2services training in the state by creating a fire and
3emergency response services training grant fund, providing
4for certain transfers to the fund, and repealing and
5creating certain other funds.
6BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  100B.15  Fire and emergency response
2services training grant fund.
   31.  A fire and emergency response services training grant
4fund is created in the state treasury under the control of
5the department of public safety. The fund shall consist of
6fees transferred pursuant to section 144.45A, section 147A.6,
7subsection 1, section 321.34, subsection 10A, paragraph “b”,
8amounts appropriated by the general assembly, and other moneys
9available from other sources accepted for deposit in the fund.
10Moneys in the fund are appropriated to the department of public
11safety and shall be used exclusively by the department for fire
12and emergency response services training grants.
   132.  A fire fighter, or a volunteer fire fighter or emergency
14medical services personnel member as defined in section 422.12,
15may apply to the department for a grant to reimburse the
16fire fighter, volunteer fire fighter, or emergency medical
17services personnel member for training expenses incurred in
18completing required training in this state. For purposes of
19this subsection, “training expenses” shall include costs of
20the required training to become or maintain status as a fire
21fighter, volunteer fire fighter, or emergency medical services
22personnel member in this state including but not limited to
23training required under section 100B.6, as well as any travel
24and lodging expenses directly related to completion of the
25training, and actually paid by a fire fighter, volunteer fire
26fighter, or emergency medical services personnel member.
   273.  Notwithstanding section 8.33, moneys in the fund shall
28not revert to the general fund of the state at the end of the
29fiscal year, but shall remain available for expenditure by the
30department in future fiscal years.
   314.  The department of public safety shall adopt rules
32pursuant to chapter 17A to administer this section.
33   Sec. 2.  Section 144.45A, Code 2017, is amended to read as
34follows:
   35144.45A  Commemorative birth and marriage certificates.

   1Upon application and payment of a thirty-five dollar fee,
2the director may issue a commemorative copy of a certificate of
3birth or a certificate of marriage. Fees collected pursuant
4to this section shall be deposited in the emergency medical
5services fund established in section 135.25 to support the
6development and enhancement of emergency medical services
7systems and emergency medical services for children
 fire and
8emergency response services training grant fund created in
9section 100B.15

10   Sec. 3.  Section 147A.6, subsection 1, Code 2017, is amended
11to read as follows:
   121.  The department, upon application and receipt of the
13prescribed fee, shall issue a certificate to an individual who
14has met all of the requirements for emergency medical care
15provider certification established by the rules adopted under
16section 147A.4, subsection 2. All fees received pursuant
17to this section shall be deposited in the emergency medical
18services fund established in section 135.25

21   Sec. 4.  Section 147A.23, subsection 2, paragraph d, Code
222017, is amended to read as follows:
   23d.  The department is responsible for the funding of the
24administrative costs of this subchapter. Any funds received
25by the department for this purpose shall be deposited in
26the emergency medical services fund established in section
27135.25

29   Sec. 5.  NEW SECTION.  147A.23A  Trauma care system
30development fund.
   31A trauma care system development fund is created in the
32state treasury under the control of the department. The fund
33shall include amounts appropriated from the general assembly
34and any other funds received by the department for deposit
35in the fund. Moneys remaining in the fund at the end of
-2-1each fiscal year shall not revert to the general fund of the
2state but shall remain in the trauma care system development
3fund, notwithstanding section 8.33. Moneys in the fund are
4appropriated to the department and shall be used for the
5purposes described in this subchapter.
6   Sec. 6.  Section 321.34, subsection 10A, paragraph b, Code
72017, is amended to read as follows:
   8b.  The special fees collected by the director under this
9subsection shall be paid monthly to the treasurer of state and
10deposited in the road use tax fund. The treasurer of state
11shall transfer monthly from the statutory allocations fund
12created under section 321.145, subsection 2, to the emergency
13medical services fund created in section 135.25

the amount of the special fees collected in
16the previous month for issuance of emergency medical services
17plates.
18   Sec. 7.  REPEAL.  Sections 100B.12 and 135.25, Code 2017,
19are repealed.
20   Sec. 8.  TRANSFER OF REMAINING FUNDS.  Any unobligated
21or unencumbered moneys remaining in the Paul Ryan memorial
22fire fighter safety training fund in section 100B.12 and the
23emergency medical services fund in section 135.25 at the end
24of the fiscal year beginning July 1, 2016, and ending June 30,
252017, shall be transferred to the fire and emergency response
26services training grant fund enacted in this Act.
27EXPLANATION
28The inclusion of this explanation does not constitute agreement with
29the explanation’s substance by the members of the general assembly.
   30This bill creates a fire and emergency response services
31training fund under the control of the department of public
32safety (DPS) to reimburse fire fighters, and volunteer fire
33fighters and emergency medical services personnel members
34as defined in the bill, for training expenses incurred in
35completing required training in this state to become or
-3-1maintain status as a fire fighter, volunteer fire fighter, or
2emergency medical services personnel member. The bill allows
3a fire fighter, volunteer fire fighter, or emergency medical
4services personnel member to apply to DPS for a grant from the
5fund to be reimbursed for training expenses, as defined in
6the bill, actually paid by the fire fighter, volunteer fire
7fighter, or emergency medical services personnel member. The
8bill requires DPS to adopt rules for the administration of the
9fund.
   10The bill repeals the Paul Ryan memorial fire fighter safety
11training fund in Code section 100B.12 and the emergency
12medical services fund in Code section 135.25, and transfers any
13unobligated or unencumbered moneys remaining in those funds at
14the end of FY 2016-2017 to the new fire and emergency response
15services training grant fund.
   16The bill also provides that the statutory transfers
17provided for deposit into the repealed funds shall instead
18be made for deposit into the new fire and emergency response
19services training fund. These transfers include the transfer
20in Code section 144.45A of fees collected on the issuance of
21commemorative copies of birth and marriage certificates, the
22transfer in Code section 147A.6(1) of fees collected on the
23issuance of emergency medical care provider certificates, and
24the transfer in Code section 321.34(10A)(b) of fees collected
25on the issuance of special emergency medical services license
26plates.
   27The bill also creates a new trauma care system development
28fund in Code section 147A.23A that shall contain any funds
29received by the department of public health for purposes of the
30statewide trauma care system (Code chapter 147A, subchapter
31II). These funds were previously deposited in the emergency
32medical services fund in Code section 135.25.
