House Study Bill 149 - IntroducedA Bill ForAn Act 1relating to access to certain mental health, substance
2abuse, and disability services.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 331.391, subsection 4, Code 2017, is
2amended to read as follows:
   34.  If a region is meeting the financial obligations for
4implementation of its regional service system management
5plan for a fiscal year and residual funding is anticipated,
6the regional administrator shall reserve an adequate amount
7for cash flow of expenditure obligations in the next fiscal
8year. The cash flow amount shall not exceed twenty-five
9percent of the gross expenditures budgeted for the combined
10account or for all regional accounts for the fiscal year in
11progress. Residual funding remaining after the cash flow
12amount is reserved shall be used to expand the region’s core
13services under section 331.397, subsection 4, and then to make
14additional core service domains available in the region as
15enumerated in section 331.397, subsection 6
.
16   Sec. 2.  Section 331.397, subsection 4, Code 2017, is amended
17by adding the following new paragraphs:
18   NEW PARAGRAPH.  g.  Comprehensive facility and
19community-based crisis services, including but not limited to
20all of the following:
   21(1)  Twenty-four-hour crisis hotline.
   22(2)  Mobile response.
   23(3)  Twenty-three-hour crisis observation and holding, and
24crisis stabilization facility and community-based services.
   25(4)  Crisis residential services.
26   NEW PARAGRAPH.  h.  Subacute services provided in facility
27and community-based settings.
28   NEW PARAGRAPH.  i.  Justice system-involved services,
29including but not limited to all of the following:
   30(1)  Jail diversion.
   31(2)  Crisis intervention training.
   32(3)  Civil commitment prescreening.
33   NEW PARAGRAPH.  j.  Advances in the use of evidence-based
34treatment, including but not limited to all of the following:
   35(1)  Positive behavior support.

   1(2)  Assertive community treatment.
   2(3)  Peer self-help drop-in centers.
3   Sec. 3.  Section 331.397, subsection 6, Code 2017, is amended
4by striking the subsection.
5   Sec. 4.  DIRECTIVE TO DEPARTMENT OF HUMAN SERVICES —
6PSYCHIATRIC BED TRACKING SYSTEM.
  The department of human
7services shall amend its administrative rules pursuant to
8chapter 17A to require the state mental health institutes
9and hospitals licensed to provide inpatient psychiatric
10treatment and services to participate in the psychiatric bed
11tracking system and to report the number of beds available
12for persons with a co-occurring mental illness and substance
13abuse disorder. The department shall issue a quarterly report
14on state mental health institutes and hospitals licensed to
15provide inpatient psychiatric treatment and services that are
16noncompliant with daily updates.
17EXPLANATION
18The inclusion of this explanation does not constitute agreement with
19the explanation’s substance by the members of the general assembly.
   20This bill relates to access to certain mental health,
21substance abuse, and disability services.
   22Under current law, a mental health and disability services
23region must make certain initial core services available to
24eligible residents of a region including residents with a
25diagnosis of a mental illness, subject to available funding
26and regardless of the funding source for the service. If
27money is available after funding the initial core services, a
28region must make certain additional core services available to
29eligible residents who are not eligible for Medicaid or who
30are not receiving other third-party payments for the services,
31when public funds are made available for such services. The
32additional core services include comprehensive facility and
33community-based crisis services, subacute services provided in
34facility and community-based settings, justice system-involved
35service, and evidence-based treatment. The bill amends current
-2-1law to redesignate these additional core services as initial
2core services that must be made available by a region.
   3The bill directs the department of human services to
4amend its administrative rules to require the state mental
5health institutes and hospitals licensed to provide inpatient
6psychiatric treatment and services to participate in the
7psychiatric bed tracking system and to report the number of
8beds available for persons with a co-occurring mental illness
9and substance abuse disorder. The bill directs the department
10to file quarterly reports listing the mental health institutes
11and hospitals licensed to provide inpatient psychiatric
12treatment and services that are not compliant in daily updates.
