PAG LIN 1 1 Section 1. NEW SECTION. 514I.1 HEALTH EDUCATION AND 1 2 ADVOCACY PROGRAM ESTABLISHED. 1 3 1. A health education and advocacy program is established 1 4 in the insurance division in the department of commerce which 1 5 shall do all of the following: 1 6 a. Assist health care consumers to make more informed 1 7 choices in the health care marketplace, and to be able to 1 8 participate in decisions concerning the consumers' health 1 9 care. 1 10 b. Promote the interest of health care consumers in this 1 11 state in the health care marketplace. 1 12 2. a. The program shall provide assistance to health care 1 13 consumers for all of the following: 1 14 (1) Understanding their health care bills and third-party 1 15 coverage. 1 16 (2) Identifying improper billing or coverage 1 17 determinations. 1 18 (3) Reporting billing or coverage problems to appropriate 1 19 entities. 1 20 b. If a billing or coverage issue concerns the adequacy or 1 21 propriety of a service or treatment, the program shall refer 1 22 the matter to an appropriate professional, licensing, or 1 23 disciplinary body, as applicable. The program shall monitor 1 24 the progress of the concerns raised by health care consumers 1 25 through the referrals. 1 26 c. The program shall work with the appropriate state 1 27 agency to assist with the resolution of billing or coverage 1 28 questions as necessary. 1 29 3. a. The program shall recommend to the attorney 1 30 general, the governor, the general assembly, or any other 1 31 appropriate state agency, any measure that will promote the 1 32 interests of health care consumers in the health marketplace. 1 33 b. The program shall make an annual report to the general 1 34 assembly concerning the program's activities. The legislative 1 35 council shall appoint an advisory committee to monitor the 2 1 activities and progress of the program in satisfying the 2 2 objectives established in this section. The advisory 2 3 committee shall consist of seven members of which one member 2 4 shall represent a small employer providing health care 2 5 coverage to its employees; two members shall represent 2 6 employees, at least one of whom shall be a member of a 2 7 statewide labor organization; and four members shall represent 2 8 consumers, at least one of whom shall be a member of a 2 9 statewide consumer organization. The committee shall meet 2 10 with program staff on a regular basis to receive reports on 2 11 the activities of the program. 2 12 Sec. 2. This Act shall only be effective if the general 2 13 assembly appropriates $200,000 for 4 FTEs in the insurance 2 14 division of the department of commerce to be used to staff the 2 15 program established in this Act. 2 16 SF 410 2 17 mj/cc/26
