  FIRST SESSION DAY

  Senate Chamber
  Des Moines, Iowa, Monday, January 13, 1997

  Pursuant to chapter two (2), sections two point one (2.1) and two point
  three (2.3),
  Code of Iowa, the 1997 Regular Session of the Seventy-seventh General
  Assembly
  convened at 10:01 a.m., and the Senate was called to order by Senator Mary
  E.
  Kramer.

  Prayer was offered by the Reverend Dr. Sam Massey, pastor of the Westminster
  Presbyterian Church, Des Moines, Iowa.

  REMARKS BY THE MAJORITY LEADER

  Senator Iverson addressed the Senate as follows:

  Today is my first day as the Majority Leader of the Iowa Senate, and as I
  assume
  this new position, I feel a great deal of pride about the current condition
  of this state
  and this state's government.
  Over the past five years, Iowa has moved from a $400 million budget deficit
  to a
  budget surplus that is larger than any state in the nation. At the same
  time, we have
  passed tax cuts in the last two years that take important steps toward
  reducing
  property and pension taxes in Iowa. And we have made important investments
  in
  education, including a $150 million technology fund that puts at the
  fingertips of
  Iowa's school children the resources for them to get the best education in
  the world.
  But challenges persist. Despite our efforts over the past two years, Iowans
  pay more
  in state and local taxes than do individuals in forty other states, and
  working class
  families bear a far greater burden of the taxes than working families in
  states that
  surround us.
  There's no doubt that Iowa's tax system, which requires 12% of the people to
  pay
  50% of the taxes, is unfair. There is also no doubt that any effort we
  undertake to fix
  Iowa's tax code will be fair to all Iowans.
  Our efforts to reduce taxes will benefit Iowa families not just by putting
  more money
  back in the family budget. It will also help bring even more good paying
  jobs to Iowa.

  Cutting taxes is only one way in which we can enhance Iowa's
  competitiveness. We
  must also review how government impacts Iowa businesses. One way state
  government can help create new jobs is to insure that government is not
  doing
  anything to keep Iowa's entrepreneurs from expanding. I want to lead a
  review which
  takes a long-term look at Iowa's business climate.
  It is important to stress that this review must be long-term. Everyone here
  today no
  doubt has an ambitious list of things they want to accomplish. But
  government gets in
  trouble when it tries to fix everything at the same time, instead of
  thoroughly
  reviewing every problem, and developing a long-term solution.
  We are lucky to belong to an institution, the Iowa Senate, which has such a
  wonderful history of consensus building and cooperation between those of
  differing
  parties and ideologies. You have my firm commitment to continue these
  outstanding
  traditions.
  Let me conclude by stressing that my door is always open to anyone and their
  ideas.
  I look forward to working with all of you to make our institution, our
  government, and
  our state a model for the nation and the world.

  REMARKS BY THE MINORITY LEADER

  Senator Gronstal addressed the Senate as follows:
  Thank you, Madame President
  Madame President ladies and gentlemen of the senate
  First of all I'd like to welcome and congratulate all of you that won in
  last fall's
  election. They were hard fought and challenging elections and each of us won
  the
  honor of trying to represent our districts and make Iowa a better place.
  To the new majority I sincerely wish you luck and I hope you recognize that
  we have
  left you with the largest budget surplus as a percent of total budget in the
  country.
  That surplus was created by the landmark budget reform law that the
  Democrats
  working with Republicans passed in 1992. That surplus paved the way for two
  of the
  biggest property tax cuts in the history of Iowa. That surplus has spurred
  the talk of
  more tax cuts this session and we share the belief that taxes are too high
  in Iowa but
  we also believe that taxes in Iowa are not fair. We will support efforts to
  create a
  lower, fairer tax burden for Iowa families. But we also believe its
  important to
  remember that the state's bank account was filled to overflowing by ordinary
  working
  Iowans with the sales tax -- and that is where tax cuts should be
  concentrated. A tax
  system where the top 1% pays at a rate one half of the bottom 20% is simply
  not fair
  and needs to be changed. We believe we should go back and make good on the
  deal we
  made in 1992 to fund the renters credit. There are many, many good ideas on
  how to
  make our taxes fairer. We could simply repeal the 5th cent of the sales tax
  or consider
  taking the sales tax off of residential energy bills. We hope you will be
  willing to listen
  and include our proposals.
  But taxes aren't the only issue we face this session. As Governor Branstad
  puts the
  final touches on his Condition of the state address to be delivered
  tomorrow, I hope
  that he will put partisan rhetoric aside and reach out to join our efforts
  to solve many
  of Iowa's problems in a bipartisan manner.

  Those efforts include:
  Making sure that we pay our bills to local governments and fully fund the
  homestead credit and other tax credits.
  Making sure that our schools are high-quality and safe. First, we must
  continue to
  recognize that education has always been a priority in Iowa and is in fact
  our
  strongest economic development tool. Second, we need to make a major
  commitment of
  state dollars to our crumbling schools-many are in such bad shape that the
  state fire
  marshal believes our children are at risk. Let's not wait for a tragedy to
  force us to
  respond.
  Recognizing that higher education is increasingly out of reach for many of
  our
  children we need to insure that every Iowa student with the talent and
  determination
  can go on to higher education. For many Iowans, higher education means our
  community colleges. That's why we proposed last fall to increase our
  investment in
  technology at all of Iowa's community colleges and why we should guarantee
  two years
  of post secondary education at our community colleges.
  Moving ahead with our initiative to give local officials more support to
  fight crime -
  including juvenile crime. We appreciate that the Governor has changed his
  mind on
  this subject and we hope he will work to convince House Republicans that
  local
  governments need more resources from the state to fight crime and make our
  neighborhoods safer.
  Boosting our economic development efforts by increasing our investment in
  affordable housing. We hope the Governor has re-thought his veto of a
  bipartisan plan
  last year that took the first steps to developing a comprehensive, statewide
  plan to
  increase affordable housing.
  Fulfilling our obligations to our innovative welfare reform program. In
  1997, that
  means expanding our investment in affordable day care, high-quality job
  training, and
  creating jobs that pay living wages.
  Addressing the state's growing problems in the well being of children. A new
  study
  has found that in seven of eight measures of child welfare Iowa is losing
  ground.
  Iowa's infant mortality rate has risen past the national average - which, as
  the study
  said, "should be a wake-up call for all of us."
  As I said before, it is time now that we set aside the heat of the political
  battles of
  last fall and begin the important work of finding solutions to the problems
  that
  confront Iowa. In my campaign last fall, while knocking on thousands of
  doors, I never
  heard a citizen suggest that we needed Republican solutions .......... and I
  also never
  heard one say we needed Democratic solutions. They expect us to listen to
  each other
  and recognize that neither party has all the answers and together we can
  find common
  sense solutions to the challenges that confront us.
  Finally as you look around the chamber and the offices in this institution
  and see
  the changes being made to accommodate the transition to the new majority
  party I
  hope you'll recognize the countless hours of work that the staff has put
  into making
  the change as smooth as possible. I'd like to personally thank the
  nonpartisan senate
  staff who have worked so hard and often find themselves caught between our
  partisan
  differences. They have done their jobs with grace and dignity and with the
  single goal
  of making our jobs easier. They have my respect and gratitude.

  TEMPORARY SECRETARY
  Senator Iverson moved that Mary Pat Gunderson be appointed as
  temporary Secretary of the Senate.
  The motion prevailed by a voice vote and Mrs. Gunderson appeared
  before the rostrum and was duly sworn to the oath of office.

  ADOPTION OF TEMPORARY RULES
  AND TEMPORARY COMPENSATION

  Senator Iverson moved that the rules of the Senate and provisions
  for compensation of employees adopted by the 76th General Assembly
  be adopted as the temporary rules and temporary compensation
  provisions for the 1997 session of the 77th General Assembly.
  The motion prevailed by a voice vote.
  COMMITTEE ON CREDENTIALS
  Senator Iverson moved that a committee of five be appointed as a
  committee on credentials.
  The motion prevailed by a voice vote and the Chair announced the
  appointment of Senators Lind, Chair; Tinsman, Douglas, Hansen and
  Halvorson.

  The Senate stood at ease at 10:23 a.m., until the fall of the gavel.

  The Senate resumed session at 10:26 a.m., Senator Kramer presiding.

  ELECTION OF PRESIDENT
  Senator Iverson placed in nomination the name of Senator Mary E.
  Kramer of Polk County as a candidate for the office of President of the
  Senate for the Seventy-seventh General Assembly.
  There being no further nominations, the Chair put the question to
  the Senate and Senator Kramer was unanimously elected by a voice
  vote.

  Senator Maddox requested that Senators, McLaren, Rife and
  Redwine escort President Kramer to the rostrum.
  President Kramer was administered the oath of office by Chief
  Justice Arthur McGivern of the Iowa Supreme Court.
  President Kramer addressed the Senate as follows:
  Good morning, it is indeed an auspicious day - Iowa is beginning her 151st
  year, and
  the 77th general assembly is under way.

  Thanks to my colleagues for their confidence in electing me, the opportunity
  that
  has been given to lead is rare and precious - humbling - and exciting - I
  have been
  anticipating this day - and now that it is here - I find it an awesome
  responsibility.

  What might we expect as we begin the session?

  Well - probably not order! The only truly orderly places are cemeteries - my
  expectation is that the Iowa Senate will be a vital, moving body - some
  times chaotic.
  Chaos is often necessary for the progress of ideas. However, decorum and
  civility have
  long been valued traditions in the Chamber - and have served the process and
  the
  members well.

  So if order is not an appropriate goal for us - we'll seek conflict - debate
  - discussion.
  What is?

  Perhaps a more progressive agenda is seeking the common ground. Hopefully
  our
  most common ground will be our common desire to create good and thoughtful
  public
  policy - policy that moves all Iowans ahead on their journey to the future
  with energy
  and enthusiasm.

  As we prepare to face challenges this year, we know that we will need new
  ideas and
  renewed determination. Another appropriate goal.

  We'll confront challenges in education, our economy tax policy and the
  environment.
  Challenges in health care - from infancy to elder and long term care. We
  have an
  inventory of unfilled aspirations for families and communities... if we
  approach these
  challenges with a determination to avoid all risk, we sentence ourselves to
  the status
  quo - or worse. If we rely exclusively on old ideas, solutions, we will not
  deserve the
  leadership positions our constituents have elected us to assume. If our
  collective fear
  of failure or of taking risk - or our demands for all or nothing -
  immobilize us, we will
  achieve little.

  Let me be clear - I do not recommend failure - I'm not even sure I believe
  failure
  builds character. However, a willingness to risk failure is one of the costs
  of
  leadership.

  And each of us has been elected to lead - to lead not only in ways that are
  positive
  for our own constituents - but for all of Iowa.

  Over one hundred years ago, President Abraham Lincoln penned some "you
  cannots" that are just as true today as they were when he wrote them. They
  provide
  much food for thought as we approach issues this session.

  YOU CANNOT STRENGTHEN THE WEAK BY WEAKENING THE STRONG.
  YOU CANNOT HELP THE WAGE EARNER BY PULLING DOWN THE WAGE
  PAYER.

  YOU CANNOT FURTHER THE BROTHERHOOD OF MANY BY ENCOURAGING
  CLASS HATRED.

  YOU CANNOT ESTABLISH SOUND SECURITY ON BORROWED MONEY.

  One of the greatest strengths we have to build on as Iowans is our sense of
  "community".

  We have such a strong sense of "belonging", we are ready to be involved in
  developing and improving that community. What will it take?

  Capabilities - as leaders, we have the skills, knowledge and personal
  qualities for
  renewing and reinventing our future.

  Commitment - builds when everyone has opportunity to take an active part so
  experiences can be shared.

  Contribution - people want to contribute - especially if they think it's to
  something
  worthwhile and needed.

  Continuity - those who don't learn from their history are destined to repeat
  it...

  Collaboration - and Conscience.

  We have all those qualities available to us in this body and broadly among
  our
  citizens.

  Community requires the capacity for great conversations about things that
  matter.

  The final goal - let the great conversations begin and let them begin here.

  ELECTION OF PRESIDENT PRO TEMPORE
  Senator Iverson placed in nomination the name of Senator Don
  Redfern of Black Hawk County as a candidate for the office of
  President pro tempore for the Senate for the Seventy-seventh General
  Assembly.
  There being no further nominations, the Chair put the question to
  the Senate and Senator Redfern was unanimously elected by a voice
  vote.
  The Chair announced that Senator Redfern had been elected
  President pro tempore of the Seventy-seventh General Assembly.
  President Kramer requested that Senators McKean, Drake and
  Rehberg escort Senator Redfern to the rostrum.
  Senator Redfern appeared, took the oath of office, was
  congratulated and presented to the Senate by President Kramer.

  Following is a summary of remarks by Senator Redfern:
  Senator Redfern welcomed the new members to a citizen-legislature. He noted
  the
  historical significance of legislators who continue to live and work in
  their
  communities. He told the new members that balancing their community, family,
  and
  work with legislative responsibilities would be a challenge, but they would
  find it a
  most rewarding challenge.
  Senator Redfern discussed the challenges facing the concept of a
  citizen-legislature.
  He noted that in the 150 year history of our state, the executive branch of
  government
  has hired thousands of employees and has undertaken numerous programs. The
  number and complexity of the issues facing a citizen legislature today have
  increased
  significantly. If we are going to continue the concept of a citizen
  legislature, he
  concluded we are all going to have become better at working together in the
  common
  interest of the State.
  Senator Redfern said that he would work as hard as he could as President pro
  tempore to help the Senate meet these challenges.
  COMMITTEE TO NOTIFY THE GOVERNOR
  Senator Iverson moved that a committee of five be appointed to
  notify the governor that the Senate was organized and ready to
  receive any communication he might be ready to transmit.
  The motion prevailed by a voice vote and the Chair announced the
  appointment of Senators Bartz, Chair; Angelo, Boettger, Deluhery
  and Fraise.
  COMMITTEE TO NOTIFY THE HOUSE
  Senator Iverson moved that a committee of five be appointed to
  notify the House of Representatives that the Senate was organized
  and ready for business.
  The motion prevailed by a voice vote and the Chair announced the
  appointment of Senators Hedge, Chair; Borlaug, Zieman, McCoy and
  Black.
  ASSIGNMENT OF SEATS IN THE PRESS GALLERY

  Senator Iverson moved that the Secretary of the Senate be authorized to
  assign
  seats to the representatives of the news media and that appropriate badges
  be
  provided for their use.

  SELECTION OF SEATS

  The Chair announced the next order of business would be the selection of
  seats.

  Senator Iverson moved that the holdover and reelected Senators who
  participated in
  seat selection in 1996 be granted the privilege of selecting new seats in
  order of
  seniority from unassigned seats; that the reelected Senators first elected
  during the
  1996 session be granted the privilege of selecting their seats from the
  unassigned
  seats according to their seniority; that former members of the House of
  Representatives be granted the privilege of selecting their seats from the
  unassigned
  seats according to seniority; that newly elected Senators be granted the
  privilege of
  selecting their seats from the unassigned seats with the order of selection
  being
  established by lot; that first, the Majority Floor Leader and the Minority

  The President announced the following appointments made during
  the 1996 legislative interim:

  Economic Development Board, Code 15.103: Senator Borlaug will serve on the
  Board through the remainder of the 76th General Assembly. New terms will
  begin for
  the Senate appointees and new members may be appointed when the 77th General
  Assembly convenes.

  Commission on the Status of Women, Code 216A.52: Senator Szymoniak will
  serve
  on the commission through the remainder of the 76th general assembly. A new
  term
  will begin and an appointment made when the 77th General Assembly convenes.
  Senator Redfern's term will run through the completion of the 77th General
  Assembly.
