PAG LIN 1 1 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 1 2 Section 1. GENERAL APPROPRIATION. There is appropriated 1 3 from the general fund of the state to the department of 1 4 agriculture and land stewardship for the fiscal year beginning 1 5 July 1, 1996, and ending June 30, 1997, the following amounts, 1 6 or so much thereof as is necessary, to be used for the 1 7 purposes designated: 1 8 1. ADMINISTRATIVE DIVISION 1 9 a. For salaries, support, maintenance, the support of the 1 10 state 4-H foundation, support of the statistics bureau, and 1 11 miscellaneous purposes, and for the salaries and support of 1 12 not more than the following full-time equivalent positions: 1 13 .................................................. $ 1,836,111 1 14 ............................................... FTEs 43.45 1 15 (1) Of the amount appropriated and full-time equivalent 1 16 positions authorized in this paragraph "a", $322,406 and 7.00 1 17 FTEs shall be used to support horticulture. 1 18 (2) Of the amount appropriated in this paragraph "a", 1 19 $50,000 shall be allocated to the state 4-H foundation to 1 20 foster the development of Iowa's youth and to encourage them 1 21 to study the subject of agriculture. 1 22 (3) Of the amount appropriated and full-time equivalent 1 23 positions authorized in this paragraph "a", $130,519 and 4.00 1 24 FTEs shall be allocated to the statistics bureau to provide 1 25 county-by-county information on land in farms, production by 1 26 crop, acres by crop, and county prices by crop. This 1 27 information shall be made available to the department of 1 28 revenue and finance for use in the productivity formula for 1 29 valuing and equalizing the values of agricultural land. 1 30 (4) Of the amount appropriated in this paragraph "a", not 1 31 more than $5,000 shall be allocated to the Iowa limousin 1 32 cattle junior association in connection with the 1996 national 1 33 junior limousin cattle show. 1 34 (5) Of the amount appropriated in this paragraph "a", $500 1 35 shall be allocated as state aid to support the north Iowa 2 1 poultry expo. 2 2 (6) Of the amount appropriated and full-time equivalent 2 3 positions authorized in this paragraph "a", $71,486 and 1.00 2 4 FTE shall be allocated to support the administrative assistant 2 5 VI position created in section 26 of this Act. 2 6 b. FTEs 85.10 2 32 (1) Of the amount appropriated in this paragraph "a", 2 33 $110,000 shall be used to administer a program relating to the 2 34 detection, surveillance, and eradication of the gypsy moth. 2 35 The department shall allocate and use the appropriation made 3 1 in this paragraph before moneys other than those appropriated 3 2 in this paragraph are used to support the program. 3 3 (2) Of the amount appropriated and the number of full-time 3 4 equivalent positions authorized in this paragraph "a", $49,850 3 5 and 1.00 FTE shall be used to support an additional regional 3 6 entomologist for purposes of conducting laboratory and field 3 7 inspection activities. 3 8 (3) Of the number of full-time equivalent positions 3 9 authorized in this paragraph "a" and funded in paragraph "c", 3 10 1.00 FTE shall be used to support an organics program 3 11 coordinator who shall assure compliance of organic foods sold 3 12 commercially within the state with federal regulations 3 13 relating to organic foods. 3 14 b. For the operations of the commercial feed programs: 3 15 .................................................. $ 742,499 3 16 c. For the operations of the pesticide programs: 3 17 .................................................. $ 1,291,781 3 18 Of the amount appropriated in this paragraph "c", $200,000 3 19 shall be allocated to Iowa state university for purposes of 3 20 training commercial pesticide applicators. 3 21 d. For the operations of the fertilizer programs: 3 22 .................................................. $ 633,832 3 23 4. SOIL CONSERVATION DIVISION 3 24 a. For salaries, support, maintenance, assistance to soil 3 25 conservation districts, miscellaneous purposes, and for not 3 26 more than the following full-time equivalent positions: 3 27 .................................................. $ 5,951,591 3 28 ............................................... FTEs 172.28 3 29 (1) Of the amount appropriated in this paragraph "a", 3 30 $330,000 shall be used to reimburse commissioners of soil and 3 31 water conservation districts for administrative expenses. 3 32 Moneys used for the payment of meeting dues by counties shall 3 33 be matched on a dollar-for-dollar basis by the soil 3 34 conservation division. 3 35 (2) Of the amount appropriated and the number of full-time 4 1 equivalent positions authorized in this paragraph "a", $56,000 4 2 and 1.00 FTE shall be used to support a position for oversight 4 3 of financial incentive programs. 4 4 b. To provide financial incentives for soil conservation 4 5 practices under chapter 161A: 4 6 .................................................. $ 6,461,850 4 7 c. The following requirements apply to the moneys 4 8 appropriated in paragraph "b": 4 9 (1) Not more than 5 percent of the moneys appropriated in 4 10 paragraph "b" may be allocated for cost sharing to abate 4 11 complaints filed under section 161A.47. 4 12 (2) Of the moneys appropriated in paragraph "b", 5 percent 4 13 shall be allocated for financial incentives to establish 4 14 practices to protect watersheds above publicly owned lakes of 4 15 the state from soil erosion and sediment as provided in 4 16 section 161A.73. 4 17 (3) Not more than 30 percent of a district's allocation of 4 18 moneys as financial incentives may be provided for the purpose 4 19 of establishing management practices to control soil erosion 4 20 on land that is row cropped, including but not limited to no- 4 21 till planting, ridge-till planting, contouring, and contour 4 22 strip-cropping as provided in section 161A.73. 4 23 (4) The state soil conservation committee created in 4 24 section 161A.4 may allocate moneys to conduct research and 4 25 demonstration projects to promote conservation tillage and 4 26 nonpoint source pollution control practices. 4 27 (5) The financial incentive payments may be used in 4 28 combination with department of natural resources moneys. 4 29 d. The provisions of section 8.33 shall not apply to the 4 30 moneys appropriated in paragraph "b". Unencumbered or 4 31 unobligated moneys remaining on June 30, 2000, from moneys 4 32 appropriated in paragraph "b" for the fiscal year beginning 4 33 July 1, 1996, shall revert to the general fund on August 31, 4 34 2000. 4 35 Sec. 2. FARMERS' MARKET COUPON PROGRAM. There is 5 1 appropriated from the general fund of the state to the 5 2 department of agriculture and land stewardship for the fiscal 5 3 year beginning July 1, 1996, and ending June 30, 1997, the 5 4 following amount, or so much thereof as is necessary, to be 5 5 used for the purposes designated: 5 6 For salaries, support, maintenance, and miscellaneous 5 7 purposes, to be used by the department to continue and expand 5 8 the farmers' market coupon program by providing federal 5 9 special supplemental food program recipients with coupons 5 10 redeemable at farmers' markets, and for not more than the 5 11 following full-time equivalent positions: 5 12 .................................................. $ 215,807 5 13 ............................................... FTEs 1.00 5 14 Sec. 3. PSEUDORABIES ERADICATION PROGRAM. 5 15 1. There is appropriated from the general fund of the 5 16 state to the department of agriculture and land stewardship 5 17 for the fiscal year beginning July 1, 1996, and ending June 5 18 30, 1997, the following amount, or so much thereof as is 5 19 necessary, to be used for the purpose designated: 5 20 For support of the pseudorabies eradication program: 5 21 .................................................. $ 900,300 5 22 2. Persons, including organizations interested in swine 5 23 production in this state and in the promotion of Iowa pork 5 24 products who contribute support to the program, are encouraged 5 25 to increase financial support for purposes of ensuring the 5 26 program's effective continuation. 5 27 Sec. 4. HORSE AND DOG RACING. There is appropriated from 5 28 the moneys available under section 99D.13 to the regulatory 5 29 division of the department of agriculture and land stewardship 5 30 for the fiscal year beginning July 1, 1996, and ending June 5 31 30, 1997, the following amount, or so much thereof as is 5 32 necessary, to be used for the purpose designated: 5 33 For salaries, support, maintenance, and miscellaneous 5 34 purposes for the administration of section 99D.22: 5 35 .................................................. $ 192,560 6 1 DEPARTMENT OF NATURAL RESOURCES 6 2 Sec. 5. GENERAL APPROPRIATION. There is appropriated from 6 3 the general fund of the state to the department of natural 6 4 resources for the fiscal year beginning July 1, 1996, and 6 5 ending June 30, 1997, the following amounts, or so much 6 6 thereof as is necessary, to be used for the purposes 6 7 designated: 6 8 1. FTEs 214.50 7 10 (2) Of the amount appropriated and the number of full-time 7 11 equivalent positions authorized in subparagraph (1) at least 7 12 $374,600 and 9.00 FTEs shall be used to support the regulation 7 13 of animal feeding operations. 7 14 (3) Of the number of full-time equivalent positions 7 15 authorized in subparagraph (1), 1.00 FTE shall be used to 7 16 support the administration of the waste tire management fund, 7 17 as provided in section 455D.11C, as enacted in 1996 Iowa Acts, 7 18 House File 2433. 7 19 b. WATER QUALITY PROTECTION FUND 7 20 For allocation to the administrative account of the water 7 21 quality protection fund established pursuant to section 7 22 455B.183A, to carry out the purpose of that account: 7 23 .................................................. $ 729,000 7 24 (1) Of the number of full-time equivalent positions 7 25 authorized in paragraph "a", 32.50 FTEs shall be dedicated to 7 26 carrying out the provisions of chapter 455B relating to the 7 27 administration, regulation, and enforcement of the federal 7 28 Safe Drinking Water Act and to support the program to assist 7 29 water supply systems as provided in section 455B.183B. 7 30 However, the limitation on full-time equivalent positions 7 31 provided in paragraph "a", shall not limit the number of 7 32 additional full-time equivalent positions supported by moneys 7 33 deposited in the water quality protection fund as provided in 7 34 section 455B.183A, in order to carry out the provisions of 7 35 division III of chapter 455B relating to the administration, 8 1 regulation, and enforcement of the federal Safe Drinking Water 8 2 Act, and the administration of the program to assist water 8 3 supply systems pursuant to section 455B.183B. 8 4 (2) In providing assistance to water supply systems, the 8 5 department shall provide priority to water supply systems 8 6 serving a population of seven thousand or less. At least 2.00 8 7 FTEs shall be allocated to provide assistance to systems 8 8 serving a population of seven thousand or less. 8 9 6. FISH AND WILDLIFE DIVISION 8 10 For not more than the following full-time equivalent 8 11 positions: 8 12 ............................................... FTEs 342.18 8 13 7. STATE FISH AND GAME PROTECTION FUND – 8 18 APPROPRIATION TO THE DIVISION OF FISH AND WILDLIFE. 8 19 1. There is appropriated from the state fish and game 8 20 protection fund to the division of fish and wildlife of the 8 21 department of natural resources for the fiscal year beginning 8 22 July 1, 1996, and ending June 30, 1997, the following amount, 8 23 or so much thereof as is necessary, to be used for the 8 24 purposes designated: 8 25 For administrative support, and for salaries, support, 8 26 maintenance, equipment, and miscellaneous purposes: 8 27 .................................................. $ 21,340,891 8 28 2. The department shall not expend more moneys from the 8 29 fish and game protection fund than provided in this section, 8 30 unless the expenditure derives from contributions made by a 8 31 private entity, or a grant or moneys received from the federal 8 32 government, and is approved by the natural resource 8 33 commission. The department of natural resources shall 8 34 promptly notify the legislative fiscal bureau and the 8 35 chairpersons and ranking members of the joint appropriations 9 1 subcommittee on agriculture and natural resources concerning 9 2 the commission's approval. 9 3 Sec. 7. MARINE FUEL TAX RECEIPTS – BOATING FACILITIES AND 9 4 ACCESS. There is appropriated from the marine fuel tax 9 5 receipts deposited in the general fund of the state to the 9 6 department of natural resources for the fiscal year beginning 9 7 July 1, 1996, and ending June 30, 1997, the following amount, 9 8 or so much thereof as is necessary, to be used for the purpose 9 9 designated: 9 10 For maintaining and developing boating facilities and 9 11 access to public waters by the parks and preserves division: 9 12 .................................................. $ 411,311 9 13 Sec. 8. SNOWMOBILE FEES – TRANSFER FOR ENFORCEMENT 9 14 PURPOSES. There is transferred on July 1, 1996, from the fees 9 15 deposited under section 321G.7 to the fish and game protection 9 16 fund and appropriated to the department of natural resources 9 17 for the fiscal year beginning July 1, 1996, and ending June 9 18 30, 1997, the following amount, or so much thereof as is 9 19 necessary, to be used for the purpose designated: 9 20 For enforcing snowmobile laws as part of the state 9 21 snowmobile program administered by the department of natural 9 22 resources: 9 23 .................................................. $ 100,000 9 24 Sec. 9. VESSEL FEES – TRANSFER FOR ENFORCEMENT PURPOSES. 9 25 There is transferred on July 1, 1996, from the fees deposited 9 26 under section 462A.52 to the fish and game protection fund and 9 27 appropriated to the department of natural resources for the 9 28 fiscal year beginning July 1, 1996, and ending June 30, 1997, 9 29 the following amount, or so much thereof as is necessary, to 9 30 be used for the purpose designated: 9 31 For the administration and enforcement of navigation laws 9 32 and water safety: 9 33 .................................................. $ 1,300,000 9 34 Of the amount appropriated in this section and the full- 9 35 time equivalent positions authorized by section 5, subsection 10 1 6, of this Act, not more than $100,000 and 1.00 FTE may be 10 2 used for purposes of controlling and eradicating eurasian 10 3 milfoil. 10 4 Notwithstanding section 8.33, moneys transferred pursuant 10 5 to this section which are unencumbered or unobligated on June 10 6 30, 1997, shall be transferred on July 1, 1997, to the special 10 7 conservation fund established by section 462A.52 to be used as 10 8 provided in that section, and shall not revert as provided in 10 9 section 8.33. 10 10 RESOURCES ENHANCEMENT AND PROTECTION 10 11 Sec. 10. GENERAL APPROPRIATION. Notwithstanding the 10 12 amount of the standing appropriation from the general fund of 10 13 the state under section 455A.18, subsection 3, there is 10 14 appropriated from the general fund of the state to the Iowa 10 15 resources enhancement and protection fund, in lieu of the 10 16 appropriation made in section 455A.18, for the fiscal year 10 17 beginning July 1, 1996, and ending June 30, 1997, the sum of 10 18 $9,000,000, of which all moneys shall be allocated as provided 10 19 in section 455A.19. 10 20 RELATED APPROPRIATIONS 10 21 Sec. 11. APPROPRIATION AND TRANSFER FROM ORGANIC NUTRIENT 10 22 MANAGEMENT FUND. There is appropriated and transferred from 10 23 the organic nutrient management fund, as created in section 10 24 161C.5, to the following entities in the fiscal year beginning 10 25 July 1, 1996, and ending June 30, 1997, the following amounts, 10 26 or so much thereof as is necessary, to be used for the 10 27 purposes designated: 10 28 1. To Iowa state university for supporting odor control 10 29 applications of animal feeding operations, including 10 30 confinement feeding operations, regulated by the department of 10 31 natural resources pursuant to chapter 455B: 10 32 .................................................. $ 400,000 10 33 a. Moneys provided under this subsection for odor control 10 34 applications of animal feeding operations shall be provided on 10 35 a dollar-for-dollar match with an individual owner or operator 11 1 and shall not exceed the amount actually spent by or on behalf 11 2 of the owner or operator for odor control. 11 3 b. Notwithstanding section 8.33, moneys provided under 11 4 this subsection for odor control applications of animal 11 5 feeding operations shall not revert to the organic nutrient 11 6 management fund but shall remain available for use as provided 11 7 in this subsection during the fiscal year beginning July 1, 11 8 1997, and ending June 30, 1998. The moneys provided in this 11 9 subsection which remain unexpended or unobligated on June 30, 11 10 1998, shall revert to the organic nutrient management fund on 11 11 August 31, 1998. 11 12 2. To Iowa state university for supporting a person 11 13 connected with the United States department of agriculture who 11 14 engages in animal control, for purposes of contributing to the 11 15 control of animals, and especially predators, which pose a 11 16 threat to this state's agriculture: 11 17 .................................................. $ 50,000 11 18 3. To the soil conservation division of the department of 11 19 agriculture and land stewardship for supporting soil and water 11 20 conservation district development, including the training of 11 21 soil and water conservation district staff: 11 22 .................................................. $ 42,000 11 23 4. To the interstate agricultural grain marketing 11 24 commission for carrying out duties of the commission as 11 25 provided in Article IV of the interstate compact on 11 26 agricultural grain marketing as provided in chapter 183: 11 27 .................................................. $ 80,000 11 28 5. a. To Iowa state university for supporting multiflora 11 29 rose eradication research and projects: 11 30 .................................................. $ 25,000 11 31 b. Notwithstanding 1995 Iowa Acts, chapter 216, section 11 32 19, subsection 2, moneys allocated pursuant to 1995 Iowa Acts, 11 33 chapter 216, section 19, subsection 1, paragraph "d", which 11 34 remain unencumbered or unobligated on June 30, 1996, shall not 11 35 revert pursuant to section 8.33, but shall remain available to 12 1 Iowa state university for purposes of supporting multiflora 12 2 rose eradication research and projects, for subsequent fiscal 12 3 years. 12 4 6. To the soil conservation division of the department of 12 5 agriculture and land stewardship to provide financial 12 6 incentives for soil conservation practices under chapter 161A: 12 7 .................................................. $ 100,000 12 8 7. To Iowa state university, in cooperation with the farm 12 9 section of the attorney general's office, in sponsoring an 12 10 Iowa agriculture 2000 conference, with assistance provided by 12 11 the department of agriculture and land stewardship and Iowa 12 12 commodity organizations, for independent agricultural 12 13 producers and other persons interested in the future of Iowa 12 14 agriculture: 12 15 .................................................. $ 80,000 12 16 Moneys provided by this subsection shall be used to defray 12 17 expenses incurred by Iowa state university and the farm 12 18 section of the attorney general's office in planning and 12 19 sponsoring the conference. Iowa state university shall 12 20 prepare a report which accounts for moneys expended by the 12 21 university in sponsoring the conference. The report shall be 12 22 submitted to the chairpersons and ranking members of the joint 12 23 appropriations subcommittee on agriculture and natural 12 24 resources on or before January 15, 1997. 12 25 Sec. 12. NONREVERSION OF MONEYS ALLOCATED TO IOWA GRAIN 12 26 QUALITY INITIATIVE. Notwithstanding 1995 Iowa Acts, chapter 12 27 216, section 19, subsection 2, moneys allocated pursuant to 12 28 1995 Iowa Acts, chapter 216, section 19, subsection 1, 12 29 paragraph "f", subparagraph (1), which remain unencumbered or 12 30 unobligated on June 30, 1996, shall not revert pursuant to 12 31 section 8.33, but shall remain available to Iowa state 12 32 university for purposes of supporting the Iowa cooperative 12 33 extension service in agriculture and home economics in 12 34 establishing and administering an Iowa grain quality 12 35 initiative in subsequent fiscal years. 13 1 Sec. 13. TRANSFERS OF MONEYS REQUIRED TO BE DEPOSITED IN 13 2 THE WATER PROTECTION FUND. Notwithstanding section 161C.4 and 13 3 the reversion and allocation provisions in section 455A.19, 13 4 subsection 1, paragraph "c", of the unencumbered and 13 5 unobligated moneys remaining, which are required to be 13 6 deposited in the water protection fund created in section 13 7 161C.4, as provided in section 455A.19, subsection 1, 13 8 paragraph "c", the following amount shall be transferred first 13 9 from moneys required to be deposited in the water protection 13 10 practices account, and if necessary from moneys required to be 13 11 deposited in the water quality protection projects account, 13 12 which shall be used for the following purposes: 13 13 To the Loess Hills development and conservation authority, 13 14 for deposit in the Loess Hills development and conservation 13 15 fund created in section 161D.2 for the purposes specified in 13 16 section 161D.1: 13 17 .................................................. $ 400,000 13 18 Sec. 14. REVENUE ADMINISTERED BY THE IOWA COMPREHENSIVE 13 19 UNDERGROUND STORAGE TANK FUND BOARD – TRANSFER. There is 13 20 appropriated from the unassigned revenue fund administered by 13 21 the Iowa comprehensive underground storage tank fund board, to 13 22 the department of natural resources for the fiscal year 13 23 beginning July 1, 1996, and ending June 30, 1997, the 13 24 following amount, or so much thereof as is necessary, to be 13 25 used for the purpose designated: 13 26 For administration expenses of the underground storage tank 13 27 section of the department of natural resources: 13 28 .................................................. $ 75,000 13 29 Sec. 15. TRANSFER – AIR QUALITY. For the fiscal year 13 30 beginning July 1, 1996, and ending June 30, 1997, the 13 31 department of natural resources shall transfer up to $430,000 13 32 from the hazardous substance remedial fund created pursuant to 13 33 section 455B.423, to support purposes related to carrying out 13 34 the duties of the commission under section 455B.133, or the 13 35 director under section 455B.134, or for carrying out the 14 1 provisions of chapter 455B, division II. 14 2 MISCELLANEOUS 14 3 Sec. 16. STUDY OF LOCATING FIELD OFFICE IN NORTH CENTRAL 14 4 DISTRICT. The department of natural resources shall conduct a 14 5 study of the feasibility of locating a field office in the 14 6 department's north central district. On or before January 1, 14 7 1997, the department of natural resources shall submit a 14 8 report including findings and recommendations resulting from 14 9 the study to the committees of the general assembly which have 14 10 jurisdiction over natural resources. 14 11 Sec. 17. STATE NURSERIES. Notwithstanding section 17A.2, 14 12 subsection 10, paragraph "g", the department of natural 14 13 resources shall adopt administrative rules establishing a 14 14 range of prices of plant material grown at the state forest 14 15 nurseries to cover all expenses related to the growing of the 14 16 plants. 14 17 1. The department shall develop programs to encourage the 14 18 wise management and preservation of existing woodlands and 14 19 shall continue its efforts to encourage forestation and 14 20 reforestation on private and public lands in the state. 14 21 2. The department shall encourage a cooperative 14 22 relationship between the state forest nurseries and private 14 23 nurseries in the state in order to achieve these goals. 14 24 Sec. 18. TRANSFER OF MONEYS OR POSITIONS; CHANGES IN 14 25 TABLES OF ORGANIZATION – NOTIFICATION. In addition to the 14 26 requirements of section 8.39, in each fiscal quarter, the 14 27 department of agriculture and land stewardship and the 14 28 department of natural resources shall notify the chairpersons, 14 29 vice chairpersons, and ranking members of the joint 14 30 appropriations subcommittee on agriculture and natural 14 31 resources for the previous fiscal quarter of any transfer of 14 32 moneys or full-time equivalent positions made by either 14 33 department which is not authorized in this Act, or any 14 34 permanent position added to or deleted from either 14 35 department's table of organization. 15 1 Sec. 19. AIR QUALITY PROGRAM – NONGENERAL FUND SUPPORT. 15 2 The department of natural resources for the fiscal year 15 3 beginning July 1, 1996, and ending June 30, 1997, shall not 15 4 use moneys appropriated from the general fund of the state 15 5 pursuant to this Act, to support any purpose related to 15 6 carrying out the duties of the commission under section 15 7 455B.133 or the director under section 455B.134, or for 15 8 carrying out the provisions of chapter 455B, division II. 15 9 Notwithstanding section 455B.133B, the department may use 15 10 moneys deposited in the air contaminant source fund created in 15 11 section 455B.133B during the fiscal year beginning July 1, 15 12 1996, and ending June 30, 1997, for any purpose related to 15 13 carrying out the duties of the commission under section 15 14 455B.133 or the director under section 455B.134, or for 15 15 carrying out the provisions of chapter 455B, division II. 15 16 Sec. 20. NATIVE AMERICAN WAR MEMORIAL. The department of 15 17 natural resources may purchase, with funds which become 15 18 available under chapter 465A for the fiscal year beginning 15 19 July 1, 1996, and ending June 30, 1997, lands on which to 15 20 locate a native American war memorial. 15 21 Sec. 21. SOIL AND WATER CONSERVATION CONFERENCE. 15 22 1. The division of soil conservation of the department of 15 23 agriculture and land stewardship shall sponsor a conference 15 24 not later than September 1, 1996, regarding the protection of 15 25 cropland soils in this state. The conference shall include 15 26 discussions of the status of soil and water conservation as it 15 27 relates to conservation compliance accomplishments, 15 28 agricultural production policies, water quality protection, 15 29 and the state's Iowa soil 2000 goal. 15 30 2. Conferees shall include representatives of the division 15 31 of soil conservation, the state soil conservation committee, 15 32 soil and water conservation districts, the natural resources 15 33 conservation service of the United States department of 15 34 agriculture, the cooperative extension service of Iowa state 15 35 university, and the department of natural resources. The 16 1 division of soil conservation shall invite other interested 16 2 persons to serve as conferees, including members of Iowa's 16 3 congressional delegation; the chairpersons and ranking members 16 4 of the standing committees on agriculture, and on natural 16 5 resources, environment, and energy of the senate; the 16 6 chairpersons and ranking members of the standing committees on 16 7 agriculture, on natural resources, and on environmental 16 8 protection of the house of representatives; the chairpersons 16 9 and ranking members of the joint appropriations subcommittee 16 10 on agriculture and natural resources; representatives of the 16 11 United States environmental protection agency; and members of 16 12 farm and commodity organizations. 16 13 3. The division of soil conservation shall report to the 16 14 general assembly not later than January 15, 1997, regarding 16 15 findings and recommendations of the conferees. 16 16 Sec. 22. LAND ACQUISITION – NATURAL RESOURCE COMMISSION. 16 17 The natural resource commission, upon consultation with 16 18 department of natural resources staff, shall develop and 16 19 implement a land acquisition policy which shall be embodied in 16 20 a strategic land acquisition plan administered by the 16 21 department. The land acquisition policy and the land 16 22 acquisition strategic plan shall provide for the acquisition 16 23 of land in order to enhance the quality of existing state 16 24 parks, state preserves, state forests, state wildlife areas, 16 25 and state recreation areas. The commission shall consider all 16 26 of the following factors and may consider additional factors: 16 27 1. The enhancement of the goals of an ecosystem or 16 28 biodiversity management plan for a state park, state preserve, 16 29 state forest, state wildlife area, or state recreation area. 16 30 2. The proximity or contiguity of the land to a state 16 31 park, state preserve, state forest, state wildlife area, or 16 32 state recreation area. 16 33 3. The quality of existing natural communities existing on 16 34 the land. 16 35 4. The presence on the land of threatened or endangered 17 1 species. 17 2 5. The potential for enhancing the natural quality or 17 3 recreational potential of land owned or managed for 17 4 conservation purposes by other public or nonprofit entities. 17 5 6. The risk of losing natural assets through the sale of 17 6 the land to a competing interest. 17 7 7. The preservation or enhancement of unique irreplaceable 17 8 archaeological, historical, or cultural features existing on 17 9 land owned or managed for such purposes by other public or 17 10 nonprofit entities. 17 11 Sec. 23. GIFT CERTIFICATES FOR SPECIAL PRIVILEGE FEES ON 17 12 STATE PARKS AND RECREATION AREAS. The department of natural 17 13 resources shall publish and make available for purchase by the 17 14 general public gift certificates entitling the bearer of the 17 15 certificate to free camping and other special privileges at 17 16 state parks and recreation areas. The department shall 17 17 establish prices for the certificates based on amounts 17 18 required to be paid in fees for camping and special privileges 17 19 pursuant to section 461A.47. 17 20 Sec. 24. APPROPRIATIONS CONDITIONAL UPON IMPLEMENTATION OF 17 21 CERTAIN PROVISIONS. As a condition of the appropriations made 17 22 to the department of agriculture and land stewardship in 17 23 sections 1 through 4 of this Act, the following shall occur as 17 24 provided in sections 26 and 27 of this Act by July 1, 1996: 17 25 1. The department shall complete all administrative 17 26 functions necessary to transfer the powers and duties of the 17 27 deputy secretary of agriculture to the interim assistant 17 28 secretary of agriculture. 17 29 2. The office from which the position of deputy secretary 17 30 of agriculture performed duties on January 1, 1996, shall be 17 31 vacated until the position of interim assistant secretary of 17 32 agriculture is filled. 17 33 Sec. 25. DEPUTY SECRETARY OF AGRICULTURE – POSITION 17 34 ELIMINATED. Notwithstanding contrary provisions in sections 17 35 14A.1 and 159.14, the position of deputy secretary of 18 1 agriculture is eliminated. 18 2 Sec. 26. ADMINISTRATIVE ASSISTANT VI POSITION. An 18 3 additional position of administrative assistant VI is created 18 4 within the department of agriculture and land stewardship. 18 5 The duties of the position shall not include any matter 18 6 relating to personnel, including the appointment of an interim 18 7 assistant secretary of agriculture as provided in section 27 18 8 of this Act; or the administration of or budgeting for the 18 9 department or its administrative units, including divisions 18 10 within the department. The position shall not have 18 11 jurisdiction over the heads of the department's administrative 18 12 units, including division directors. Notwithstanding chapter 18 13 19A, the person appointed to fill the position shall serve at 18 14 the pleasure of the secretary of agriculture. The secretary 18 15 of agriculture shall prepare and submit a written report to 18 16 the chairpersons and ranking members of the house and senate 18 17 standing committees on appropriations and to the legislative 18 18 fiscal bureau director not later than August 31, 1996, 18 19 describing the duties and responsibilities of the position. 18 20 Sec. 27. INTERIM ASSISTANT SECRETARY OF AGRICULTURE. The 18 21 position of interim assistant secretary of agriculture is 18 22 created within the department of agriculture and land 18 23 stewardship. The secretary of agriculture shall appoint a 18 24 person to serve as the interim assistant secretary of 18 25 agriculture, at any time after the effective date of this 18 26 section of this Act. However, the person appointed as interim 18 27 assistant secretary of agriculture shall not fill that 18 28 position before January 15, 1997. Notwithstanding chapter 18 29 19A, the person appointed as interim assistant secretary of 18 30 agriculture shall serve at the pleasure of the secretary of 18 31 agriculture. The interim assistant secretary of agriculture 18 32 shall have the same powers and duties performed by the 18 33 position of the deputy secretary of agriculture, as that 18 34 position existed on January 1, 1996. Until the appointment of 18 35 the interim assistant secretary of agriculture is made, the 19 1 interim assistant secretary of agriculture's duties shall be 19 2 performed by the administrative division director of the 19 3 department of agriculture and land stewardship who shall be 19 4 acting interim assistant secretary of agriculture. Upon 19 5 appointment, the interim assistant secretary of agriculture 19 6 shall receive compensation at the same pay grade at which the 19 7 position of deputy secretary of agriculture was compensated 19 8 immediately prior to the effective date of this section of 19 9 this Act. No position shall be housed in the office from 19 10 which the position of deputy secretary of agriculture 19 11 performed duties on January 1, 1996, until the appointment of 19 12 the interim assistant secretary of agriculture, who shall be 19 13 housed in that office. 19 14 CODIFIED CHANGES 19 15 Sec. 28. NEW SECTION. 2.55A DEPARTMENTAL INFORMATION 19 16 REQUIRED. 19 17 1. The department of agriculture and land stewardship and 19 18 the department of natural resources, in cooperation as 19 19 necessary with the department of management and the department 19 20 of personnel, shall provide a list to the legislative fiscal 19 21 bureau, on a quarterly basis, of all permanent positions added 19 22 to or deleted from the departments' table of organization in 19 23 the previous fiscal quarter. This list shall include at least 19 24 the position number, salary range, projected funding source or 19 25 sources of each position, and the reason for the addition or 19 26 deletion. The legislative fiscal bureau may use this 19 27 information to assist in the establishment of the full-time 19 28 equivalent position limits authorized in law for the 19 29 departments. 19 30 2. The department of natural resources shall provide the 19 31 legislative fiscal bureau information and financial data by 19 32 cost center, on at least a monthly basis, relating to the 19 33 indirect cost accounting procedure, the amount of funding from 19 34 each funding source for each cost center, and the internal 19 35 budget system used by the department. The information shall 20 1 include but is not limited to financial data covering the 20 2 department's budget by cost center and funding source prior to 20 3 the start of the fiscal year, and to the department's actual 20 4 expenditures by cost center and funding source after the 20 5 accounting system has been closed for that fiscal year. 20 6 3. The department of agriculture and land stewardship 20 7 shall provide the legislative fiscal bureau information and 20 8 financial data on at least a monthly basis, relating to the 20 9 internal budget system used by the department. The 20 10 information shall include but is not limited to financial data 20 11 covering the department's budget prior to the start of the 20 12 fiscal year, and to the department's actual expenditures after 20 13 the accounting system has been closed for that fiscal year. 20 14 Sec. 29. NEW SECTION. 8.60A TRUST FUND INFORMATION. 20 15 The department of revenue and finance in cooperation with 20 16 each appropriate agency shall track receipts to the general 20 17 fund of the state which under law were previously collected to 20 18 be used for specific purposes, or to be credited to, or be 20 19 deposited to a particular account or fund, as provided in 20 20 section 8.60. 20 21 The department of revenue and finance and each appropriate 20 22 agency shall prepare reports detailing revenue from receipts 20 23 previously deposited into each of the funds. A report shall 20 24 be submitted to the legislative fiscal bureau at least once 20 25 for each three-month period as designated by the legislative 20 26 fiscal bureau. 20 27 Sec. 30. Section 166D.10, Code 1995, is amended by adding 20 28 the following new subsection: 20 29 NEW SUBSECTION. 4. In addition to other applicable 20 30 requirements of this section, feeder swine shall not be moved 20 31 into this state from another state except to slaughter, unless 20 32 the feeder swine are vaccinated by a differentiable vaccine 20 33 within forty-five days of arrival in this state. 20 34 Sec. 31. Section 455A.18, subsection 3, unnumbered 20 35 paragraph 1, Code 1995, is amended to read as follows: 21 1 For each fiscal year of the fiscal period beginning July 1, 21 219901997, and ending June 30,20012021, there is 21 3 appropriated from the general fund, to the Iowa resources 21 4 enhancement and protection fund, the amount ofthirtytwenty 21 5 million dollars,except that for the fiscal year beginning21 6July 1, 1990, the amount is twenty million dollars,to be used 21 7 as provided in this chapter. However, in any fiscal year of 21 8 the fiscal period, if moneys from the lottery are appropriated 21 9 by the state to the fund, the amount appropriated under this 21 10 subsection shall be reduced by the amount appropriated from 21 11 the lottery. 21 12 Sec. 32. NEW SECTION. 455A.21 PREFERENCE PROVIDED – 21 13 PERSONS MEETING ELIGIBILITY REQUIREMENTS OF THE GREEN THUMB 21 14 PROGRAM. 21 15 In its employment of persons in temporary positions in 21 16 conservation and outdoor recreation, the department of natural 21 17 resources shall give preference to persons meeting eligibility 21 18 requirements for the green thumb program under section 15.227 21 19 and to persons working toward an advanced education in natural 21 20 resources and conservation. 21 21 Sec. 33. FUTURE REPEAL. Sections 25 through 27 of this 21 22 Act are repealed on December 31, 1998. 21 23 Sec. 34. EFFECTIVE DATES. 21 24 1. This subsection, section 11, subsection 5, paragraph 21 25 "b", and section 12 of this Act, being deemed of immediate 21 26 importance, take effect upon enactment. 21 27 2. The amendment to section 455A.18 in this Act takes 21 28 effect on July 1, 1997. 21 29 SF 2446 21 30 kah/cc/26
