3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 232.116, subsection 1, paragraph e,
2subparagraph (2), Code 2017, is amended to read as follows:
   3(2)  The child has been removed from or was not placed in
4 the physical custody of the child’s parents for a period of at
5least six consecutive months.
6   Sec. 2.  Section 232.116, subsection 1, paragraph f,
7subparagraph (3), Code 2017, is amended to read as follows:
   8(3)  The child has been removed from or was not placed in the
9physical custody of the child’s parents for at least twelve of
10the last eighteen months, or for the last twelve consecutive
11months and any trial period at home has been less than thirty
12days.
13   Sec. 3.  Section 232.116, subsection 1, paragraph h,
14subparagraph (3), Code 2017, is amended to read as follows:
   15(3)  The child has been removed from or was not placed in the
16physical custody of the child’s parents for at least six months
17of the last twelve months, or for the last six consecutive
18months and any trial period at home has been less than thirty
19days.
20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
   23This bill relates to grounds for the termination of parental
24rights under Code chapter 232 when a child has been adjudicated
25a child in need of assistance.
   26The bill amends existing grounds for termination of parental
27rights that each include as an element that the child has been
28removed from the physical custody of the child’s parent for
29a specified period of time. The bill amends this element to
30require that either the child has been removed from or was not
31placed in the physical custody of the child’s parent for a
32specified period of time.
