Proposed Ways & Means Committee Rules:
1. House Rules and Mason's Manual of Legislative Procedure apply in any instances not covered by these committee rules.
2. A majority of the members of the committee constitutes a quorum.
3. An affirmative vote of the majority of members of the committee is needed to report a bill out to the floor for debate or to suspend a committee rule.
4. The committee chairperson is to have prepared and the ranking member shall distribute an agenda of each meeting at least one legislative day prior to any meeting date. However, with the consent of the House, the chairperson may call a meeting without providing the required notice and agenda.
5. All notices and minutes will be distributed electronically.
6. Prior to being considered by the committee, the chairperson is to refer all bills to a subcommittee unless the bills are acted upon by a committee of the whole. After action by a committee of the whole is completed, a motion is made to arise from the committee of the whole and the bill manager then moves the bill to be considered by the full committee.
7. The chairperson may assign bills to a subcommittee without a meeting of the full committee but the membership of the subcommittee must be reported at the next committee meeting. Final action on a bill will not be taken until the meeting following the subcommittee announcement.
8. All study bills and substantive amendments must be reviewed and typed in proper form by the Legislative Services Agency prior to consideration by the full committee.
9. Voting by secret ballot is prohibited; a record roll call vote is required for final action on a bill.
10. An unexcused member in the committee room when a question to report a bill out of committee is put must vote aye or nay. However, the member may pass on the first taking of the roll call but when the member's name is called for a second time, the member must vote aye or nay.
11. The committee chairperson may call a public hearing to receive comments on any matter within the purview of the committee and shall call a public hearing upon written request of at least five members of the committee.
The committee chairperson will designate a time and place for a public hearing and provide public notice at least five days prior to the designated date. A public hearing will not be held on a bill already reported from committee; nor is a bill to be reported to the House on the same day a public hearing is held on the bill.
A meeting at which any member of the House or Senate, representatives of a state agency, lobbyist, or other person presents information to the committee at the request of the chairperson is not considered to be a public hearing.
12. The committee chairperson is the official spokesperson for the committee.
13. A person possessing a cellular telephone or other audible device during a committee meeting must make certain the telephone or device is not audible to any other person attending the committee meeting.
