Senate Study Bill 1129 - IntroducedA Bill ForAn Act 1relating to the issuance of birth certificates and
2providing for a fee.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 144.13A, subsections 1 and 2, Code 2017,
2are amended to read as follows:
   31.  The state registrar shall charge the parent a fee of
4twenty dollars
for the registration of a certificate of birth
5as follows:
   6a.  Beginning July 1, 2003, and ending June 30, 2005, a fee
7of fifteen dollars.
   8b.  Beginning July 1, 2005, a fee of twenty dollars.
   92.  a.  The state registrar shall charge the parent a
10separate fee established under section 144.46 for a certified
11copy of the certificate. The certified copy shall be mailed to
12the parent by the state registrar. The mailing of a certified
13copy of the certificate to a biological parent shall not be
14precluded by the execution of a release of custody under
15chapter 600A, and, upon request, a biological parent shall be
16provided with a certified copy of the certificate unless the
17parental rights of the biological parent are terminated.
   18b.  (1)  If a parent is issued a smaller than letter-sized
19certified copy of the certificate of birth by the state
20registrar under this section, which does not include all
21information provided in the original certificate of birth, upon
22request of the parent, the state registrar shall mail to the
23parent one letter-sized certified copy that includes all of the
24information provided in the original certificate of birth.
   25(2)  Notwithstanding the amount of any fee charged under
26paragraph “a”, the state registrar may instead charge the parent
27a fee of one dollar for one letter-sized certified copy of the
28certificate of birth requested by and mailed to a parent under
29this paragraph “b”.
   30(3)  This paragraph “b” shall not apply if a new certificate
31of birth was substituted for the original certificate of birth
32pursuant to section 144.24.
33EXPLANATION
34The inclusion of this explanation does not constitute agreement with
35the explanation’s substance by the members of the general assembly.

   1This bill relates to the certified copy of a certificate
2of birth mailed to a parent by the state registrar following
3registration of the certificate of birth.
   4The bill updates outdated language relating to the fee
5charged a parent for registration of a certificate of birth by
6eliminating the reference to the fee charged during the period
7ending June 30, 2005, and retaining the current fee which is
8$20.
   9The bill provides that if a parent is issued a certified copy
10of the certificate of birth that is smaller than letter-sized
11and does not include all of the information provided in the
12original certificate of birth, upon request of the parent,
13the state registrar shall mail to the parent one letter-sized
14certified copy that includes all of the information provided in
15the original certificate of birth. Notwithstanding the amount
16of the fee regularly charged for the certificate of birth
17issued to a parent, the bill authorizes the state registrar
18to instead charge the parent a fee of $1 for one letter-sized
19certified copy requested by and mailed to the parent under the
20bill.
