4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 135.166, subsection 2, as enacted in 2017
2Iowa Acts, House File 393, section 104, if enacted, is amended
3to read as follows:
   42.  Unless otherwise authorized or required by state or
5federal law, data collected under this section shall not
6include the social security number or name of the individual
7subject of the data.
8   Sec. 2.  Section 144.43, subsection 3, unnumbered paragraph
91, Code 2017, is amended to read as follows:
   10However, the following vital statistics records may be
11inspected and copied as of right under chapter 22, if requested
12by a member of the news media or an entitled person as defined
13by rule,
when they the records are in the custody of a county
14registrar or when they the records are in the custody of the
15state archivist and are at least seventy-five years old:
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill relates to records and data including activities
20relating to vital statistics records and the collection and
21use of health data by the department of public health. The
22bill amends Code section 135.166, if enacted in 2017 Iowa Acts,
23House File 393, to provide that in addition to prohibiting the
24collection of the social security number of the individual
25subject of the data, collection of the name of such individual
26is also prohibited.
   27The bill also provides that when a record of birth; a record
28of marriage; a record of divorce, dissolution of marriage, or
29annulment of marriage; or a record of death if that death was
30not a fetal death is in the custody of the county registrar
31or in the custody of the state archivist and the record is at
32least 75 years old, if requested by a member of the news media
33or an entitled person as defined by rule, the record may be
34inspected and copied as of right under Code chapter 22.
