1 1 Section 1. Section 232.141, subsection 2, paragraph b,
1 2 Code 1997, is amended to read as follows:
1 3 b. Reasonable compensation for an attorney appointed by
1 4 the court to serve as counsel or guardian ad litem.
1 5 Reasonable compensation shall be determined in substantially
1 6 the same manner as provided by section 815.7.
1 7 EXPLANATION
1 8 This bill provides that reasonable compensation for an
1 9 attorney appointed to serve as counsel or guardian ad litem in
1 10 a juvenile court proceeding shall be determined in the same
1 11 manner as in Code section 815.7. Code section 815.7 provides
1 12 that reasonable compensation for an attorney appointed to
1 13 represent a person charged with a crime shall be calculated
1 14 based on ordinary and customary charges for like services in
1 15 the community but in no event shall the fee be calculated on
1 16 an hourly rate that exceeds the rate provided for a contract
1 17 attorney in Code section 13B.4. Code section 13B.4 allows the
1 18 state public defender to enter into contracts with attorneys
1 19 for the representation of indigent defendants.
