  1  4 RELATING TO THE REGISTRATION FEE FOR EX-PRISONER OF WAR MOTOR
  1  5    VEHICLE PLATES AND PROVIDING AN EFFECTIVE DATE AND A RETRO-
  1  6    ACTIVE APPLICABILITY DATE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 321.34, Code 1997, is amended by adding
  1 11 the following new subsection:
  1 12    NEW SUBSECTION.  8A.  EX-PRISONER OF WAR SPECIAL PLATES.
  1 13 The owner of a motor vehicle subject to registration under
  1 14 section 321.109, subsection 1, light delivery truck, panel
  1 15 delivery truck, or pickup who was a prisoner of war during the
  1 16 Second World War at any time between December 7, 1941, and
  1 17 December 31, 1946, the Korean Conflict at any time between
  1 18 June 25, 1950, and January 31, 1955, or the Vietnam Conflict
  1 19 at any time between August 5, 1964, and June 30, 1973, all
  1 20 dates inclusive, may, upon written application to the
  1 21 department, order only one set of special registration plates
  1 22 with an ex-prisoner of war processed emblem.  The emblem shall
  1 23 be designed by the department in cooperation with the adjutant
  1 24 general and shall signify that the owner was a prisoner of war
  1 25 as described in this subsection.  The application is subject
  1 26 to approval by the department, in consultation with the
  1 27 adjutant general.  The special plates shall be issued at no
  1 28 charge and are subject to an annual fee registration of
  1 29 fifteen dollars.  The county treasurer shall validate the
  1 30 special plates in the same manner as regular registration
  1 31 plates are validated under this section.
  1 32    The surviving spouse of a person who was issued special
  1 33 plates under this subsection may continue to use the special
  1 34 plates subject to registration of the special plates in the
  1 35 surviving spouse's name and upon payment of the annual
  2  1 registration fee.  If the surviving spouse remarries, the
  2  2 surviving spouse shall return the special plates to the
  2  3 department and the department shall issue regular registration
  2  4 plates to the surviving spouse.
  2  5    Sec. 2.  Section 321.34, subsection 15, Code 1997, is
  2  6 amended by striking the subsection.
  2  7    Sec. 3.  A person eligible to be issued ex-prisoner of war
  2  8 special plates who ordered and paid for the special plates on
  2  9 or after January 1, 1997, but prior to the effective date of
  2 10 this Act shall be entitled to a refund from the state
  2 11 department of transportation of all fees in excess of fifteen
  2 12 dollars paid for issuance of one set of the special plates.  A
  2 13 person eligible for a refund under this section shall submit a
  2 14 claim for a refund to the state department of transportation
  2 15 on a form for that purpose obtained from the county treasurer.
  2 16 Notwithstanding any provision of the Code to the contrary,
  2 17 refunds shall be paid by the department from registration fees
  2 18 deposited in the road use tax fund under section 321.145.
  2 19    A person who obtained more than one set of special plates
  2 20 under section 321.34, subsection 15, shall surrender the
  2 21 additional sets of special plates not later than the end of
  2 22 the registration year for which the plates were issued.  A
  2 23 refund shall not be issued for additional sets of special
  2 24 plates.
  2 25    Sec. 4.  EFFECTIVE AND APPLICABILITY DATE.  This Act, being
  2 26 deemed of immediate importance, takes effect upon enactment
  2 27 and is retroactively applicable to January 1, 1997.
