4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 483A.1, Code 2017, is amended to read as
2follows:
   3483A.1  Licenses — fees.
   4Except as otherwise provided in this chapter, a person
5shall not fish, trap, hunt, pursue, catch, kill, take in any
6manner, use, have possession of, sell, or transport all or a
7part of any wild animal, bird, game, or fish, the protection
8and regulation of which is desirable for the conservation of
9resources of the state, without first obtaining a license for
10that purpose and the payment of a fee as follows:

23   Sec. 2.  NEW SECTION.  483A.1B  License fees — periodic
24evaluation.
   251.  The license fees established in section 483A.1 shall be
26periodically evaluated by the department, but not less often
27than once every three years to ensure that the fees paid are
28sufficient to meet the needs of natural resource management and
29the public.
   302.  By December 15 of each year that an evaluation of the
31license fees is completed, the department shall file a written
32report with the commission which shall include the findings of
33the evaluation and recommendations, if any.
34   Sec. 3.  Section 483A.3, subsection 1, paragraphs c and d,
35Code 2017, are amended to read as follows:
-5-   1c.  Eleven Fifteen dollars of the fee paid for each resident
2or nonresident hunting or fur harvester license that includes
3the wildlife habitat fee and twenty dollars of the fee paid for
4each nonresident hunting or fur harvester license that includes
5the wildlife habitat fee
shall be designated as a wildlife
6habitat fee.
   7d.  All wildlife habitat fees shall be administered in
8the same manner as hunting and fur harvester licenses except
9all revenue derived from wildlife habitat fees shall be used
10within the state of Iowa for habitat development and shall be
11deposited in the state fish and game protection fund, except
12as provided in subsection 2. The revenue may be used for
13the matching of federal funds. The revenues and any matched
14federal funds shall be used for acquisition of land, leasing of
15land, or obtaining of easements from willing sellers for use
16as wildlife habitats. Notwithstanding the exemption provided
17by section 427.1, any land acquired with the revenues and
18matched federal funds shall be subject to the full consolidated
19levy of property taxes, which shall be paid from those the
20income generated from those lands or, if no such income is
21generated, from the wildlife habitat fee
revenues. In addition
22the revenue may be used for the development and enhancement of
23wildlife lands and habitat areas.
24   Sec. 4.  Section 483A.3, subsection 3, Code 2017, is amended
25to read as follows:
   263.  Notwithstanding subsections 1 and 2, any increase in
27wildlife habitat fee revenues received on or after July 1,
282007, pursuant to this section as a result of wildlife habitat
29fee increases pursuant to 2007 Iowa Acts, ch.194,
 five dollars
30from each wildlife habitat fee paid by a resident and eight
31dollars from each wildlife habitat fee paid by a nonresident

32 shall be used by the commission only for the purpose of the
33game bird habitat development program programs as provided
34in section 483A.3B. The commission shall not reduce on an
35annual basis for these purposes the amount of other funds being
-6-1expended as of July 1, 2007.

2   Sec. 5.  Section 483A.3B, subsection 1, Code 2017, is amended
3to read as follows:
   41.  Allocation of revenue — accounts.  All revenue collected
5from increases in wildlife habitat fees as provided in section
6483A.3, subsection 3, that is deposited in the state fish and
7game protection fund shall be allocated as follows:
   8a.  Two Three dollars of each resident wildlife habitat
9fee and five dollars of each nonresident wildlife habitat
10fee
collected shall be allocated to the game bird wetlands
11conservation account.
   12b.  One dollar Two dollars of each resident wildlife habitat
13fee and three dollars of each nonresident wildlife habitat fee
14 collected shall be allocated to the game bird buffer strip
15assistance account.
   16c.  Notwithstanding section 12C.7, subsection 2, interest or
17earnings on moneys collected from wildlife habitat fees that
18are deposited in each account created under this section shall
19be credited to that account. Notwithstanding section 8.33 or
20section 456A.17, moneys credited to each account created under
21this section shall not revert to the state general fund at the
22close of a fiscal year.
   23d.  All revenue generated by increases in the collected
24from
wildlife habitat fee fees as provided in section 483A.3,
25subsection 3, shall be used as provided in this section, except
26for that part which is specified by the department for use in
27paying administrative expenses as provided in section 456A.17.
28   Sec. 6.  NEW SECTION.  483A.6B  Nonresident five-day hunting
29license — fee.
   301.  A nonresident may be issued a five-day hunting license
31that costs ninety-five dollars, including the wildlife habitat
32fee. A nonresident hunting with a license issued under this
33section shall be otherwise qualified to hunt in this state.
   342.  This section is repealed on December 15, 2020.
35   Sec. 7.  Section 483A.7, subsection 3, paragraph a, Code
-7-12017, is amended to read as follows:
   2a.  A nonresident wild turkey hunter is required to purchase
3a nonresident annual hunting license that includes the wildlife
4habitat fee and a nonresident wild turkey hunting license. The
5commission shall annually limit to two thousand three hundred
6licenses the number of nonresidents allowed to have wild turkey
7hunting licenses. Of the two thousand three hundred licenses,
8one hundred fifty licenses shall be valid for hunting with
9muzzle loading shotguns only. The commission shall allocate
10the nonresident wild turkey hunting licenses issued among the
11zones based on the populations of wild turkey. A nonresident
12applying for a wild turkey hunting license must exhibit proof
13of having successfully completed a hunter education program as
14provided in section 483A.27 or its equivalent as determined by
15the department before the license is issued.
16   Sec. 8.  Section 483A.8, subsection 3, paragraph a, Code
172017, is amended to read as follows:
   18a.  A nonresident hunting deer is required to purchase
19a nonresident annual hunting license that includes the
20wildlife habitat fee and a nonresident deer hunting license.
21In addition, a nonresident who purchases a deer hunting
22license shall pay a one dollar fee that shall be used and
23is appropriated for the purpose of deer herd population
24management, including assisting with the cost of processing
25deer donated to the help us stop hunger program administered
26by the commission.
27   Sec. 9.  Section 483A.8, subsection 4, Code 2017, is amended
28to read as follows:
   294.  The commission may provide, by rule, for the issuance
30of an additional antlerless deer hunting license to a person
31who has been issued an antlerless deer hunting license. The
32rules shall specify the number of additional antlerless deer
33hunting licenses which may be issued, and the season and zone
34in which the license is valid. The fee for an additional
35antlerless deer hunting license shall be ten seventeen dollars

2   Sec. 10.  Section 483A.8, subsection 6, Code 2017, is amended
3to read as follows:
   46.  The commission shall provide by rule for the annual
5issuance to a nonresident of a nonresident antlerless deer
6hunting license that is valid for use only during the period
7beginning on December 24 and ending at sunset on January 2 of
8the following year and costs seventy-five one hundred dollars.
9A nonresident hunting deer with a license issued under this
10subsection shall be otherwise qualified to hunt deer in this
11state and shall purchase a nonresident annual hunting license
12that includes the wildlife habitat fee, and pay the one dollar
13fee for the purpose of deer herd population management as
14provided in subsection 3. Pursuant to this subsection, the
15commission shall make available for issuance only the remaining
16nonresident antlerless deer hunting licenses allocated under
17subsection 3 that have not yet been issued for the current
18year’s nonresident antlerless deer hunting seasons.
19   Sec. 11.  Section 483A.24, subsection 3, paragraph a, Code
202017, is amended to read as follows:
   21a.  Fifty of the nonresident deer hunting licenses shall be
22allocated as requested by a majority of a committee consisting
23of the majority leader of the senate, speaker of the house
24of representatives, and director of the economic development
25authority, or their designees. The licenses provided pursuant
26to this subsection shall be in addition to the number of
27nonresident licenses authorized pursuant to section 483A.8.
28The purpose of the special nonresident licenses is to allow
29state officials and local development groups to promote the
30state and its natural resources to nonresident guests and
31dignitaries. Photographs, videotapes, or any other form
32of media resulting from the hunting visitation shall not
33be used for political campaign purposes. The nonresident
34licenses shall be issued without application upon purchase of a
35nonresident annual hunting license that includes the wildlife
-9-1habitat fee and the purchase of a nonresident deer hunting
2license. The licenses are valid in all zones open to deer
3hunting. The hunter education certificate requirement pursuant
4to section 483A.27 is waived for a nonresident issued a license
5pursuant to this subsection.
6   Sec. 12.  Section 483A.24, subsection 4, paragraph a, Code
72017, is amended to read as follows:
   8a.  Fifty of the nonresident wild turkey hunting licenses
9shall be allocated as requested by a majority of a committee
10consisting of the majority leader of the senate, speaker of
11the house of representatives, and director of the economic
12development authority, or their designees. The licenses
13provided pursuant to this subsection shall be in addition
14to the number of nonresident licenses authorized pursuant
15to section 483A.7. The purpose of the special nonresident
16licenses is to allow state officials and local development
17groups to promote the state and its natural resources to
18nonresident guests and dignitaries. Photographs, videotapes,
19or any other form of media resulting from the hunting
20visitation shall not be used for political campaign purposes.
21The nonresident licenses shall be issued without application
22upon purchase of a nonresident annual hunting license that
23includes the wildlife habitat fee and the purchase of a
24nonresident wild turkey hunting license. The licenses are
25valid in all zones open to wild turkey hunting. The hunter
26education certificate requirement pursuant to section 483A.27
27is waived for a nonresident issued a license pursuant to this
28subsection.
29   Sec. 13.  EFFECTIVE DATE.  This Act takes effect December 15,
302017.
31EXPLANATION
32The inclusion of this explanation does not constitute agreement with
33the explanation’s substance by the members of the general assembly.
   34This bill increases certain fees and reallocates certain
35revenues related to hunting, fishing, and fur harvesting.

   1The bill increases most fees for resident and nonresident
2fishing, hunting, and fur harvester licenses. The bill
3requires the department of natural resources to evaluate the
4license fees at least every three years and report the results
5of that evaluation to the natural resource commission by
6December 15 of each year that an evaluation is made. The bill
7provides that a resident deer hunting license for antlered or
8any sex deer costs $35 and a resident antlerless deer only
9deer hunting license is available for $25.50. The bill also
10includes a new five-day nonresident adult hunting license,
11including the wildlife habitat fee, that costs $95 and is
12available for issuance for three years. The bill provides that
13a nonresident who purchases a hunting license in conjunction
14with a deer or turkey hunting license must purchase an annual
15hunting license.
   16The bill also increases the wildlife habitat fee for
17residents and nonresidents from $11 to $15 for residents and
18$20 for nonresidents. The bill amends Code section 483A.3(1)
19to provide that the income generated from land acquired with
20revenues from wildlife habitat fees and matched federal funds
21shall be used to pay property taxes on that land, and if no
22income is generated, wildlife habitat fee revenue shall be used
23to pay the taxes. Currently, the taxes are paid only with
24wildlife habitat fee revenues.
   25The bill amends Code section 483A.3(3) to provide that
26$5 from each resident wildlife habitat fee paid and $8 from
27each nonresident wildlife habitat fee paid shall be used by
28the natural resource commission only for the purpose of game
29bird habitat development programs. Currently, the increase
30in wildlife habitat fee revenues received as a result of an
31increase in the resident and nonresident wildlife habitat fees
32in 2007 from $8 to $11, can be used by the commission for the
33purpose of those programs.
   34The bill amends Code section 483A.3B to provide that all
35revenue collected from wildlife habitat fees, not just the
-11-1increase in fees since 2007, shall be allocated to game bird
2habitat development programs.
   3The bill provides that $3 of each resident wildlife habitat
4fee and $5 of each nonresident fee collected shall be allocated
5to the game bird wetlands conservation account. Currently, $2
6of each resident and nonresident fee collected is allocated to
7that account.
   8The bill also provides that $2 of each resident fee and $3 of
9each nonresident fee collected shall be allocated to the game
10bird buffer strip assistance account. Currently, $1 of each
11resident and nonresident fee collected is allocated to that
12account.
   13The bill takes effect December 15, 2017.
