 Sec. 6. There is appropriated from the general fund of the 3 20 state to the department of cultural affairs for the fiscal 3 21 year beginning July 1, 1999, and ending June 30, 2000, the 3 22 following amounts, or so much thereof as is necessary, to be 3 23 used for the purposes designated: 3 24 1. FTEs 302.25 5 28 From the funds appropriated in this lettered paragraph, up 5 29 to $2,000,000 shall be used to provide services to persons 5 30 without regard to an order of selection. The division shall 5 31 seek additional local matching funds in an amount sufficient 5 32 to avoid any loss of federal funds. 5 33 The division of vocational rehabilitation services shall 5 34 seek a waiver from the federal government to accept 5 35 assessments of clients performed by area education agencies or 6 1 any other governmental subdivision. The division shall also 6 2 seek additional federal waivers to improve and increase the 6 3 availability of supported employment services to Iowans. 6 4 The division of vocational rehabilitation services shall 6 5 seek funds other than federal funds, which may include but are 6 6 not limited to local funds from local provider entities, 6 7 community colleges, area education agencies, and local 6 8 education agencies, for purposes of matching federal 6 9 vocational rehabilitation funds. The funds collected by the 6 10 division may exceed the amount needed to match available 6 11 federal vocational rehabilitation funds in an effort to 6 12 qualify for additional federal funds when such funds become 6 13 available. 6 14 Except where prohibited under federal law, the division of 6 15 vocational rehabilitation services of the department of 6 16 education shall accept client assessments, or assessments of 6 17 potential clients, performed by other agencies in order to 6 18 reduce duplication of effort. 6 19 Notwithstanding the full-time equivalent position limit 6 20 established in this lettered paragraph, for the fiscal year 6 21 ending June 30, 2000, if federal funding is received to pay 6 22 the costs of additional employees for the vocational 6 23 rehabilitation services division who would have duties 6 24 relating to vocational rehabilitation services paid for 6 25 through federal funding, authorization to hire not more than 6 26 4.00 additional full-time equivalent employees shall be 6 27 provided, the full-time equivalent position limit shall be 6 28 exceeded, and the additional employees shall be hired by the 6 29 division. 6 30 The division of vocational rehabilitation services shall 6 31 enter into a chapter 28E agreement with the creative 6 32 employment options program at the state university of Iowa, or 6 33 take whatever other action is necessary, to enable the 6 34 division to count as a local match the state funds 6 35 appropriated to the university for purposes of the creative 7 1 employment options program. 7 2 b. For matching funds for programs to enable persons with 7 3 severe physical or mental disabilities to function more 7 4 independently, including salaries and support, and for not 7 5 more than the following full-time equivalent positions: 7 6 .................................................. $ 76,067 7 7 ............................................... FTEs 1.50 7 8 The highest priority use for the moneys appropriated under 7 9 this lettered paragraph shall be for programs that emphasize 7 10 employment and assist persons with severe physical or mental 7 11 disabilities to find and maintain employment to enable them to 7 12 function more independently. 7 13 5. STATE LIBRARY 7 14 a. For salaries, support, maintenance, miscellaneous 7 15 purposes, and for not more than the following full-time 7 16 equivalent positions: 7 17 .................................................. $ 3,153,168 7 18 ............................................... FTEs 21.00 7 19 Reimbursement of the institutions of higher learning under 7 20 the state board of regents for participation in the access 7 21 plus program during the fiscal year beginning July 1, 1999, 7 22 and ending June 30, 2000, shall not exceed the total amount of 7 23 reimbursement paid to the regents institutions of higher 7 24 learning for participation in the access plus program during 7 25 the fiscal year beginning July 1, 1998, and ending June 30, 7 26 1999. 7 27 b. For a one-year enrich Iowa pilot program: 7 28 .................................................. $ 700,000 7 29 (1) Funds allocated for purposes of the enrich Iowa pilot 7 30 program as provided in this lettered paragraph shall be 7 31 distributed by the division of libraries and information 7 32 services to eligible public libraries that are in compliance 7 33 with performance measures adopted by rule by the commission. 7 34 The funds allocated as provided in this lettered paragraph 7 35 shall not be used for the costs of administration by the 8 1 division. The amount distributed to each eligible public 8 2 library shall be based upon the following: 8 3 (a) The level of compliance by the eligible public library 8 4 with the performance measures adopted by the commission as 8 5 provided in this subsection. 8 6 (b) The number of people residing within an eligible 8 7 library's geographic service area for whom the library 8 8 provides services. 8 9 (c) The amount of other funding the eligible public 8 10 library received in the previous fiscal year for providing 8 11 services to rural residents and to contracting communities. 8 12 (2) Moneys received by a public library under this 8 13 lettered paragraph shall supplement, not supplant, any other 8 14 funding received by the library. 8 15 (3) For purposes of this section, "eligible public 8 16 library" means a public library that meets at least all of the 8 17 following requirements: 8 18 (a) Submits to the division all of the following: 8 19 (i) The report provided for under section 256.51, 8 20 subsection 1, paragraph "h". 8 21 (ii) An application and accreditation report, in a format 8 22 approved by the commission, that provides evidence of the 8 23 library's compliance with at least one level of the standards 8 24 established in accordance with section 256.51, subsection 1, 8 25 paragraph "k". 8 26 (iii) Any other application or report the division deems 8 27 necessary for the implementation of the enrich Iowa program. 8 28 (b) Participates in the library resource and information 8 29 sharing programs established by the state library. 8 30 (c) Is a public library established by city ordinance or a 8 31 county library as provided in chapter 336. 8 32 (4) Each eligible public library shall maintain a separate 8 33 listing within its budget for payments received and 8 34 expenditures made pursuant to this section, and shall annually 8 35 submit this listing to the division. 9 1 (5) By January 15, 2000, the division shall submit a 9 2 program evaluation report to the general assembly and the 9 3 governor detailing the uses and the impacts of funds allocated 9 4 under this lettered paragraph. It is the intent of the 9 5 general assembly to address the continuation of the enrich 9 6 Iowa pilot program during the 2000 legislative session. 9 7 6. REGIONAL LIBRARY 9 8 For state aid: 9 9 .................................................. $ 1,687,000 9 10 The division of libraries and information services shall 9 11 submit a list of current regional library employees and their 9 12 salaries to the department of management by August 1, 1999. 9 13 The list shall be used by the department for purposes of 9 14 calculating the annual salary increase need, based on the 9 15 salary increases negotiated by the American federation of 9 16 state, county, and municipal employees. The amount calculated 9 17 by the department for salary need shall be included in the 9 18 regional library budget request submitted to the governor for 9 19 the fiscal year beginning July 1, 2000, and ending June 30, 9 20 2001. 9 21 7. PUBLIC BROADCASTING DIVISION 9 22 For salaries, support, maintenance, capital expenditures, 9 23 miscellaneous purposes, and for not more than the following 9 24 full-time equivalent positions: 9 25 .................................................. $ 7,661,324 9 26 ............................................... VOCATIONAL EDUCATION TO SECONDARY SCHOOLS 9 28 For reimbursement for vocational education expenditures 9 29 made by secondary schools: 9 30 .................................................. $ 3,308,850 9 31 Funds appropriated in this subsection shall be used for 9 32 expenditures made by school districts to meet the standards 9 33 set in sections 256.11, 258.4, and 260C.14 as a result of the 9 34 enactment of 1989 Iowa Acts, chapter 278. Funds shall be used 9 35 as reimbursement for vocational education expenditures made by 10 1 secondary schools in the manner provided by the department of 10 2 education for implementation of the standards set in 1989 Iowa 10 3 Acts, chapter 278. 10 4 9. SCHOOL FOOD SERVICE 10 5 For use as state matching funds for federal programs that 10 6 shall be disbursed according to federal regulations, including 10 7 salaries, support, maintenance, miscellaneous purposes, and 10 8 for not more than the following full-time equivalent 10 9 positions: 10 10 .................................................. $ 2,716,859 10 11 ............................................... EMPLOYABILITY SKILLS ASSESSMENTS REIMBURSEMENTS 11 6 For reimbursement of school district claims for the costs 11 7 of acquiring and using employability skills assessment tools 11 8 as provided in this subsection: 11 9 .................................................. $ 185,000 11 10 a. The department of education shall reimburse school 11 11 district claims for the costs of acquiring, administering, and 11 12 scoring assessment tools to assess the employability skills of 11 13 students. The director of education shall identify available 11 14 employability skills assessment tools that school districts 11 15 may use to meet the claim reimbursement requirements of this 11 16 subsection. 11 17 b. In order to be eligible for reimbursement under this 11 18 subsection, a school district shall submit a claim on forms 11 19 provided by the department by July 15, 2000, and the claim 11 20 shall state the actual costs incurred and shall be accompanied 11 21 by an affidavit of an officer of the school district affirming 11 22 the accuracy of the claim. 11 23 c. A school district that submits to the department a 11 24 claim for reimbursement in accordance with this subsection 11 25 shall develop and integrate specific employability skills 11 26 goals and activities into the comprehensive school improvement 11 27 plan required under section 256.7, subsection 21, paragraph 11 28 "a". 11 29 d. The department of education shall certify to the 11 30 department of revenue and finance the amounts of approved 11 31 claims to be paid, and the department of revenue and finance 11 32 shall draw warrants payable to school districts with approved 11 33 claims, taking into consideration the relative budget and cash 11 34 position of the state resources. 11 35 e. Moneys received under this subsection shall not be 12 1 commingled with state aid payments made under section 257.16 12 2 to a school district and shall be accounted for by the school 12 3 district separately from state aid payments. Payments made to 12 4 a school district under this subsection are miscellaneous 12 5 income for purposes of chapter 257. 12 6 f. If the funds appropriated in this subsection are 12 7 insufficient to pay in full the claims submitted by school 12 8 districts and approved by the department, the amounts of 12 9 approved claims shall be prorated among all school districts 12 10 with approved claims. 12 11 15. BEGINNING TEACHER INDUCTION PROGRAM 12 12 For purposes of the beginning teacher induction program as 12 13 provided in section 256E.2: 12 14 .................................................. $ 300,000 12 15 Notwithstanding section 8.33, moneys appropriated in this 12 16 section that remain unencumbered or unobligated at the close 12 17 of the fiscal year shall not revert but shall remain available 12 18 for expenditure for the purposes designated until the close of 12 19 the succeeding fiscal year. 12 20 16. COMMUNITY COLLEGES 12 21 For general state financial aid, including general 12 22 financial aid to merged areas in lieu of personal property tax 12 23 replacement payments, to merged areas as defined in section 12 24 260C.2, for vocational education programs in accordance with 12 25 chapters 258 and 260C: 12 26 .................................................. $141,577,403 12 27 The funds appropriated in this subsection shall be 12 28 allocated as follows: 12 29 a. DISTRIBUTION OF FUNDS APPROPRIATED. For the 13 10 fiscal year beginning July 1, 1999, and ending June 30, 2000, 13 11 moneys appropriated by the general assembly from the general 13 12 fund to the department of education for community colleges for 13 13 a fiscal year shall be allocated to each community college by 13 14 the department of education in the following manner: 13 15 1. BASE FUNDING. The base funding for a fiscal year shall 13 16 be equal to the amount each community college received as an 13 17 allocation from appropriations made from the general fund of 13 18 the state in the most recent fiscal year. 13 19 2. DISTRIBUTION FOR INFLATION. First priority shall be to 13 20 give each college an increase based upon inflation. The 13 21 inflation increase shall be not less than 2 percent. However, 13 22 the inflation increase shall be equal to the national 13 23 inflation rate, if it exceeds 2 percent, if the amount of 13 24 state aid appropriated is equal to or greater than the 13 25 national inflation rate. 13 26 3. DISTRIBUTION BASED ON PROPORTIONAL SHARE OF ENROLLMENT. 13 27 The balance of the growth in state aid appropriations, once 13 28 the inflation increase has been satisfied, shall be 13 29 distributed based on each college's proportional share of 13 30 enrollment. However, a minimum of one percent of the total 13 31 growth shall be distributed in this manner. 13 32 4. If the total appropriation made by the general assembly 13 33 is less than 2 percent growth, the entire increase shall be 13 34 distributed as inflation. 13 35 Sec. 9. BOARD OF EDUCATIONAL EXAMINERS LICENSING FEES. 14 1 Notwithstanding section 272.10, up to 85 percent of any funds 14 2 received annually resulting from an increase in fees approved 14 3 and implemented for licensing by the state board of 14 4 educational examiners after July 1, 1997, shall be available 14 5 for the fiscal year beginning July 1, 1999, to the state board 14 6 for purposes related to the state board's duties, including, 14 7 but not limited to, additional full-time equivalent positions. 14 8 The director of revenue and finance shall draw warrants upon 14 9 the treasurer of state from the funds appropriated as provided 14 10 in this section and shall make the funds resulting from the 14 11 increase in fees available during the fiscal year to the state 14 12 board on a monthly basis. 14 13 Sec. 10. FISCAL YEAR 1999-2000 EXTENDED SCHOOL YEAR GRANT 14 14 MONEYS DISTRIBUTION. 14 15 1. Notwithstanding section 8.33 and section 256.22, 14 16 subsection 4, from the funds appropriated in 1998 Iowa Acts, 14 17 chapter 1216, section 1, subsection 1, to the department of 14 18 education for extended school year grants, which remain 14 19 unencumbered or unobligated on June 30, 1999, the sum of 14 20 $735,000 shall not revert to the general fund of the state and 14 21 shall not be available for expenditure for the following 14 22 fiscal year for purposes of extended school year grants, but 14 23 shall be reallocated by the department as follows: 14 24 a. The sum of $200,000 to the board of educational 14 25 examiners for a one-year pilot program study to assess the 14 26 performance of teacher education graduates at no charge to the 14 27 graduates. The department of education, the board of 14 28 educational examiners, and the college student aid commission 14 29 shall determine the number of students that will be tested at 14 30 each postsecondary institution that provides an approved 14 31 practitioner preparation program in a manner that will result 14 32 in a reliable statistical sampling. It is the intent of the 14 33 general assembly that if the board recommends statewide 14 34 implementation of the assessment prior to initial licensure, 14 35 the costs of an assessment shall be paid by the teacher 15 1 education graduate applying for initial licensure. 15 2 b. The sum of $100,000 to the division of libraries and 15 3 information services for promotion of the next decennial 15 4 federal census. 15 5 c. The sum of $100,000 to the department of education for 15 6 distribution to the reading recovery center. 15 7 d. The sum of $120,000 to the department of education for 15 8 support of the family resource center demonstration program 15 9 established under chapter 256C. 15 10 e. The sum of $165,000 to the department of education for 15 11 reimbursement of school district claims for the costs of 15 12 acquiring and using employability skills assessment tools as 15 13 provided in section 7, subsection 14, of this Act. 15 14 f. The sum of $50,000 to the department of cultural 15 15 affairs for the local arts comprehensive educational 15 16 strategies program (LACES) for contracting with the Iowa 15 17 alliance for arts education to execute their local arts 15 18 comprehensive educational strategies. The sum reallocated in 15 19 this lettered paragraph is in addition to funds appropriated 15 20 in section 6, subsection 5, of this Act. 15 21 Sec. 11. REGIONAL LIBRARIES STUDY. The legislative 15 22 council is requested to establish an interim study committee 15 23 to review the issues concerning making regional library staff 15 24 state employees. The interim study committee shall submit a 15 25 report of recommendations concerning these issues and 15 26 recommendations for any necessary legislation to the general 15 27 assembly by December 1, 1999. 15 28 Sec. 12. COMMUNITY COLLEGE GOVERNANCE TASK FORCE. The 15 29 legislative council is requested to establish an interim task 15 30 force consisting of members of both political parties from 15 31 both houses of the general assembly, the office of the 15 32 governor, representatives of the Iowa association of community 15 33 college trustees, the Iowa association of community college 15 34 presidents, and the division of community colleges and 15 35 workforce preparation of the department of education, to 16 1 identify and study options for restructuring the community 16 2 college governance system. The goal of the task force shall 16 3 be to determine a plan for a community college governance 16 4 structure that causes community colleges to operate more 16 5 cooperatively, effectively, and efficiently as a state system, 16 6 while recognizing the strong local character of community 16 7 colleges. The task force shall review the current community 16 8 college governance system; ongoing collaborative efforts among 16 9 the community colleges; the relationships between the 16 10 community colleges and local school districts, accredited 16 11 nonpublic schools, other accredited postsecondary institutions 16 12 in Iowa, and the department of education; and changes 16 13 necessary to enhance the accountability of community colleges. 16 14 The task force shall submit its findings and recommendations 16 15 for a plan for a restructuring of the community college 16 16 governance system that achieves the goals set forth in this 16 17 section in a report to the chairpersons and ranking members of 16 18 the senate and house standing committees on education and the 16 19 joint appropriations subcommittee on education by December 1, 16 20 1999. 16 21 STATE BOARD OF REGENTS 16 22 Sec. 13. STATE BOARD OF REGENTS STUDY. The state board of 24 35 regents shall, in consultation with the Iowa association of 25 1 independent colleges and universities and the Iowa 25 2 coordinating council for post-high school education, complete 25 3 a study of the number and type of undergraduate and graduate 25 4 degree programs offered at the satellite locations of all 25 5 institutions of higher learning under the control of the state 25 6 board of regents and at the satellite locations of all 25 7 accredited private postsecondary institutions. The study 25 8 shall include a listing of degree programs currently in 25 9 operation and those the Iowa coordinating council has 25 10 approved, but which have not yet begun operation. By January 25 11 15, 2000, the state board of regents shall submit a report to 25 12 the chairpersons and ranking members of the senate and house 25 13 joint appropriations subcommittee on education, the 25 14 legislative fiscal bureau, the secretary of the senate, and 25 15 the chief clerk of the house of representatives, that contains 25 16 the following information: 25 17 1. A listing of all satellite locations where degree 25 18 programs are offered. 25 19 2. A listing of all degree programs offered, identified by 25 20 satellite location and postsecondary institution. 25 21 3. The enrollment in each degree program by resident, 25 22 nonresident, and the combined enrollment total. 25 23 4. The date each degree program was approved by the Iowa 25 24 coordinating council for post-high school education. 25 25 5. The date each degree program actually began operation. 25 26 For purposes of this section, "satellite" means a facility 25 27 not attached to the campus of the main postsecondary 25 28 institution. 25 29 Sec. 15. MEDICAL ASSISTANCE SUPPLEMENTAL AMOUNTS. For 25 30 the fiscal year beginning July 1, 1999, and ending June 30, 25 31 2000, the department of human services shall continue the 25 32 supplemental disproportionate share and a supplemental 25 33 indirect medical education adjustment applicable to state- 25 34 owned acute care hospitals with more than 500 beds and shall 25 35 reimburse qualifying hospitals pursuant to that adjustment 26 1 with a supplemental amount for services provided medical 26 2 assistance recipients. The adjustment shall generate 26 3 supplemental payments intended to equal the state 26 4 appropriation made to a qualifying hospital for treatment of 26 5 indigent patients as provided in chapter 255. To the extent 26 6 of the supplemental payments, a qualifying hospital shall, 26 7 after receipt of the funds, transfer to the department of 26 8 human services an amount equal to the actual supplemental 26 9 payments that were made in that month. The aggregate amounts 26 10 for the fiscal year shall not exceed the state appropriation 26 11 made to the qualifying hospital for treatment of indigent 26 12 patients as provided in chapter 255. The department of human 26 13 services shall deposit the portion of these funds equal to the 26 14 state share in the department's medical assistance account and 26 15 the balance shall be credited to the general fund of the 26 16 state. To the extent that state funds appropriated to a 26 17 qualifying hospital for the treatment of indigent patients as 26 18 provided in chapter 255 have been transferred to the 26 19 department of human services as a result of these supplemental 26 20 payments made to the qualifying hospital, the department shall 26 21 not, directly or indirectly, recoup the supplemental payments 26 22 made to a qualifying hospital for any reason, unless an 26 23 equivalent amount of the funds transferred to the department 26 24 of human services by a qualifying hospital pursuant to this 26 25 provision is transferred to the qualifying hospital by the 26 26 department. 26 27 If the state supplemental amount allotted to the state of 26 28 Iowa for the federal fiscal year beginning October 1, 1999, 26 29 and ending September 30, 2000, pursuant to section 1923(f)(3) 26 30 of the federal Social Security Act, as amended, or pursuant to 26 31 federal payments for indirect medical education is greater 26 32 than the amount necessary to fund the federal share of the 26 33 supplemental payments specified in the preceding paragraph, 26 34 the department of human services shall increase the 26 35 supplemental disproportionate share or supplemental indirect 27 1 medical education adjustment by the lesser of the amount 27 2 necessary to utilize fully the state supplemental amount or 27 3 the amount of state funds appropriated to the state university 27 4 of Iowa general education fund and allocated to the university 27 5 for the college of medicine. The state university of Iowa 27 6 shall transfer from the allocation for the college of medicine 27 7 to the department of human services, on a monthly basis, an 27 8 amount equal to the additional supplemental payments made 27 9 during the previous month pursuant to this paragraph. A 27 10 qualifying hospital receiving supplemental payments pursuant 27 11 to this paragraph that are greater than the state 27 12 appropriation made to the qualifying hospital for treatment of 27 13 indigent patients as provided in chapter 255 shall be 27 14 obligated as a condition of its participation in the medical 27 15 assistance program to transfer to the state university of Iowa 27 16 general education fund on a monthly basis an amount equal to 27 17 the funds transferred by the state university of Iowa to the 27 18 department of human services. To the extent that state funds 27 19 appropriated to the state university of Iowa and allocated to 27 20 the college of medicine have been transferred to the 27 21 department of human services as a result of these supplemental 27 22 payments made to the qualifying hospital, the department shall 27 23 not, directly or indirectly, recoup these supplemental 27 24 payments made to a qualifying hospital for any reason, unless 27 25 an equivalent amount of the funds transferred to the 27 26 department of human services by the state university of Iowa 27 27 pursuant to this paragraph is transferred to the qualifying 27 28 hospital by the department. 27 29 Continuation of the supplemental disproportionate share and 27 30 supplemental indirect medical education adjustment shall 27 31 preserve the funds available to the university hospital for 27 32 medical and surgical treatment of indigent patients as 27 33 provided in chapter 255 and to the state university of Iowa 27 34 for educational purposes at the same level as provided by the 27 35 state funds initially appropriated for that purpose. 28 1 The department of human services shall, in any compilation 28 2 of data or other report distributed to the public concerning 28 3 payments to providers under the medical assistance program, 28 4 set forth reimbursements to a qualifying hospital through the 28 5 supplemental disproportionate share and supplemental indirect 28 6 medical education adjustment as a separate item and shall not 28 7 include such payments in the amounts otherwise reported as the 28 8 reimbursement to a qualifying hospital for services to medical 28 9 assistance recipients. 28 10 For purposes of this section, "supplemental payment" means 28 11 a supplemental payment amount paid for medical assistance to a 28 12 hospital qualifying for that payment under this section. 28 13 Sec. 16. STATE UNIVERSITY OF IOWA DEPARTMENT OF HUMAN 28 14 SERVICES. The department of human services shall transfer to 28 15 the state university of Iowa for the purposes of the creative 28 16 employment options program the same amount of moneys in the 28 17 fiscal year beginning July 1, 1999, and ending June 30, 2000, 28 18 as was transferred in the fiscal year beginning July 1, 1997, 28 19 and ending June 30, 1998. 28 20 Sec. 17. For the fiscal year beginning July 1, 1999, and 28 21 ending June 30, 2000, the state board of regents may use 28 22 notes, bonds, or other evidences of indebtedness issued under 28 23 section 262.48 to finance projects that will result in energy 28 24 cost savings in an amount that will cause the state board to 28 25 recover the cost of the projects within an average of six 28 26 years. 28 27 Sec. 18. Notwithstanding section 270.7, the department of 28 28 revenue and finance shall pay the state school for the deaf 28 29 and the Iowa braille and sight saving school the moneys 28 30 collected from the counties during the fiscal year beginning 28 31 July 1, 1999, for expenses relating to prescription drug costs 28 32 for students attending the state school for the deaf and the 28 33 Iowa braille and sight saving school. 28 34 Sec. 19. Section 256.22, subsection 2, Code 1999, is 28 35 amended to read as follows: 29 1 2. Grant moneys shall be distributed to qualifying school 29 2 districts by the department no later than October 15,199829 3 1999. Grant amounts shall be distributed as determined by the 29 4 department. 29 5 Sec. 20. Section 256.44, Code 1999, as amended by 1999 29 6 Iowa Acts, House File 766, if enacted, is amended by adding 29 7 the following new subsection: 29 8 NEW SUBSECTION. 8. Notwithstanding section 8.33, funds 29 9 appropriated for purposes of this section which remain 29 10 unencumbered or unobligated at the close of the fiscal year 29 11 for which the funds were appropriated shall not revert but 29 12 shall be available for expenditure for the following fiscal 29 13 year for purposes of this section. 29 14 Sec. 21. NEW SECTION. 256.67A INSURANCE ELIGIBILITY. 29 15 Personnel employed by a regional library shall be 29 16 considered state employees for purposes of eligibility for 29 17 receiving employee health and dental insurance as provided to 29 18 state employees by the department of personnel. If a regional 29 19 library elects to participate in a state employee health and 29 20 dental insurance program, the regional library shall continue 29 21 to pay the costs of employee participation in a program from 29 22 funds appropriated for purposes of the regional libraries by 29 23 the general assembly. 29 24 Sec. 22. NEW SECTION. 256E.1 DEFINITIONS. 29 25 As used in this chapter, unless the context otherwise 29 26 requires: 29 27 1. "Beginning teacher" means an individual serving under 29 28 an initial provisional or conditional license, issued by the 29 29 board of educational examiners under chapter 272, who is 29 30 assuming a position as a classroom teacher. 29 31 2. "Board" means the board of directors of a school 29 32 district or a collaboration of boards of directors of school 29 33 districts. 29 34 3. "Classroom teacher" means an individual who holds a 29 35 valid practitioner's license and who is employed under a 30 1 teaching contract with a school district or area education 30 2 agency in this state to provide classroom instruction to 30 3 students. 30 4 4. "Department" means the department of education. 30 5 5. "Director" means the director of the department of 30 6 education. 30 7 6. "District facilitator" means a licensed professional 30 8 pursuant to chapter 272 who is appointed by a board to serve 30 9 as the liaison between the board and the department for the 30 10 beginning teacher induction program. 30 11 7. "Mentor" means an individual employed by a school 30 12 district or area education agency as a classroom teacher who 30 13 holds a valid license to teach issued under chapter 272. The 30 14 individual must have a record of four years of successful 30 15 teaching practice, must be employed as a classroom teacher on 30 16 a nonprobationary basis, and must demonstrate professional 30 17 commitment to the improvement of teaching and learning, and 30 18 the development of beginning teachers. 30 19 Sec. 23. NEW SECTION. 256E.2 BEGINNING TEACHER INDUCTION 30 20 PROGRAM ESTABLISHED GRANTS. 30 21 1. If the general assembly appropriates moneys for 30 22 purposes of teacher induction, the department of education 30 23 shall coordinate a beginning teacher induction program to 30 24 promote excellence in teaching, build a supportive environment 30 25 within school districts, increase the retention of promising 30 26 beginning teachers, and promote the personal and professional 30 27 well-being of teachers. 30 28 2. The department shall adopt rules concerning the grant 30 29 application and award process, including reasonable cost 30 30 estimates for beginning teacher induction programs. The 30 31 department may disapprove a plan submitted by a board if the 30 32 plan does not meet the minimum criteria set forth in section 30 33 256E.3, subsection 2, or the plan exceeds the reasonable costs 30 34 as determined by the department. If the cost estimates 30 35 submitted by a board exceed reasonable cost estimates as 31 1 determined by the department, the department shall work with 31 2 the board to identify measures for reducing plan costs. If 31 3 the department determines that moneys appropriated by the 31 4 general assembly are insufficient to meet the grant requests 31 5 for all approved beginning teacher induction program plans, 31 6 the department shall award grants based on the geographic 31 7 location and district population of the school districts with 31 8 approved plans. Grants may be awarded in subsequent years 31 9 based upon the most recent plan on file with the department. 31 10 It is the intent of the general assembly that the department 31 11 approve plans that incorporate local innovation and take into 31 12 consideration local needs. 31 13 Sec. 24. NEW SECTION. 256E.3 DISTRICT FACILITATOR AND 31 14 PLAN. 31 15 1. An area education agency shall prepare a model 31 16 beginning teacher induction program plan and shall provide the 31 17 model plan to each school district within its area. The plan 31 18 shall include a model evaluation component by which a school 31 19 district may measure the effectiveness of its program. Any 31 20 modifications to the model plan shall be submitted to school 31 21 districts as soon as practical. A board that wishes to 31 22 participate in the program shall adopt a beginning teacher 31 23 induction program plan and written procedures for the program, 31 24 and may use, alter, or revise the model plan provided by the 31 25 area education agency at the board's discretion. 31 26 2. A board that wishes to participate in the beginning 31 27 teacher induction program shall appoint a district 31 28 facilitator, whose duties shall include, but are not limited 31 29 to, overseeing the implementation of a plan for meeting the 31 30 goals of the program as set forth in section 256E.2. The plan 31 31 shall, at a minimum, provide the process for the selection of 31 32 and the number of mentors; the mentor training process; the 31 33 timetable by which the plan shall be implemented; placement of 31 34 mentors and beginning teachers; the minimum amount of contact 31 35 time between mentors and beginning teachers; the minimum 32 1 amount of release time for mentors and beginning teachers for 32 2 meetings for planning, demonstration, observation, feedback, 32 3 and workshops; the process for dissolving mentor and beginning 32 4 teacher partnerships; and the process for measuring the 32 5 results of the program. 32 6 3. The district facilitator shall submit the plan, and the 32 7 proposed costs of implementing the plan, to the board, which 32 8 shall consider the plan and, once approved, submit the plan 32 9 and a reasonable cost proposal to the department of education. 32 10 4. The district facilitator is encouraged to work with 32 11 area education agencies and postsecondary institutions in the 32 12 preparation and implementation of a plan. 32 13 5. The district facilitator shall place beginning teachers 32 14 participating in the program in a manner that provides the 32 15 greatest opportunity to work with the largest number of 32 16 mentors. 32 17 Sec. 25. NEW SECTION. 256E.4 BEGINNING TEACHER INDUCTION 32 18 STATE SUBSIDY FUND. 32 19 1. A mentor in a beginning teacher induction program 32 20 approved under this chapter shall be eligible for an award of 32 21 five hundred dollars per semester, at a minimum, for 32 22 participation in the program, which shall be paid from moneys 32 23 received pursuant to this chapter by the school district. 32 24 2. Moneys received by a school district pursuant to this 32 25 chapter shall be expended to provide mentors with awards in 32 26 accordance with subsection 1, to implement the plan, to 32 27 provide for a stipend for the district facilitator, and to pay 32 28 any applicable costs of the employer's share of contributions 32 29 to federal social security and the Iowa public employees' 32 30 retirement system or a pension and annuity retirement system 32 31 established under chapter 294, for such amounts paid by the 32 32 district. 32 33 3. Moneys received by a school district under this chapter 32 34 are miscellaneous income for purposes of chapter 257 or are 32 35 considered encumbered. A school district shall maintain a 33 1 separate listing within its budget for payments received and 33 2 expenditures made pursuant to this section. 33 3 4. A beginning teacher induction fund is established in 33 4 the office of the treasurer of state to be administered by the 33 5 department. Moneys appropriated by the general assembly for 33 6 deposit in the fund shall be used to provide funding to school 33 7 districts pursuant to this section. 33 8 Sec. 26. NEW SECTION. 256E.5 REPORTS. 33 9 The board implementing an approved beginning teacher 33 10 induction program as provided in this chapter shall submit an 33 11 assessment of the program's results by July 1 of the fiscal 33 12 year succeeding the year in which the school district received 33 13 moneys under this chapter. The department shall annually 33 14 report the statewide results of the program to the 33 15 chairpersons and the ranking members of the senate and house 33 16 education committees by January 1. 33 17 Sec. 27. Section 261.2, Code 1999, is amended by adding 33 18 the following new subsection: 33 19 NEW SUBSECTION. 15. Be prohibited from expending interest 33 20 moneys earned on accounts of the commission located within the 33 21 office of the treasurer of state unless the general assembly 33 22 specifically appropriates the interest moneys for use by the 33 23 commission. If the general assembly appropriates interest 33 24 moneys transferred from the Pub. L. No. 105-33 recall account 33 25 within the office of the treasurer of state to the fund 61 33 26 default reduction account, the commission shall adopt rules 33 27 for the expenditure of the interest moneys for purposes of 33 28 issuing emergency loans to assist needy students in avoiding 33 29 default on a guaranteed or parental loan made under this 33 30 chapter. 33 31 Sec. 28. Section 261.12, subsection 1, paragraph b, Code 33 32 1999, is amended to read as follows: 33 33 b. For the fiscal year beginning July 1,19981999, and 33 34 for each following fiscal year, three thousandsixnine 33 35 hundredfiftydollars. 34 1 Sec. 29. Section 261.17, subsection 3, unnumbered 34 2 paragraph 1, Code 1999, is amended to read as follows: 34 3 A qualified full-time student may receive vocational- 34 4 technical tuition grants for not more than four semesters,34 5eight quartersor the trimester or quarter equivalent of two 34 6 full years of study.The amount of a vocational-technical34 7tuition grant to aA qualified part-time student enrolled in a 34 8 course of study including at least three semester hours but 34 9 fewer than twelve semester hours or the trimester or quarter 34 10 equivalentshall be equal to the amount of a tuition grant34 11that would be paid to a full-time student times a number which34 12represents the number of hours in which the part-time student34 13is actually enrolled divided by twelve semester hours,may 34 14 receive vocational-technical tuition grants for not more than 34 15 eight semesters or the trimester or quarter equivalent of two 34 16 full years of full-time study. 34 17 Sec. 30. Section 261.17, subsection 4, Code 1999, is 34 18 amended to read as follows: 34 19 4. a. The amount of a vocational-technical tuition grant 34 20 to a qualified full-time student shall not exceed the lesser 34 21 of six hundred fifty dollars per year or the amount of the 34 22 student's established financial need. 34 23 b. The amount of a vocational-technical tuition grant to a 34 24 qualified part-time student enrolled in a course of study 34 25 including at least three semester hours but fewer than twelve 34 26 semester hours or the trimester or quarter equivalent shall be 34 27 equal to the amount of a vocational-technical tuition grant 34 28 that would be paid to a full-time student, except that the 34 29 commission shall prorate the amount in a manner consistent 34 30 with the federal Pell grant program proration. 34 31 Sec. 31. Section 261.25, subsections 1 through 3, Code 34 32 1999, are amended to read as follows: 34 33 1. There is appropriated from the general fund of the 34 34 state to the commission for each fiscal year the sum offorty-34 35fourforty-seven million six hundred sixty-four thousand seven 35 1 hundred fifty dollars for tuition grants. 35 2 2. There is appropriated from the general fund of the 35 3 state to the commission for each fiscal year the sum of four 35 4 hundredseventy-fourninety-eight thousandeightfive hundred 35 5 forty dollars for scholarships. 35 6 3. There is appropriated from the general fund of the 35 7 state to the commission for each fiscal year the sum of two 35 8 milliontwofour hundredforty-foureighty-two thousandone35 9 four hundredninety-sevendollars for vocational-technical 35 10 tuition grants. 35 11 Sec. 32. Section 261.25, subsection 4, Code 1999, is 35 12 amended by striking the subsection. 35 13 Sec. 33. Section 261.38, subsection 1, Code 1999, is 35 14 amended to read as follows: 35 15 1. The commission shall establish a loan reserve account 35 16from which any default on a guaranteed student loan shall be35 17paidand an agency operating account as authorized by the 35 18 federal Higher Education Act of 1965. The commission shall 35 19 credit tothis accountthese accounts all moneysdesignated35 20exclusively for the reserve fundprovided for the state 35 21 student loan program by the United States, the state of Iowa, 35 22 or any of their agencies, departments or instrumentalities, as 35 23 well as any funds accruing to the program which are not 35 24 required for current administrative expenses. Thedepartment35 25of management shall determine the actuarially sound reserve35 26requirement for the amount of guaranteed loans outstanding35 27 commission may expend moneys in the loan reserve and agency 35 28 operating accounts as authorized by the federal Higher 35 29 Education Act of 1965. 35 30 Sec. 34. Section 261.38, subsection 2, Code 1999, is 35 31 amended by striking the subsection. 35 32 Sec. 35. Section 261.38, subsections 3, 4, and 5, Code 35 33 1999, are amended to read as follows: 35 34 3. The payment of any funds for the default on a 35 35 guaranteed student loan shall be solely from the loan reserve 36 1accountand agency operating accounts. The general assembly 36 2 shall not be obligated to appropriate any moneys to pay for 36 3 any defaults or to appropriate any moneys to be credited to 36 4 the loan reserve account. The commission shall not give or 36 5 lend the credit of the state of Iowa. 36 6 4.FundsNotwithstanding section 8.33, funds on deposit in 36 7 the loan reserveaccount or in the administrative accountand 36 8 operating accounts shall not revert to the state general fund 36 9 at the close of any fiscal year. 36 10 5. The treasurer of state shall invest any funds, 36 11 including those in the loan reserveaccountand operating 36 12 accounts, and, notwithstanding section 12C.7, the interest 36 13 income earned shall be credited back to theloan reserve36 14 appropriate account. 36 15 Sec. 36. Section 261.38, subsection 6, Code 1999, is 36 16 amended by striking the subsection. 36 17 Sec. 37. Section 261.38, subsection 7, unnumbered 36 18 paragraph 1, Code 1999, is amended to read as follows: 36 19 The commission mayexpend funds in the reserve account and36 20 enter into agreements with the Iowa student loan liquidity 36 21 corporation in order to increase access for students to 36 22 education loan programs that the commission determines meet 36 23 the education needs of Iowa residents. The agreements shall 36 24 permit the establishment, funding, and operation of 36 25 alternative education loan programs, as described in section 36 26 144(b)(1)(B) of the Internal Revenue Code of 1986 as amended, 36 27 as defined in section 422.3, in addition to programs permitted 36 28 under the federal Higher Education Act of 1965. In accordance 36 29 with those agreements, the Iowa student loan liquidity 36 30 corporation may issue bonds, notes, or other obligations to 36 31 the public and others for the purpose of funding the 36 32 alternative education loan programs. This authority to issue 36 33suchbonds, notes, or other obligations shall be in addition 36 34 to the authority established in the articles of incorporation 36 35 and bylaws of the Iowa student loan liquidity corporation. 37 1 Sec. 38. Section 261.71, subsection 1, paragraph c, Code 37 2 1999, is amended to read as follows: 37 3 c. The studentpracticesagrees to practice in an 37 4 underserved area in the state of Iowa for a period of time to 37 5 be determined by the commission at the time the loan is 37 6 awarded. 37 7 Sec. 39. Section 261.71, subsections 2 and 3, Code 1999, 37 8 are amended to read as follows: 37 9 2.Of the moneys loaned to an eligible student, for each37 10year of up to and including four years of practice in Iowa, an37 11amount equal to twenty-five percent of the original principal37 12and the proportionate share of accrued interest, or one37 13thousand one hundred dollars, whichever is greater, shall be37 14forgiven. If a student fails to complete a year of practice37 15in the state, as practice is defined by the college student37 16aid commission, the loan amount for that year shall not be37 17forgiven.The contract for the loan repayment shall stipulate 37 18 the time period the chiropractor shall practice in an 37 19 underserved area in this state. In addition, the contract 37 20 shall stipulate that the chiropractor repay any funds paid on 37 21 the chiropractor's loan by the commission if the chiropractor 37 22 fails to practice in an underserved area in this state for the 37 23 required period of time. Forgivable loans made to eligible 37 24 students shall not become due, for repayment purposes, until 37 25 one year after the student has graduated. A loan that has not 37 26 been forgiven may be sold to a bank, savings and loan 37 27 association, credit union, or nonprofit agency eligible to 37 28 participate in the guaranteed student loan program under the 37 29 federal Higher Education Act of 1965, 20 U.S.C. } 1071 et 37 30 seq., by the commission when the loan becomes due for 37 31 repayment. 37 32 3. For purposes of this section "graduate student" means a 37 33 student who has completed at least ninety semester hours, or 37 34 the trimester or quarter equivalent, of postsecondary course 37 35 work at a public higher education institution or at an 38 1 accredited private institution, as defined under section 38 2 261.9. "Underserved area" means a geographical area included 38 3 on the Iowa governor's health practitioner shortage area list, 38 4 which is compiled by the center for rural health and primary 38 5 care of the Iowa department of public health. Thecollege38 6student aidcommission shall adopt rules, consistent with 38 7 rules used for students enrolled in higher education 38 8 institutions under the control of the state board of regents, 38 9 for purposes of determining Iowa residency status of graduate 38 10 students under this section. The commission shall also adopt 38 11 rules which provide standards, guidelines, and procedures for 38 12 the receipt, processing, and administration of student 38 13 applications and loans under this section. 38 14 Sec. 40. NEW SECTION. 261.86 NATIONAL GUARD EDUCATIONAL 38 15 ASSISTANCE PROGRAM. 38 16 1. A national guard educational assistance program is 38 17 established to be administered by the college student aid 38 18 commission for members of the Iowa national guard who are 38 19 enrolled as undergraduate students in a community college, an 38 20 institution of higher learning under the state board of 38 21 regents, or an accredited private institution. The college 38 22 student aid commission shall adopt rules pursuant to chapter 38 23 17A to administer this section. An individual is eligible for 38 24 the national guard educational assistance program if the 38 25 individual meets all of the following conditions: 38 26 a. Is a resident of the state and a member of an Iowa army 38 27 or air national guard unit while receiving educational 38 28 assistance pursuant to this section. 38 29 b. Satisfactorily completed required initial active duty 38 30 training. 38 31 c. Maintains satisfactory performance of duty upon return 38 32 from initial active duty training, including attending a 38 33 minimum ninety percent of scheduled drill dates and attending 38 34 annual training. 38 35 d. Is enrolled as an undergraduate student in a community 39 1 college as defined in section 260C.2, an institution of higher 39 2 learning under the control of the board of regents, or an 39 3 accredited private institution as defined in section 261.9, 39 4 and is maintaining satisfactory academic progress. 39 5 e. Provides proper notice of national guard status to the 39 6 community college or institution at the time of registration 39 7 for the term in which tuition benefits are sought. 39 8 f. Submits an application to the adjutant general of Iowa, 39 9 on forms prescribed by the adjutant general, who shall 39 10 determine eligibility and whose decision is final. 39 11 2. The amount of educational assistance received by a 39 12 national guard member pursuant to this section shall be 39 13 determined by the adjutant general and shall not exceed the 39 14 resident tuition rate established for institutions of higher 39 15 learning under the control of the state board of regents. If 39 16 the amount appropriated in a fiscal year for purposes of this 39 17 section is insufficient to provide educational assistance to 39 18 all national guard members who apply for the program and who 39 19 are determined by the adjutant general to be eligible for the 39 20 program, the adjutant general shall determine the amount of 39 21 educational assistance each eligible guard member shall 39 22 receive. However, educational assistance paid to an eligible 39 23 national guard member shall not be less than an amount equal 39 24 to fifty percent of the resident tuition rate established for 39 25 institutions of higher learning under the control of the state 39 26 board of regents. The adjutant general shall not determine 39 27 educational assistance amounts based upon a national guard 39 28 member's unit, the location at which drills are attended, or 39 29 whether the eligible individual is a member of the Iowa army 39 30 or air national guard. 39 31 3. An eligible member of the national guard, attending an 39 32 institution as provided in subsection 1, paragraph "d", as a 39 33 full-time student, shall not receive educational assistance 39 34 under this section for more than eight semesters, or if 39 35 attending as a part-time student for not more than sixteen 40 1 semesters, of undergraduate study, or the trimester or quarter 40 2 equivalent. A national guard member who has met the 40 3 educational requirements for a baccalaureate degree is 40 4 ineligible for educational assistance under this section. 40 5 4. The eligibility of applicants and amounts of 40 6 educational assistance to be paid shall be certified by the 40 7 adjutant general of Iowa to the college student aid 40 8 commission, and all amounts that are or become due to a 40 9 community college, accredited private institution, or 40 10 institution of higher learning under the control of the state 40 11 board of regents under this section shall be paid to the 40 12 college or institution by the college student aid commission 40 13 upon receipt of certification by the president or governing 40 14 board of the educational institution as to accuracy of charges 40 15 made, and as to the attendance and academic progress of the 40 16 individual at the educational institution. The college 40 17 student aid commission shall maintain an annual record of the 40 18 number of participants and the dollar value of the educational 40 19 assistance provided. 40 20 5. For purposes of this section, unless otherwise 40 21 required, "educational assistance" means the same as "cost of 40 22 attendance" as defined in Title IV, part B, of the federal 40 23 Higher Education Act of 1965 as amended. 40 24 Sec. 41. Section 261.111, Code 1999, is amended by 40 25 striking the section and inserting in lieu thereof the 40 26 following: 40 27 261.111 TEACHER SHORTAGE FORGIVABLE LOAN PROGRAM. 40 28 1. A teacher shortage forgivable loan program is 40 29 established to be administered by the college student aid 40 30 commission. An individual is eligible for the forgivable loan 40 31 program if the individual is a resident of this state who is 40 32 enrolled as a sophomore, junior, senior, or graduate student 40 33 in an approved practitioner preparation program in a 40 34 designated area in which teacher shortages are anticipated, at 40 35 an institution of higher learning under the control of the 41 1 state board of regents or an accredited private institution as 41 2 defined in section 261.9. 41 3 2. The director of the department of education shall 41 4 annually designate the areas in which teacher shortages are 41 5 anticipated. The director shall periodically conduct a survey 41 6 of school districts, accredited nonpublic schools, and 41 7 approved practitioner preparation programs to determine 41 8 current shortage areas and predict future shortage areas. 41 9 3. Each applicant shall, in accordance with the rules of 41 10 the commission, do the following: 41 11 a. Complete and file an application for a teacher shortage 41 12 forgivable loan. The individual shall be responsible for the 41 13 prompt submission of any information required by the 41 14 commission. 41 15 b. File a new application and submit information as 41 16 required by the commission annually on the basis of which the 41 17 applicant's eligibility for the renewed forgivable loan will 41 18 be evaluated and determined. 41 19 4. Forgivable loans to eligible students shall not become 41 20 due until after the student graduates or leaves school. The 41 21 individual's total loan amount, including principal and 41 22 interest, shall be reduced by twenty percent for each year in 41 23 which the individual remains an Iowa resident and is employed 41 24 in Iowa by a school district or an accredited nonpublic school 41 25 as a practitioner in the teacher shortage area for which the 41 26 loan was approved. If the commission determines that the 41 27 person does not meet the criteria for forgiveness of the 41 28 principal and interest payments, the commission shall 41 29 establish a plan for repayment of the principal and interest 41 30 over a ten-year period. If a person required to make the 41 31 repayment does not make the required payments, the commission 41 32 shall provide for payment collection. 41 33 5. The amount of a teacher shortage forgivable loan shall 41 34 not exceed three thousand dollars annually, or the amount of 41 35 the student's established financial need, whichever is less. 42 1 6. The commission shall prescribe by rule the interest 42 2 rate for the forgivable loan. 42 3 7. A teacher shortage forgivable loan repayment fund is 42 4 created for deposit of payments made by forgivable loan 42 5 recipients who do not fulfill the conditions of the forgivable 42 6 loan program and any other moneys appropriated to or received 42 7 by the commission for deposit in the fund. Notwithstanding 42 8 section 8.33, moneys deposited in the fund shall not revert to 42 9 the general fund of the state at the end of any fiscal year 42 10 but shall remain in the forgivable loan repayment fund and be 42 11 continuously available to make additional loans under the 42 12 program. Notwithstanding section 12C.7, subsection 2, 42 13 interest or earnings on moneys deposited in the fund shall be 42 14 credited to the fund. 42 15 8. For purposes of this section, unless the context 42 16 otherwise requires, "teacher" means the same as defined in 42 17 section 272.1. 42 18 Sec. 42. Section 294A.25, subsections 6, 11, and 12, Code 42 19 1999, are amended to read as follows: 42 20 6. For the fiscal year beginning July 1,19971999, and 42 21 ending June 30,19982000, from phase III moneys the amount of 42 22 fifty thousand dollars to the department of education for the 42 23 geography alliance. 42 24 11. For the fiscal year beginning July 1,19981999, and 42 25 ending June 30,19992000, to the department of education from 42 26 phase III moneys the amount of one million two hundred fifty 42 27 thousand dollars for support for the operations of the new 42 28 Iowa schools development corporation and for school 42 29 transformation design and implementation projects administered 42 30 by the corporation. Of the amount provided in this 42 31 subsection, one hundred fifty thousand dollars shall be used 42 32 for the school and community planning initiative. 42 33 12. For the fiscal year beginning July 1,19981999, and 42 34 ending June 30, 2000, to the department of education from 42 35 phase III moneys the amount of one hundred fifty thousand 43 1 dollars to the Iowa public broadcasting division for overnight 43 2 transmitter feeds. 43 3 Sec. 43. Section 294A.25, Code 1999, is amended by adding 43 4 the following new subsections: 43 5 NEW SUBSECTION. 13. For the fiscal year beginning July 1, 43 6 1999, and ending June 30, 2000, to the department of education 43 7 from phase III moneys the amount of fifty thousand dollars for 43 8 participation in the national assessment of education 43 9 progress. 43 10 NEW SUBSECTION. 14. For the fiscal year beginning July 1, 43 11 1999, and ending June 30, 2000, to the department of education 43 12 from phase III moneys the amount of fifty thousand dollars for 43 13 the Iowa mathematics and science coalition. 43 14 Sec. 44. Section 303.16, Code 1999, is amended by adding 43 15 the following new subsection: 43 16 NEW SUBSECTION. 10. a. The general assembly finds that 43 17 the country school that served Iowa's educational needs for 43 18 much of its history offered a unique opportunity to students 43 19 and communities, providing for multigenerational attendance, 43 20 high educational performance, a safe environment, a focus for 43 21 community support, and a caring, attentive environment. 43 22 b. A country schools historical resource preservation 43 23 grant program is therefore established to be administered by 43 24 the historical division for the preservation of one-room and 43 25 two-room buildings once used as country schools. In 43 26 developing grant approval criteria, the division shall place a 43 27 priority on the educational uses planned for the country 43 28 school building, which may include, but are not limited to, 43 29 historical interpretation and use as a teaching museum or as 43 30 an operational classroom accessible to a school district or 43 31 accredited nonpublic school for provisional instructional 43 32 purposes. 43 33 c. Notwithstanding any other provision of this section, 43 34 the amount of a grant shall not exceed twenty-five thousand 43 35 dollars and applicants shall match grant funding on a dollar- 44 1 for-dollar basis, of which at least one-half of the local 44 2 match must be in cash. 44 3 Sec. 45. EMERGENCY RULES. The department of education may 44 4 adopt emergency rules under section 17A.4, subsection 2, and 44 5 section 17A.5, subsection 2, paragraph "b", to implement the 44 6 provisions of Code chapter 256E as enacted by this Act and the 44 7 rules shall be effective immediately upon filing unless a 44 8 later date is specified in the rules. Any rules adopted in 44 9 accordance with this section shall also be published as a 44 10 notice of intended action as provided in section 17A.4. 44 11 Sec. 46. EMERGENCY RULES. The commission of libraries 44 12 shall adopt emergency rules under section 17A.4, subsection 2, 44 13 and section 17A.5, subsection 2, paragraph "b", adopting the 44 14 performance measures referred to in 286 IAC 3.6 and implement 44 15 the provisions of section 7, subsection 5, paragraph "b", of 44 16 this Act, and the rules shall be effective immediately upon 44 17 filing unless a later date is specified in the rules. Any 44 18 rules adopted in accordance with this section shall also be 44 19 published as a notice of intended action as provided in 44 20 section 17A.4. 44 21 Sec. 47. Sections 261.21 and 261.112, Code 1999, are 44 22 repealed. 44 23 Sec. 48. EFFECTIVE DATES. 44 24 1. Section 4 of this Act, relating to the remaining 44 25 national guard tuition aid balance, being deemed of immediate 44 26 importance, takes effect upon enactment. 44 27 2. Section 5 of this Act, relating to the remaining 44 28 industrial technology forgivable loan program balance, being 44 29 deemed of immediate importance, takes effect upon enactment. 44 30 3. Section 9 of this Act, relating to board of educational 44 31 examiners licensing fees, being deemed of immediate 44 32 importance, takes effect upon enactment. 44 33 4. Section 10 of this Act, relating to the distribution of 44 34 FY 1999-2000 extended school year grant moneys, being deemed 44 35 of immediate importance, takes effect upon enactment. 45 1 5.
