  3 14    The director of the department of education shall
  3 15 ensure that all school districts are aware of the
  3 16 state education resources available on the state
  3 17 website for listing teacher job openings and shall
  3 18 make every reasonable effort to enable qualified
  3 19 practitioners to post their resumes on the state
  3 20 website.  The department shall administer the posting
  3 21 of job vacancies for school districts, accredited
  3 22 nonpublic schools, and area education agencies on the
  3 23 state website.  The department may coordinate this
  3 24 activity with the Iowa school board association or
  3 25 other interested education associations in the state.
  3 26    2.  VOCATIONAL EDUCATION ADMINISTRATION
  3 27    For salaries, support, maintenance, miscellaneous
  3 28 purposes, and for not more than the following full-

  3 44    From the funds appropriated in this lettered
  3 45 paragraph, up to $2,000,000 shall be used to provide
  3 46 services to persons without regard to a waiting list.
  3 47 The division shall seek additional local matching
  3 48 funds in an amount sufficient to avoid any loss of
  3 49 federal funds.
  3 50    The division of vocational rehabilitation services
  4  1 shall seek a waiver from the federal government to
  4  2 accept assessments of clients performed by area
  4  3 education agencies or any other governmental
  4  4 subdivision.  The division shall also seek additional
  4  5 federal waivers to improve and increase the
  4  6 availability of supported employment services to
  4  7 Iowans.
  4  8    The division of vocational rehabilitation services
  4  9 shall seek funds other than federal funds, which may
  4 10 include but are not limited to local funds from local
  4 11 provider entities, community colleges, area education
  4 12 agencies, and local education agencies, for purposes
  4 13 of matching federal vocational rehabilitation funds.
  4 14 The funds collected by the division may exceed the
  4 15 amount needed to match available federal vocational
  4 16 rehabilitation funds in an effort to qualify for
  4 17 additional federal funds when such funds become
  4 18 available.
  4 19    Except where prohibited under federal law, the
  4 20 division of vocational rehabilitation services of the
  4 21 department of education shall accept client
  4 22 assessments, or assessments of potential clients,
  4 23 performed by other agencies in order to reduce
  4 24 duplication of effort.
  4 25    Notwithstanding the full-time equivalent position
  4 26 limit established in this lettered paragraph, for the
  4 27 fiscal year ending June 30, 2001, if federal funding
  4 28 is received to pay the costs of additional employees
  4 29 for the vocational rehabilitation services division
  4 30 who would have duties relating to vocational
  4 31 rehabilitation services paid for through federal
  4 32 funding, authorization to hire not more than 4.00
  4 33 additional full-time equivalent employees shall be
  4 34 provided, the full-time equivalent position limit
  4 35 shall be exceeded, and the additional employees shall
  4 36 be hired by the division.
  4 37    b.  For matching funds for programs to enable
  4 38 persons with severe physical or mental disabilities to
  4 39 function more independently, including salaries and
  4 40 support, and for not more than the following full-time
  4 41 equivalent position:

  4 44    The highest priority use for the moneys
  4 45 appropriated under this lettered paragraph shall be
  4 46 for programs that emphasize employment and assist
  4 47 persons with severe physical or mental disabilities to
  4 48 find and maintain employment to enable them to
  4 49 function more independently.
  4 50    5.  STATE LIBRARY
  5  1    a.  For salaries, support, maintenance,
  5  2 miscellaneous purposes, and for not more than the
  5  3 following full-time equivalent positions:

  5  6    Reimbursement of the institutions of higher
  5  7 learning under the state board of regents for
  5  8 participation in the access plus program during the
  5  9 fiscal year beginning July 1, 2000, and ending June
  5 10 30, 2001, shall not exceed the total amount of
  5 11 reimbursement paid to the regents institutions of
  5 12 higher learning for participation in the access plus
  5 13 program during the fiscal year beginning July 1, 1999,
  5 14 and ending June 30, 2000.
  5 15    b.  For the enrich Iowa program:  
  5 16 .................................................. $    1,000,000
  5 17    (1)  Funds allocated for purposes of the enrich
  5 18 Iowa program as provided in this lettered paragraph
  5 19 shall be distributed by the division of libraries and
  5 20 information services to eligible public libraries that
  5 21 are in compliance with performance measures adopted by
  5 22 rule by the commission of libraries.  The funds
  5 23 allocated as provided in this lettered paragraph shall
  5 24 not be used for the costs of administration by the
  5 25 division.  The amount distributed to each eligible
  5 26 public library shall be based upon the following:
  5 27    (a)  The level of compliance by the eligible public
  5 28 library with the performance measures adopted by the
  5 29 commission as provided in this subparagraph.
  5 30    (b)  The number of people residing within an
  5 31 eligible library's geographic service area for whom
  5 32 the library provides services.
  5 33    (c)  The amount of other funding the eligible
  5 34 public library received in the previous fiscal year
  5 35 for providing services to rural residents and to
  5 36 contracting communities.
  5 37    (2)  Moneys received by a public library under this
  5 38 lettered paragraph shall supplement, not supplant, any
  5 39 other funding received by the library.
  5 40    (3)  For purposes of this section, "eligible public
  5 41 library" means a public library that meets all of the
  5 42 following requirements:
  5 43    (a)  Submits to the division all of the following:
  5 44    (i)  The report provided for under section 256.51,
  5 45 subsection 1, paragraph "h".
  5 46    (ii)  An application and accreditation report, in a
  5 47 format approved by the commission, that provides
  5 48 evidence of the library's compliance with at least one
  5 49 level of the standards established in accordance with
  5 50 section 256.51, subsection 1, paragraph "k".
  6  1    (iii)  Any other application or report the division
  6  2 deems necessary for the implementation of the enrich
  6  3 Iowa program.
  6  4    (b)  Participates in the library resource and
  6  5 information sharing programs established by the state
  6  6 library.
  6  7    (c)  Is a public library established by city
  6  8 ordinance or a county library as provided in chapter
  6  9 336.
  6 10    (4)  Each eligible public library shall maintain a
  6 11 separate listing within its budget for payments
  6 12 received and expenditures made pursuant to this
  6 13 lettered paragraph, and shall annually submit this
  6 14 listing to the division.
  6 15    (5)  By January 15, 2001, the division shall submit
  6 16 a program evaluation report to the general assembly
  6 17 and the governor detailing the uses and the impacts of
  6 18 funds allocated under this lettered paragraph.  It is
  6 19 the intent of the general assembly to address the
  6 20 continuation of the enrich Iowa program during the
  6 21 2001 legislative session.
  6 22    (6)  A public library that receives funds in
  6 23 accordance with this lettered paragraph shall have an
  6 24 internet use policy in place, which may or may not
  6 25 include internet filtering.  The library shall submit
  6 26 a report describing the library's internet use efforts
  6 27 to the division.
  6 28    6.  REGIONAL LIBRARY
  6 29    For state aid:

  6 32    For salaries, support, maintenance, capital
  6 33 expenditures, miscellaneous purposes, and for not more

  6 37    8.  VOCATIONAL EDUCATION TO SECONDARY SCHOOLS
  6 38    For reimbursement for vocational education
  6 39 expenditures made by secondary schools:

  6 41    Funds appropriated in this subsection shall be used
  6 42 for expenditures made by school districts to meet the
  6 43 standards set in sections 256.11, 258.4, and 260C.14
  6 44 as a result of the enactment of 1989 Iowa Acts,
  6 45 chapter 278.  Funds shall be used as reimbursement for
  6 46 vocational education expenditures made by secondary
  6 47 schools in the manner provided by the department of
  6 48 education for implementation of the standards set in
  6 49 1989 Iowa Acts, chapter 278.
  6 50    9.  SCHOOL FOOD SERVICE
  7  1    For use as state matching funds for federal
  7  2 programs that shall be disbursed according to federal
  7  3 regulations, including salaries, support, maintenance,
  7  4 miscellaneous purposes, and for not more than the
  7  5 following full-time equivalent positions:  
  7  6 .................................................. $  2,716,119

  7  8    10.  IOWA EMPOWERMENT FUND
  7  9    For deposit in the school ready children grants
  7 10 account of the Iowa empowerment fund created in
  7 11 section 28.9:  
  7 12 .................................................. $ 15,600,000
  7 13    a.  From the moneys deposited in the school ready
  7 14 children grants account for the fiscal year beginning
  7 15 July 1, 2000, and ending June 30, 2001, not more than
  7 16 $200,000 is allocated for the community empowerment
  7 17 office and other technical assistance activities.  It
  7 18 is the intent of the general assembly that regional
  7 19 technical assistance teams will be established and
  7 20 will include staff from various agencies, as
  7 21 appropriate, including the area education agencies,
  7 22 community colleges, and the Iowa state university of
  7 23 science and technology cooperative extension service
  7 24 in agriculture and home economics.  The state
  7 25 empowerment board shall direct staff to work with the
  7 26 advisory council to inventory technical assistance
  7 27 needs.  Funds allocated under this lettered paragraph
  7 28 may be used by the state empowerment board for the
  7 29 purpose of skills development and support for ongoing
  7 30 training of the regional technical assistance teams.
  7 31 However, funds shall not be used for additional staff
  7 32 or for the reimbursement of staff.
  7 33    As a condition of receiving funding appropriated in
  7 34 this subsection, each local empowerment board shall
  7 35 report to the state empowerment board progress on each
  7 36 of the state indicators approved by the state board,
  7 37 as well as progress on local indicators.
  7 38    School ready children grants account funds shall be
  7 39 distributed through a grant application process.
  7 40 Grant awards shall be contingent upon the availability
  7 41 of funds.  The deadline for applications for school
  7 42 ready children grants in the fiscal year beginning
  7 43 July 1, 2000, shall be August 31, 2000, with grant
  7 44 awards to be made on or about October 2, 2000.
  7 45    b.  For the fiscal year beginning July 1, 2000, in
  7 46 awarding grants and establishing grant amounts for all
  7 47 designated community empowerment areas that have never
  7 48 been awarded a school ready children grant, the Iowa
  7 49 empowerment board shall give consideration to the
  7 50 future implementation of a funding formula for
  8  1 distribution of the grant moneys, anticipation of the
  8  2 state moving over a period of years to full funding of
  8  3 the grant program, and the reasonable expectations of
  8  4 community empowerment areas for a process of equitable
  8  5 distribution of funds.
  8  6    c.  The provisions of paragraph "b" are not
  8  7 applicable to those designated community empowerment
  8  8 areas that were awarded a school ready children grant
  8  9 prior to the fiscal year beginning July 1, 2000, and
  8 10 those areas shall be held harmless from the provisions
  8 11 implemented by the Iowa empowerment board pursuant to
  8 12 paragraph "b".
  8 13    11.  TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS
  8 14    To provide funds for costs of providing textbooks
  8 15 to each resident pupil who attends a nonpublic school
  8 16 as authorized by section 301.1.  The funding is
  8 17 limited to $20 per pupil and shall not exceed the
  8 18 comparable services offered to resident public school
  8 19 pupils:  
  8 20 .................................................. $    650,000
  8 21    12.  VOCATIONAL AGRICULTURE YOUTH ORGANIZATION
  8 22    To assist a vocational agriculture youth
  8 23 organization sponsored by the schools to support the
  8 24 foundation established by that vocational agriculture
  8 25 youth organization and for other youth activities:  
  8 26 .................................................. $     94,400
  8 27    13.  NATIONAL BOARD CERTIFICATION
  8 28    For the issuance of national board certification
  8 29 awards in accordance with section 256.44:

  8 31    Notwithstanding section 8.33, funds appropriated
  8 32 for purposes of this subsection which remain
  8 33 unencumbered or unobligated at the close of the fiscal
  8 34 year, shall not revert but shall be available for
  8 35 expenditure for purposes of issuing national board
  8 36 certification awards during the succeeding fiscal
  8 37 year.
  8 38    14.  BEGINNING TEACHER INDUCTION PROGRAM
  8 39    For purposes of the beginning teacher induction
  8 40 program as provided in section 256E.2:  
  8 41 .................................................. $    775,000
  8 42    Notwithstanding section 8.33, moneys appropriated
  8 43 in this subsection that remain unencumbered or
  8 44 unobligated at the close of the fiscal year shall not
  8 45 revert but shall remain available for expenditure for
  8 46 the purposes designated until the close of the
  8 47 succeeding fiscal year.
  8 48    15.  FAMILY RESOURCE CENTER DEMONSTRATION PROGRAM
  8 49    For support of the family resource center
  8 50 demonstration program established under chapter 256C:  
  9  1 .................................................. $     90,000
  9  2    16.  EDUCATION INNOVATION PROJECT GRANTS
  9  3    To support innovative research-based K-12 education
  9  4 projects:  
  9  5 .................................................. $    425,000
  9  6    a.  From the funds appropriated in this subsection,
  9  7 the sum of $225,000 shall be used by the department of
  9  8 education for a study of methods to improve teacher
  9  9 compensation and to award education innovation project
  9 10 grants.  Eligible projects shall demonstrate research-
  9 11 based innovative methods to improve the quality of
  9 12 teaching or promote attraction and retention of
  9 13 teachers in the teaching profession, identify
  9 14 measurable performance indicators and annually report
  9 15 results, and demonstrate how the project can be self-
  9 16 supporting within a three-year to five-year period.
  9 17 Notwithstanding section 8.33, unencumbered or
  9 18 unobligated funds remaining on June 30 of the fiscal
  9 19 year from funds allocated in this paragraph shall not
  9 20 revert but shall be available for expenditure for the
  9 21 following fiscal year for the purposes of this
  9 22 paragraph.
  9 23    b.  The department shall establish pilot regional
  9 24 academies in cooperation with school districts, area
  9 25 education agencies, and postsecondary institutions.
  9 26 From the funds appropriated in this subsection, not
  9 27 more than $200,000 shall be used to plan and implement
  9 28 pilot regional academies to provide high school
  9 29 students with advanced level courses and technical
  9 30 courses not currently available within the curriculum
  9 31 in their district of attendance.
  9 32    c.  The department shall submit a report on the
  9 33 status of the projects receiving grants under this
  9 34 subsection to the senate and house standing committees
  9 35 on education and the joint appropriations subcommittee
  9 36 on education by December 1, 2000.
  9 37    17.  LOCAL ARTS COMPREHENSIVE EDUCATIONAL
  9 38 STRATEGIES PROGRAM (LACES)
  9 39    For contracting with the Iowa alliance for arts
  9 40 education to execute their local arts comprehensive
  9 41 educational strategies:  
  9 42 .................................................. $     25,000
  9 43    18.  CONNECTING EDUCATION AND WORKFORCE DEVELOPMENT
  9 44    For purposes of providing support to statewide
  9 45 school-to-work implementation through professional
  9 46 development opportunities, employability skill
  9 47 revalidation, partnership capacity building,
  9 48 connecting to the department of workforce
  9 49 development's making connections system
  9 50 implementation, and the integration of academic and
 10  1 vocational education, and for not more than the
 10  2 following full-time equivalent positions:

 10  5    19. EMPLOYABILITY SKILLS ASSESSMENTS REIMBURSEMENTS
 10  6    For reimbursement of school district claims for the
 10  7 costs of acquiring and using employability skills
 10  8 assessment tools as provided in this subsection:  
 10  9 .................................................. $    200,000
 10 10    a.  The department of education shall reimburse
 10 11 school district claims for the costs of acquiring,
 10 12 administering, and scoring assessment tools to assess
 10 13 the employability skills of students.  The director of
 10 14 education shall identify available employability
 10 15 skills assessment tools that school districts may use
 10 16 to meet the claim reimbursement requirements of this
 10 17 subsection.
 10 18    b.  In order to be eligible for reimbursement under
 10 19 this subsection, a school district shall submit a
 10 20 claim on forms provided by the department by July 15,
 10 21 2001, and the claim shall state the actual costs
 10 22 incurred and shall be accompanied by an affidavit of
 10 23 an officer of the school district affirming the
 10 24 accuracy of the claim.
 10 25    c.  A school district that submits to the
 10 26 department a claim for reimbursement in accordance
 10 27 with this subsection shall develop and integrate
 10 28 specific employability skills goals and activities
 10 29 into the comprehensive school improvement plan
 10 30 required under section 256.7, subsection 21, paragraph
 10 31 "a".
 10 32    d.  The department of education shall certify to
 10 33 the department of revenue and finance the amounts of
 10 34 approved claims to be paid, and the department of
 10 35 revenue and finance shall draw warrants payable to
 10 36 school districts with approved claims, taking into
 10 37 consideration the relative budget and cash position of
 10 38 the state resources.
 10 39    e.  Moneys received under this subsection shall not
 10 40 be commingled with state aid payments made under
 10 41 section 257.16 to a school district and shall be
 10 42 accounted for by the school district separately from
 10 43 state aid payments.  Payments made to a school
 10 44 district under this subsection are miscellaneous
 10 45 income for purposes of chapter 257.
 10 46    f.  If the funds appropriated in this subsection
 10 47 are insufficient to pay in full the claims submitted
 10 48 by school districts and approved by the department,
 10 49 the amounts of approved claims shall be prorated among
 10 50 all school districts with approved claims.
 11  1    20.  JOBS FOR AMERICA'S GRADUATES
 11  2    For school districts to provide direct services to
 11  3 the most at-risk senior high school students enrolled
 11  4 in school districts through direct intervention by a
 11  5 "jobs for America's graduates" specialist:

 11 39    Sec. 4.  DISTRIBUTION OF FUNDS APPROPRIATED.  For
 11 40 the fiscal year beginning July 1, 2000, and ending
 11 41 June 30, 2001, moneys appropriated by the general
 11 42 assembly from the general fund of the state to the
 11 43 department of education for community colleges for a
 11 44 fiscal year shall be allocated to each community
 11 45 college by the department of education in the
 11 46 following manner:
 11 47    1.  BASE FUNDING.  The base funding for a fiscal
 11 48 year shall be equal to the amount each community
 11 49 college received as an allocation from appropriations
 11 50 made from the general fund of the state in the most
 12  1 recent fiscal year.
 12  2    2.  DISTRIBUTION FOR INFLATION.  First priority
 12  3 shall be to give each college an increase based upon
 12  4 inflation.  The inflation increase shall be not less
 12  5 than 2 percent.  However, the inflation increase shall
 12  6 be equal to the national inflation rate, if it exceeds
 12  7 2 percent, if the amount of state aid appropriated is
 12  8 equal to or greater than the national inflation rate.
 12  9    3.  DISTRIBUTION BASED ON PROPORTIONAL SHARE OF
 12 10 ENROLLMENT.  The balance of the growth in state aid
 12 11 appropriations, once the inflation increase has been
 12 12 satisfied, shall be distributed based on each
 12 13 college's proportional share of enrollment.  However,
 12 14 a minimum of one percent of the total growth shall be
 12 15 distributed in this manner.
 12 16    4.  If the total appropriation made by the general
 12 17 assembly is less than 2 percent growth, the entire
 12 18 increase shall be distributed as inflation.
 12 19    Sec. 5.  PROVIDING LIMITED PHASE III MONEYS
 12 20 DISTRIBUTION AUTHORITY TO THE DIRECTOR.
 12 21 Notwithstanding the appropriations in section 294A.25,
 12 22 subsections 6, 9, and 14 for the fiscal year beginning
 12 23 July 1, 2000, the director of the department of
 12 24 education is authorized to determine the amount of
 12 25 phase III moneys which shall be distributed for the
 12 26 purposes described in section 294A.25, subsections 6,
 12 27 9, and 14 for the fiscal year beginning July 1, 2000.
 12 28    Sec. 6.  AREA EDUCATION AGENCY REORGANIZATION
 12 29 STUDY.  The department of education shall complete a
 12 30 study and make recommendations for the alignment of
 12 31 area education boundaries in the event of voluntary
 12 32 area education agency merger or restructuring to best
 12 33 ensure the equitable, effective, and efficient
 12 34 delivery of core area education agency services to
 12 35 students and schools.  The study shall be conducted in
 12 36 conjunction with representative administrators and
 12 37 board members from area education agencies, and in
 12 38 consultation with other K-12 representatives as
 12 39 determined by the department.  The study shall
 12 40 consider population projections of the merged areas,
 12 41 enrollment projections, number of school districts and
 12 42 schools served, financial resources, efficient and
 12 43 effective delivery of core services as required under
 12 44 area education agency accreditation under chapter 273,
 12 45 existing and possible regional collaborations, and
 12 46 possible reorganization incentives.  The department
 12 47 shall forward recommendations and any possible
 12 48 reorganization plans to the area education agency
 12 49 boards no later than July 1, 2001.  The department
 12 50 shall forward any recommendations for statutory
 13  1 changes that may be required to accomplish area
 13  2 education agency reorganization to the senate and
 13  3 house standing committees on education and the joint
 13  4 appropriations subcommittee on education not later
 13  5 than December 15, 2000.
 13  6    Sec. 7.  BOARD OF EDUCATIONAL EXAMINERS LICENSING
 13  7 FEES.  Notwithstanding section 272.10, up to 85
 13  8 percent of any funds received annually resulting from
 13  9 an increase in fees approved and implemented for
 13 10 licensing by the state board of educational examiners
 13 11 after July 1, 1997, shall be available for the fiscal
 13 12 year beginning July 1, 2000, to the state board for
 13 13 purposes related to the state board's duties,
 13 14 including, but not limited to, additional full-time
 13 15 equivalent positions.  The director of revenue and
 13 16 finance shall draw warrants upon the treasurer of
 13 17 state from the funds appropriated as provided in this
 13 18 section and shall make the funds resulting from the
 13 19 increase in fees available during the fiscal year to
 13 20 the state board on a monthly basis.
 13 21    Sec. 8.  PROFESSIONAL DEVELOPMENT STUDY.  The board
 13 22 of educational examiners shall conduct a study of the
 13 23 use of school days for the professional development of
 13 24 teachers by school districts and area education
 13 25 agencies.  Each school district and area education
 13 26 agency shall submit to the board by August 1, 2000, in
 13 27 the manner required by the board, data relating to the
 13 28 use of school days for the professional development of
 13 29 teachers.  The board shall develop and recommend
 13 30 alternatives to reduce the number of school days used
 13 31 for the professional development of teachers.  The
 13 32 board shall submit its recommendations by December 1,
 13 33 2000, in a report to the senate and house standing
 13 34 committees on education and the joint appropriations
 13 35 subcommittee on education.
 13 36    Sec. 9.  LOCAL PUBLIC LIBRARIES SUPPORT SERVICES
 13 37 STUDY.  The commission of libraries shall coordinate a
 13 38 study of the state library structure.  The commission,
 13 39 the area education agencies, and the regional
 13 40 libraries jointly shall compile a list of the support
 13 41 functions currently provided to local libraries by the
 13 42 regional system, including but not limited to the
 13 43 continuation of consultation and educational programs
 13 44 for library staff and trustees concerning all facets
 13 45 of library management and operation and intraregional
 13 46 interlibrary loan and information services, and shall
 13 47 develop a plan to provide those support functions and
 13 48 services more effectively and efficiently.  The plan
 13 49 shall be submitted by December 1, 2000, to the senate
 13 50 and house standing committees on education, the joint
 14  1 appropriations subcommittee on education, and the
 14  2 legislative fiscal bureau.
 14  3    Sec. 10.  1999 Iowa Acts, chapter 205, section 7,
 14  4 subsections 13 and 15, are amended to read as follows:
 14  5    13.  NATIONAL BOARD CERTIFICATION

 14  7 awards in accordance with section 256.44, if 1999 Iowa

 15 47    The university of Iowa hospitals and clinics shall,

 16  2 frequency of visits to the hospital required by
 16  3 indigent patients.  The university of Iowa hospitals

 16  6 15, 2001, describing its use of these technologies to
 16  7 accomplish this purpose.
 16  8    The university of Iowa hospitals and clinics shall
 16  9 submit quarterly a report regarding the portion of the
 16 10 appropriation in this lettered paragraph expended on
 16 11 medical education.  The report shall be submitted in a
 16 12 format jointly developed by the university of Iowa
 16 13 hospitals and clinics, the legislative fiscal bureau,
 16 14 and the department of management, and shall delineate
 16 15 the expenditures and purposes of the funds.
 16 16    Funds appropriated in this lettered paragraph shall
 16 17 not be used to perform abortions except medically
 16 18 necessary abortions, and shall not be used to operate
 16 19 the early termination of pregnancy clinic except for
 16 20 the performance of medically necessary abortions.  For
 16 21 the purpose of this lettered paragraph, an abortion is
 16 22 the purposeful interruption of pregnancy with the
 16 23 intention other than to produce a live-born infant or
 16 24 to remove a dead fetus, and a medically necessary
 16 25 abortion is one performed under one of the following

 16 28 continuing the pregnancy would endanger the life of

 16 38 reported within 150 days of the incident to a law
 16 39 enforcement agency or public or private health agency
 16 40 which may include a family physician.
 16 41    (5)  The abortion is a spontaneous abortion,
 16 42 commonly known as a miscarriage, wherein not all of
 16 43 the products of conception are expelled.
 16 44    The total quota allocated to the counties for
 16 45 indigent patients for the fiscal year beginning July
 16 46 1, 2000, shall not be lower than the total quota
 16 47 allocated to the counties for the fiscal year

 21 24 reimburse qualifying hospitals pursuant to that
 21 25 adjustment with a supplemental amount for services
 21 26 provided medical assistance recipients.  The
 21 27 adjustment shall generate supplemental payments
 21 28 intended to equal the state appropriation made to a
 21 29 qualifying hospital for treatment of indigent patients
 21 30 as provided in chapter 255.  To the extent of the
 21 31 supplemental payments, a qualifying hospital shall,
 21 32 after receipt of the funds, transfer to the department
 21 33 of human services an amount equal to the actual
 21 34 supplemental payments that were made in that month.
 21 35 The aggregate amounts for the fiscal year shall not
 21 36 exceed the state appropriation made to the qualifying
 21 37 hospital for treatment of indigent patients as
 21 38 provided in chapter 255.  The department of human
 21 39 services shall deposit these funds in the department's
 21 40 medical assistance account.  To the extent that state
 21 41 funds appropriated to a qualifying hospital for the
 21 42 treatment of indigent patients as provided in chapter
 21 43 255 have been transferred to the department of human
 21 44 services as a result of these supplemental payments
 21 45 made to the qualifying hospital, the department shall
 21 46 not, directly or indirectly, recoup the supplemental
 21 47 payments made to a qualifying hospital for any reason,
 21 48 unless an equivalent amount of the funds transferred
 21 49 to the department of human services by a qualifying
 21 50 hospital pursuant to this provision is transferred to
 22  1 the qualifying hospital by the department.
 22  2    If the state supplemental amount allotted to the
 22  3 state of Iowa for the federal fiscal year beginning
 22  4 October 1, 2000, and ending September 30, 2001,
 22  5 pursuant to section 1923(f)(3) of the federal Social
 22  6 Security Act, as amended, or pursuant to federal
 22  7 payments for indirect medical education is greater
 22  8 than the amount necessary to fund the federal share of
 22  9 the supplemental payments specified in the preceding
 22 10 paragraph, the department of human services shall
 22 11 increase the supplemental disproportionate share or
 22 12 supplemental indirect medical education adjustment by
 22 13 the lesser of the amount necessary to utilize fully
 22 14 the state supplemental amount or the amount of state
 22 15 funds appropriated to the state university of Iowa
 22 16 general education fund and allocated to the university
 22 17 for the college of medicine.  The state university of
 22 18 Iowa shall transfer from the allocation for the
 22 19 college of medicine to the department of human
 22 20 services, on a monthly basis, an amount equal to the
 22 21 additional supplemental payments made during the
 22 22 previous month pursuant to this paragraph.  A
 22 23 qualifying hospital receiving supplemental payments
 22 24 pursuant to this paragraph that are greater than the
 22 25 state appropriation made to the qualifying hospital
 22 26 for treatment of indigent patients as provided in
 22 27 chapter 255 shall be obligated as a condition of its
 22 28 participation in the medical assistance program to
 22 29 transfer to the state university of Iowa general
 22 30 education fund on a monthly basis an amount equal to
 22 31 the funds transferred by the state university of Iowa
 22 32 to the department of human services.  To the extent
 22 33 that state funds appropriated to the state university
 22 34 of Iowa and allocated to the college of medicine have
 22 35 been transferred to the department of human services
 22 36 as a result of these supplemental payments made to the
 22 37 qualifying hospital, the department shall not,
 22 38 directly or indirectly, recoup these supplemental
 22 39 payments made to a qualifying hospital for any reason,
 22 40 unless an equivalent amount of the funds transferred
 22 41 to the department of human services by the state
 22 42 university of Iowa pursuant to this paragraph is
 22 43 transferred to the qualifying hospital by the
 22 44 department.
 22 45    Continuation of the supplemental disproportionate
 22 46 share and supplemental indirect medical education
 22 47 adjustment shall preserve the funds available to the
 22 48 university hospital for medical and surgical treatment
 22 49 of indigent patients as provided in chapter 255 and to
 22 50 the state university of Iowa for educational purposes
 23  1 at the same level as provided by the state funds
 23  2 initially appropriated for that purpose.
 23  3    The department of human services shall, in any
 23  4 compilation of data or other report distributed to the
 23  5 public concerning payments to providers under the
 23  6 medical assistance program, set forth reimbursements
 23  7 to a qualifying hospital through the supplemental
 23  8 disproportionate share and supplemental indirect
 23  9 medical education adjustment as a separate item and
 23 10 shall not include such payments in the amounts
 23 11 otherwise reported as the reimbursement to a
 23 12 qualifying hospital for services to medical assistance
 23 13 recipients.
 23 14    For purposes of this section, "supplemental
 23 15 payment" means a supplemental payment amount paid for
 23 16 medical assistance to a hospital qualifying for that
 23 17 payment under this section.
 23 18    Sec. 13.  2000 Iowa Acts, House File 2039, section
 23 19 24, is amended to read as follows:
 23 20    SEC. 24.  MEDICAL ASSISTANCE CLAIMING BY STATE
 23 21 BOARD OF REGENTS.  The state shall enter into a
 23 22 contract to enhance claiming of medical assistance
 23 23 program reimbursement payable for services provided by
 23 24 the state university of Iowa hospitals and clinics.
 23 25 After payment of contract costs, the first $4,000,000
 23 26 $12,000,000 received in additional reimbursement from
 23 27 the enhanced claiming during the period beginning with
 23 28 the effective date of this Act, and ending June 30,
 23 29 2001, shall be credited to the general fund of the
 23 30 state.  The balance of the additional reimbursement
 23 31 received during the period is appropriated to the
 23 32 state board of regents for the state university of
 23 33 Iowa hospitals and clinics for other expenses
 23 34 associated with the enhanced claiming and for the
 23 35 provision of services.  The state board of regents
 23 36 shall report quarterly during the period delineated in
 23 37 this section to the department of management and the
 23 38 legislative fiscal bureau concerning the enhanced
 23 39 claiming and reimbursement that is received and
 23 40 anticipated.
 23 41    For purposes of this section, "enhanced claiming"
 23 42 does not include any process already being utilized by
 23 43 the state university of Iowa hospitals and clinics to
 23 44 identify and seek reimbursement from appropriate
 23 45 payors.  Individual patient accounts shall not be
 23 46 eligible for participation in enhanced claiming
 23 47 activities until the state university of Iowa
 23 48 hospitals and clinics certifies that its internal
 23 49 processes to identify and seek reimbursement from
 23 50 appropriate payors have been completed.  Should
 24  1 additional reimbursement from the enhanced claiming
 24  2 fail to equal the targeted amount to be credited to
 24  3 the general fund, the state university of Iowa
 24  4 hospitals and clinics shall not be held responsible
 24  5 for making up the shortfall.
 24  6    Sec. 14.  STATE UNIVERSITY OF IOWA – DEPARTMENT OF
 24  7 HUMAN SERVICES.  The department of human services
 24  8 shall transfer to the state university of Iowa for the
 24  9 purposes of the creative employment options program
 24 10 the same amount of moneys in the fiscal year beginning
 24 11 July 1, 2000, and ending June 30, 2001, as was
 24 12 transferred in the fiscal year beginning July 1, 1997,
 24 13 and ending June 30, 1998.
 24 14    Sec. 15.  For the fiscal year beginning July 1,
 24 15 2000, and ending June 30, 2001, the state board of
 24 16 regents may use notes, bonds, or other evidences of
 24 17 indebtedness issued under section 262.48 to finance
 24 18 projects that will result in energy cost savings in an
 24 19 amount that will cause the state board to recover the
 24 20 cost of the projects within an average of six years.
 24 21    Sec. 16.  Notwithstanding section 270.7, the
 24 22 department of revenue and finance shall pay the state
 24 23 school for the deaf and the Iowa braille and sight
 24 24 saving school the moneys collected from the counties
 24 25 during the fiscal year beginning July 1, 2000, for
 24 26 expenses relating to prescription drug costs for
 24 27 students attending the state school for the deaf and
 24 28 the Iowa braille and sight saving school.
 24 29    Sec. 17.  Section 28.3, subsection 2, Code
 24 30 Supplement 1999, is amended to read as follows:
 24 31    2.  The Iowa board shall consist of fifteen
 24 32 seventeen voting members with twelve thirteen citizen
 24 33 members and three four state agency members.  The
 24 34 three four state agency members shall be the directors
 24 35 of the following departments:  education, human
 24 36 rights, human services, and public health.  The twelve
 24 37 thirteen citizen members shall be appointed by the
 24 38 governor, subject to confirmation by the senate.  The
 24 39 governor's appointments of citizen members shall be
 24 40 made in a manner so that each of the state's
 24 41 congressional districts is represented by two citizen
 24 42 members and so that all the appointments as a whole
 24 43 reflect the ethnic, cultural, social, and economic
 24 44 diversity of the state.  The governor's appointees
 24 45 shall be selected from individuals nominated by
 24 46 community empowerment area boards.  The nominations
 24 47 shall reflect the range of interests represented on
 24 48 the community boards so that the governor is able to
 24 49 appoint one or more members each for education,
 24 50 health, human services, business, faith, and public
 25  1 interests.  At least one of the citizen members shall
 25  2 be a service consumer or the parent of a service
 25  3 consumer.  Terms of office of all citizen members are
 25  4 three years.  A vacancy on the board shall be filled
 25  5 in the same manner as the original appointment for the
 25  6 balance of the unexpired term.
 25  7    Sec. 18.  Section 135.11, subsection 18, Code
 25  8 Supplement 1999, is amended to read as follows:
 25  9    18.  Consult with the office of statewide clinical
 25 10 education programs at the university of Iowa college
 25 11 of medicine and annually submit a report to the
 25 12 general assembly by January 15 verifying the number of
 25 13 physicians in active practice in Iowa by county who
 25 14 are engaged in providing obstetrical care.  To the
 25 15 extent data are readily available, the report shall
 25 16 include information concerning the number of
 25 17 deliveries per year by specialty and county, the age
 25 18 of physicians performing deliveries, and the number of
 25 19 current year graduates of the university of Iowa
 25 20 college of medicine and the Des Moines university of
 25 21  osteopathic medicine and health sciences medical
 25 22 center entering into residency programs in obstetrics,
 25 23 gynecology, and family practice.  The report may
 25 24 include additional data relating to access to
 25 25 obstetrical services that may be available.
 25 26    Sec. 19.  NEW SECTION.  135.26  OBSTETRICAL
 25 27 BRACHIAL PLEXUS PALSY CONSULTATION.
 25 28    The university of Iowa hospitals and clinics shall
 25 29 develop and maintain a comprehensive database of
 25 30 information regarding obstetrical brachial plexus
 25 31 palsy treatment options and success rates.  In every
 25 32 case where a diagnosis of obstetrical brachial plexus
 25 33 palsy is made, the parents or legal guardians of an
 25 34 infant so diagnosed shall be given the opportunity to
 25 35 consult with an obstetrical brachial plexus palsy
 25 36 specialist regarding treatment options and reported
 25 37 success rates currently documented in medical
 25 38 literature for obstetrical brachial plexus palsy. The
 25 39 objective of the consultation shall be to place a
 25 40 parent or legal guardian in the position of
 25 41 subsequently making an educated and informed decision
 25 42 regarding the pursuit of obstetrical brachial plexus
 25 43 palsy treatment.
 25 44    Sec. 20.  Section 135.107, subsection 3, paragraph
 25 45 d, subparagraph (1), Code 1999, is amended to read as
 25 46 follows:
 25 47    (1)  The Iowa department of public health, in
 25 48 cooperation with a primary care collaborative effort
 25 49 including the university of Iowa college of medicine,
 25 50 the Des Moines university of  osteopathic medicine
 26  1 and health sciences medical center, and other primary
 26  2 care professional educational institutions in Iowa,
 26  3 shall develop and establish area health education
 26  4 centers.  The effort shall involve making application
 26  5 for a federal grant under 42 U.S.C. } 293j, as
 26  6 prescribed by that section.
 26  7    Sec. 21.  Section 135.107, subsection 4, Code 1999,
 26  8 is amended to read as follows:
 26  9    4.  The director of public health shall establish a
 26 10 primary care collaborative work group to coordinate
 26 11 all statewide recruitment and retention activities
 26 12 established pursuant to this section and to make
 26 13 recommendations to the department and the center for
 26 14 rural health and primary care relating to the
 26 15 implementation of subsection 3.  Membership of the
 26 16 work group shall consist, at a minimum, of
 26 17 representatives from the university of Iowa college of
 26 18 medicine, Des Moines university of  osteopathic
 26 19 medicine and health sciences medical center,
 26 20 university of Iowa physician assistant school,
 26 21 university of Iowa nurse practitioner school, Des
 26 22 Moines university of  osteopathic medicine and
 26 23 health sciences medical center physician assistant
 26 24 program, Iowa-Nebraska primary care association, Iowa
 26 25 medical society, Iowa osteopathic medical association,
 26 26 Iowa chapter of American college of osteopathic family
 26 27 physicians, Iowa academy of family physicians, nurse
 26 28 practitioner association, Iowa nurses association,
 26 29 association of Iowa hospitals and health systems, and
 26 30 Iowa physicians assistants association.
 26 31    Sec. 22.  Section 235C.3, subsection 2, paragraph
 26 32 b, Code Supplement 1999, is amended to read as
 26 33 follows:
 26 34    b.  A health professional training campaign,
 26 35 including recommendations concerning the curriculum
 26 36 offered at the college of medicine at the state
 26 37 university of Iowa and the Des Moines university of 
 26 38 osteopathic medicine and health sciences medical
 26 39 center, providing assistance in the identification of
 26 40 women at risk of substance abuse during pregnancy and
 26 41 strategies to be employed in assisting those women to
 26 42 maintain healthy lifestyles during pregnancy.  This
 26 43 education campaign shall offer information to health
 26 44 professionals on assessment, laboratory testing, and
 26 45 referrals.
 26 46    Sec. 23.  Section 256.42, subsection 4, Code 1999,
 26 47 is amended by striking the subsection.
 26 48    Sec. 24.  Section 256B.15, subsection 7, paragraph
 26 49 a, Code 1999, is amended to read as follows:
 26 50    a.  The treasurer of the state shall credit
 27  1 receipts received under this section to the department
 27  2 of human services to pay contractual fees incurred by
 27  3 the department to maximize federal funding for special
 27  4 education services.  All remaining receipts in excess
 27  5 of the amount necessary to pay contractual fees shall
 27  6 be credited to the general fund of the state
 27  7 department of human services medical assistance
 27  8 account.
 27  9    Sec. 25.  Section 256C.2, unnumbered paragraph 2,
 27 10 Code 1999, is amended to read as follows:
 27 11    A district applying for a grant under this section
 27 12 shall agree, for each dollar of grant funds, to
 27 13 provide twenty cents in matching cash or in-kind
 27 14 resources.  Grants may be awarded for four years,
 27 15 beginning July 1, 1994, and ending June 30, 1998.  Up
 27 16 to ten percent of the moneys appropriated for the
 27 17 grant program may be used by the council for staffing,
 27 18 technical assistance, and external evaluation
 27 19 development.  Notwithstanding section 8.33,
 27 20 unencumbered or unobligated funds remaining on June 30
 27 21 of the fiscal year for which the funds were
 27 22 appropriated shall not revert but shall be available
 27 23 for expenditure for the following fiscal year for the
 27 24 purposes of this section.
 27 25    Sec. 26.  Section 261.12, subsection 1, paragraph
 27 26 b, Code Supplement 1999, is amended to read as
 27 27 follows:
 27 28    b.  For the fiscal year beginning July 1, 1999
 27 29 2000, and for each following fiscal year, three four
 27 30 thousand nine hundred dollars.
 27 31    Sec. 27.  Section 261.19, subsections 1 through 4,
 27 32 Code 1999, are amended to read as follows:
 27 33    1.  A physician recruitment program is established,
 27 34 to be administered by the college student aid
 27 35 commission, for the Des Moines university of 
 27 36 osteopathic medicine and health sciences of Des
 27 37 Moines, Iowa medical center.  The program shall
 27 38 consist of a forgivable loan program and a tuition
 27 39 scholarship program for students and a loan repayment
 27 40 program for physicians.  The commission shall
 27 41 regularly adjust the physician service requirement
 27 42 under each aspect of the program to provide, to the
 27 43 extent possible, an equal financial benefit for each
 27 44 period of service required.  From funds appropriated
 27 45 for purposes of the program by the general assembly,
 27 46 the commission shall pay a fee to the Des Moines
 27 47 university of  osteopathic medicine and health
 27 48 sciences medical center for the administration of the
 27 49 program.  A portion of the fee shall be paid by the
 27 50 commission to the university based upon the number of
 28  1 physicians recruited under subsection 4.
 28  2    2.  A forgivable loan may be awarded to a resident
 28  3 of Iowa who is enrolled at the Des Moines university
 28  4 of  osteopathic medicine and health sciences medical
 28  5 center if the student agrees to practice in this state
 28  6 for a period of time to be determined by the
 28  7 commission at the time the loan is awarded.
 28  8 Forgivable loans to eligible students shall not become
 28  9 due and interest on the loan shall not accrue until
 28 10 after the student completes a residency program.  If
 28 11 the student completes the period of practice
 28 12 established by the commission and agreed to by the
 28 13 student, the loan amount shall be forgiven.  The loan
 28 14 amount shall not be forgiven if the osteopathic
 28 15 physician fails to complete the required time period
 28 16 of practice in this state or fails to satisfactorily
 28 17 continue in the university's program of medical
 28 18 education.
 28 19    3.  A student enrolled at the Des Moines university
 28 20 of  osteopathic medicine and health sciences medical
 28 21 center shall be eligible for a tuition scholarship for
 28 22 the student's study at the university.  The
 28 23 scholarship shall be for an amount not to exceed the
 28 24 annual tuition at the university.  A student who
 28 25 receives a tuition scholarship shall not be eligible
 28 26 for the loan repayment program provided for by this
 28 27 section.  A student who receives a tuition scholarship
 28 28 shall agree to practice in an eligible rural community
 28 29 in this state for a period of time to be determined by
 28 30 the commission at the time the scholarship is awarded.
 28 31 The student shall repay the scholarship to the
 28 32 commission if the student fails to practice in a
 28 33 medically underserved rural community in this state
 28 34 for the required period of time.
 28 35    4.  A physician shall be eligible for the physician
 28 36 loan repayment program if the physician agrees to
 28 37 practice in an eligible rural community in this state.
 28 38 The Des Moines university of  osteopathic medicine
 28 39 and health sciences medical center shall recruit and
 28 40 place physicians in rural communities which have
 28 41 agreed to provide additional funds for the physician's
 28 42 loan repayment.  The contract for the loan repayment
 28 43 shall stipulate the time period the physician shall
 28 44 practice in an eligible rural community in this state.
 28 45 In addition, the contract shall stipulate that the
 28 46 physician repay any funds paid on the physician's loan
 28 47 by the commission if the physician fails to practice
 28 48 in an eligible rural community in this state for the
 28 49 required period of time.  For purposes of this
 28 50 subsection, "eligible rural community" means a
 29  1 medically underserved rural community which agrees to
 29  2 match state funds provided on at least a dollar-for-
 29  3 dollar basis for the loan repayment of a physician who
 29  4 practices in the community.
 29  5    Sec. 28.  Section 261.25, subsection 1, Code
 29  6 Supplement 1999, is amended to read as follows:
 29  7    1.  There is appropriated from the general fund of
 29  8 the state to the commission for each fiscal year the
 29  9 sum of forty-seven forty-eight million six eight
 29 10 hundred sixty-four thirty thousand seven hundred fifty
 29 11 seventy-five dollars for tuition grants.
 29 12    Sec. 29.  Section 261.85, unnumbered paragraph 1,
 29 13 Code 1999, is amended to read as follows:
 29 14    There is appropriated from the general fund of the
 29 15 state to the commission for each fiscal year the sum
 29 16 of two million nine seven hundred fifty thousand
 29 17 dollars for the work-study program.
 29 18    Sec. 30.  NEW SECTION.  262.76  ASSIGNMENT OF
 29 19 STUDENT TEACHERS – ACCREDITED NONPUBLIC SCHOOLS.
 29 20    The state board of regents shall adopt rules
 29 21 authorizing approved practitioner preparation program
 29 22 faculty to assign a student enrolled in the program to
 29 23 an accredited nonpublic school for student teaching
 29 24 experience if the coursework and the curriculum the
 29 25 student is assigned to teach are nonsectarian,
 29 26 nonreligious, and would reasonably be expected to be
 29 27 taught in any public school district in the state.
 29 28    Sec. 31.  Section 266.39C, subsection 3, unnumbered
 29 29 paragraph 1, Code 1999, is amended to read as follows:
 29 30    Iowa state university of science and technology
 29 31 shall employ a director for the center, who shall be
 29 32 appointed by the president of Iowa state university of
 29 33 science and technology.  The director of the center
 29 34 shall employ necessary research and support staff.
 29 35 The director and staff shall be employees of Iowa
 29 36 state university of science and technology.  No more
 29 37 than five seven hundred thousand dollars of the funds
 29 38 made available by appropriation from state revenues in
 29 39 any one year shall be expended by the center for the
 29 40 salaries and benefits of the employees of the center,
 29 41 including the salary and benefits of the director.
 29 42 The remainder of the funds appropriated from state
 29 43 funds shall be used to sponsor research grants and
 29 44 projects submitted on a competitive basis by Iowa
 29 45 colleges and universities and private nonprofit
 29 46 agencies and foundations.  The center may also solicit
 29 47 additional grants and funding from public and private
 29 48 nonprofit agencies and foundations.
 29 49    Sec. 32.  Section 272.12, Code 1999, as amended by
 29 50 2000 Iowa Acts, House File 2146, section 5, if
 30  1 enacted, is amended to read as follows:
 30  2    272.12  PARA-EDUCATOR CERTIFICATES.
 30  3    The board of educational examiners shall adopt
 30  4 rules pursuant to chapter 17A relating to a voluntary
 30  5 certification system for para-educators.  The rules
 30  6 shall specify rights, responsibilities, levels, and
 30  7 qualifications for the certificate.  Applicants shall
 30  8 be disqualified for any reason specified in section
 30  9 272.6 or in administrative rule.  Notwithstanding
 30 10 section 272.6, subsection 1, paragraph "a", the board
 30 11 may issue a para-educator certificate to a person who
 30 12 is at least eighteen years of age.  A person holding a
 30 13 para-educator certificate shall not perform the duties
 30 14 of a licensed practitioner.  A certificate issued
 30 15 pursuant to this chapter shall not be considered a
 30 16 teacher or administrator license for any purpose
 30 17 specified by law, including the purposes specified
 30 18 under this chapter or chapter 279.
 30 19    Sec. 33.  Section 283A.2, subsection 2, paragraph
 30 20 b, unnumbered paragraph 1, and paragraph c, as enacted
 30 21 by 1999 Iowa Acts, chapter 147, section 1, are amended
 30 22 to read as follows:
 30 23    The board of directors of a school district that
 30 24 wishes to provide safe, reasonable student access to a
 30 25 school breakfast program, rather than operate or
 30 26 provide for the operation of a school breakfast
 30 27 program at a specific attendance center within the
 30 28 school district shall develop an alternative site plan
 30 29 to operate the school breakfast program at another
 30 30 attendance center or other site within the school
 30 31 district and shall annually certify to the department
 30 32 that the plan meets the following criteria:
 30 33    c.  The board of directors of a school district
 30 34 that wishes to provide access to a school breakfast
 30 35 program in accordance with paragraph "b", shall notify
 30 36 the parent, guardian, or legal or actual custodian of
 30 37 a child enrolled in the school district of the school
 30 38 district's intention to develop and implement a plan
 30 39 to provide school breakfast programs only in certain
 30 40 attendance centers at an alternative site.  At any
 30 41 time in which the school district proposes to make
 30 42 substantive changes to a plan certified with the
 30 43 department of education, the notification requirements
 30 44 of this paragraph shall apply.
 30 45    Sec. 34.  Section 294A.25, subsections 6, 10, and
 30 46 14, Code Supplement 1999, are amended to read as
 30 47 follows:
 30 48    6.  For the fiscal year beginning July 1, 1999
 30 49 2000, and ending June 30, 2000 2001, from phase III
 30 50 moneys the amount of fifty thousand dollars to the
 31  1 department of education for the geography alliance.
 31  2    10.  For the fiscal year beginning July 1, 1998
 31  3 2000, and for each succeeding fiscal year, the amount
 31  4 of one hundred seventy thousand dollars to the state
 31  5 board of regents for equal distribution in the amount
 31  6 of sixty-eight thousand dollars to the Iowa braille
 31  7 and sight saving school and in the amount of one
 31  8 hundred two thousand dollars to the Iowa state school
 31  9 for the deaf from phase III moneys.
 31 10    14.  For the fiscal year beginning July 1, 1999
 31 11 2000, and ending June 30, 2000 2001, to the department
 31 12 of education from phase III moneys the amount of fifty
 31 13 thousand dollars for the Iowa mathematics and science
 31 14 coalition.
 31 15    Sec. 35.  Section 294A.25, subsection 7, Code
 31 16 Supplement 1999, is amended by striking the
 31 17 subsection.
 31 18    Sec. 36.  RETROACTIVE APPLICABILITY.  Section
 31 19 256C.2, unnumbered paragraph 2, as amended in this
 31 20 Act, is retroactively applicable to July 1, 1999.  Any
 31 21 moneys retained by the child development coordinating
 31 22 council for the fiscal year beginning July 1, 1999,
 31 23 for staffing, technical assistance, and external
 31 24 evaluation development shall be awarded in
 31 25 demonstration program grants as provided in chapter
 31 26 256C.
 31 27    Sec. 37.  EFFECTIVE DATE.  Section 10 of this Act,
 31 28 relating to 1999 Iowa Acts, chapter 205; section 25,
 31 29 amending section 256C.2; and section 36, relating to
 31 30 retroactive applicability, being deemed of immediate
 31 31 importance, take effect upon enactment."
