3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 455A.12, Code 2017, is amended to read
2as follows:
   3455A.12  Gift certificates for special privilege fees at state
4parks and recreation areas.
   5The department of natural resources shall publish and make
6available for purchase by the general public, gift certificates
7entitling the bearer of the certificate to free camping and
8other special privileges at state parks and recreation areas.
9The department shall establish prices for the certificates
10based on amounts required to be paid in fees for camping and
11special privileges pursuant to section 461A.47 455A.14.
12   Sec. 2.  NEW SECTION.  455A.14  Camping and rental facilities
13and other privileges — fees.
   141.  Notwithstanding any provision of law to the contrary,
15the department of natural resources is authorized to establish
16fees for camping and use of rental facilities and other special
17privileges at state parks and recreation areas under the
18jurisdiction of the department.
   192.  The fees established by the department pursuant to this
20section shall be in such amounts as may be determined by the
21department based on the cost of providing the privileges and
22the reasonable value of such privileges. Such fees may be
23increased, reduced, or waived by the department for special
24promotional events or efforts or on the basis of special
25seasonal or holiday rates, on a statewide basis or on the basis
26of an individual state park or recreation area.
   273.  Fees established pursuant to this section shall be
28considered a specification of prices to be charged for goods or
29services as provided in section 17A.2, subsection 11, paragraph
30“g”.
31   Sec. 3.  REPEAL.  Section 461A.47, Code 2017, is repealed.
32EXPLANATION
33The inclusion of this explanation does not constitute agreement with
34the explanation’s substance by the members of the general assembly.
   35This bill provides that, notwithstanding any provision of
-1-1law to the contrary, the department of natural resources is
2authorized to establish fees for camping and use of rental
3facilities and other special privileges at state parks and
4recreation areas under the jurisdiction of the department.
5Currently, the natural resource commission is authorized to
6establish such fees under Code section 461A.47, which is
7repealed by the bill.
   8The bill also provides that fees established by the
9department pursuant to the bill’s provisions shall be in such
10amounts as may be determined by the department based on the
11cost of providing the privileges and the reasonable value
12of such privileges. Such fees may be increased, reduced,
13or waived by the department for special promotional events
14or efforts or on the basis of special seasonal or holiday
15rates, on a statewide basis or on the basis of an individual
16state park or recreation area. The bill provides that fees
17established pursuant to the bill are considered a specification
18of the prices to be charged for goods or services sold by
19an agency and are not considered rules for purposes of Code
20chapter 17A.
   21A coordinating change is made to Code section 455A.12.
