Senate Study Bill 1103 - IntroducedA Bill ForAn Act 1concerning persons voluntarily excluded from gambling

3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 99D.7, subsection 23, Code 2017, is
2amended to read as follows:
   323.  To require licensees to establish a process to allow a
4person to be voluntarily excluded for life from the wagering
5area of
a racetrack enclosure and from the gaming floor, as
6defined in section 99F.1, of
all other licensed facilities
7under this chapter and chapter 99F as provided in this
8subsection. The process shall provide that an initial request
9by a person to be voluntarily excluded shall be for a period
10of five years or life and any subsequent request following any
11five-year period shall be for a period of five years or life
.
12The process established shall also require that a licensee
13disseminate information regarding persons voluntarily excluded
14to all licensees under this chapter and chapter 99F. The state
15and any licensee under this chapter or chapter 99F shall not
16be liable to any person for any claim which may arise from this
17process. In addition to any other penalty provided by law, any
18money or thing of value that has been obtained by, or is owed
19to, a voluntarily excluded person by a licensee as a result of
20wagers made by the person after the person has been voluntarily
21excluded shall not be paid to the person but shall be credited
22to the general fund of the state.
23   Sec. 2.  Section 99F.4, subsection 22, Code 2017, is amended
24to read as follows:
   2522.  To require licensees to establish a process to allow
26a person to be voluntarily excluded for life from the gaming
27floor of
an excursion gambling boat and from the wagering
28area, as defined in section 99D.2, and the gaming floor of
all
29other licensed facilities under this chapter and chapter 99D
 30as provided in this subsection. The process shall provide
31that an initial request by a person to be voluntarily excluded
32shall be for a period of five years or life and any subsequent
33request following any five-year period shall be for a period of
34five years or life
. The process established shall also require
35that a licensee disseminate information regarding persons
-1-1voluntarily excluded to all licensees under this chapter and
2chapter 99D. The state and any licensee under this chapter or
3chapter 99D shall not be liable to any person for any claim
4which may arise from this process. In addition to any other
5penalty provided by law, any money or thing of value that has
6been obtained by, or is owed to, a voluntarily excluded person
7by a licensee as a result of wagers made by the person after the
8person has been voluntarily excluded shall not be paid to the
9person but shall be credited to the general fund of the state.
10   Sec. 3.  GAMBLING SELF-EXCLUSION — REVOCATION.  A person
11who has been voluntarily excluded for life from a racetrack
12enclosure, an excursion gambling boat, and all other licensed
13facilities under Code chapters 99D and 99F pursuant to the
14process established in Code sections 99D.7 and 99F.4 prior to
15the effective date of this Act may revoke the exclusion by
16filing a form with the racing and gaming commission in a manner
17as prescribed by the racing and gaming commission. A person
18may revoke the voluntary exclusion only if the person has been
19voluntarily excluded for a period of at least five years.
20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
   23This bill concerns the process by which a person can be
24voluntarily excluded from a racetrack enclosure under Code
25chapter 99D and from an excursion gambling boat and all other
26licensed facilities under Code chapter 99F.
   27The bill provides that a person who is voluntarily excluded
28shall be excluded only from the wagering area and gaming floor
29of a licensed facility under Code chapters 99D and 99F.
   30The bill provides that an initial request to be voluntarily
31excluded shall be for a period of five years or for life and any
32subsequent request by that person after any five-year period
33shall be for five years or life. Under current law, a request
34to be voluntarily excluded is for life.
   35The bill also provides that for a person who has been

2to the effective date of the bill, the person may have the
3exclusion revoked by filing a form with the racing and gaming
4commission if the person has been excluded for at least five
5years.
