3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  481A.56A  Retrieval of wounded deer
2by leashed dogs.
   3A person having a valid hunting license and a valid deer
4hunting license who has wounded a deer while hunting may use a
5dog to locate and retrieve the wounded deer. The hunter or any
6person in the company of the hunter shall not possess a firearm
7or bow while using a dog in this manner and shall have the
8dog leashed and under control at all times during the search.
9A person shall obtain permission from the owner or tenant of
10private property before using a dog to locate a wounded deer
11on the private property. The commission shall adopt rules
12pursuant to chapter 17A to implement this section.
13   Sec. 2.  Section 805.8B, subsection 3, paragraph c, Code
142018, is amended to read as follows:
   15c.  For violations of sections 481A.6, 481A.21, 481A.22,
16481A.26, 481A.50, 481A.56, 481A.56A, 481A.60 through, 481A.61,
17 481A.62, 481A.83, 481A.84, 481A.92, 481A.123, 481A.145,
18subsection 3, sections 483A.6A, 483A.7, 483A.8, 483A.23,
19483A.24, and 483A.28, the scheduled fine is twenty-five
20dollars.
21EXPLANATION
22The inclusion of this explanation does not constitute agreement with
23the explanation’s substance by the members of the general assembly.
   24This bill creates new Code section 481A.56A to allow a
25hunter with a valid hunting license and deer hunting license
26who wounds a deer while hunting to use a dog to locate and
27retrieve the wounded deer. The hunter or any person in the
28company of the hunter shall not possess a firearm or bow while
29using a dog in this manner and shall have the dog leashed and
30under control at all times during the search. A person must
31obtain permission from the owner or tenant before using a dog
32to locate a wounded deer on private property. The natural
33resource commission shall adopt rules pursuant to Code chapter
3417A to implement this provision.
   35A violation of the new provision is punishable by a scheduled
