House Study Bill 111 - IntroducedA Bill ForAn Act 1relating to motor trucks traveling in a connected
2platoon, and making penalties applicable.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.308, Code 2017, is amended to read
2as follows:
   3321.308  Motor trucks and towed vehicles — distance
4requirements.
   5The driver of any motor truck, including but not limited to
6a motor truck using cooperative adaptive cruise control or any
7other automated driving technology approved by the department
8to travel in a connected platoon,
or of a motor vehicle drawing
9another vehicle, when traveling upon a roadway, outside of a
10business or residence district shall not follow within three
11hundred feet of another motor truck, or of a motor vehicle
12drawing another vehicle. The provisions of this section shall
13not be construed to prevent overtaking and passing nor shall
14the same apply upon any lane specially designated for use by
15motor trucks.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19Current law prohibits the driver of a motor truck from
20following within 300 feet of another motor truck when traveling
21upon a roadway outside of a business or residence district.
22This bill includes in that provision motor trucks using
23cooperative adaptive cruise control or any other automated
24driving technology approved by the department of transportation
25to travel in a connected platoon. Under current law, a
26violation of the provision is punishable by a scheduled fine of
27$100. However, if the violation causes a serious injury, the
28court could impose a fine of $500 and suspend the violator’s
29driver’s license or operating privileges for not more than 90
30days. If the violation causes a death, the court could impose
31a fine of $1,000 and suspend the violator’s driver’s license or
32operating privileges for not more than 180 days.
