3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 483A.8, subsection 2, Code 2017, is
2amended to read as follows:
   32.  a.  The deer hunting license shall be accompanied by
4a tag designed to be used only once. When a deer is taken,
5the deer shall be tagged and the tag shall be dated. The tag
6shall be attached to the carcass of a deer taken within fifteen
7minutes of the time the deer carcass is located after being
8taken, or before the carcass is moved to be transported by any
9means from the place where the deer was taken, whichever occurs
10first. For each antlered deer taken, the tag shall be affixed
11to the deer’s antlers.
   12b.  For purposes of the tagging requirements in this
13subsection, a deer carcass may be moved away from an obstacle,
14entanglement, waterway, or any other area, including but not
15limited to a roadway, if tagging the carcass at that location
16would be a safety hazard to the hunter or a third person,
17before the tag is attached to the carcass. However, the
18carcass shall not be moved from the immediate vicinity of where
19the deer was taken, shall be moved only so far as is necessary
20to avoid the obstacle, entanglement, waterway, or other safety
21hazard, and shall be tagged immediately upon being so moved and
22before being moved to be transported.
23EXPLANATION
24The inclusion of this explanation does not constitute agreement with
25the explanation’s substance by the members of the general assembly.
   26This bill provides that for purposes of requirements that
27a deer carcass must be affixed with a tag before being moved
28for transport, the carcass can be moved away from an obstacle,
29entanglement, waterway, or any area, including but not limited
30to a roadway, if tagging the carcass at that location would be
31a safety hazard to the hunter or a third person, before the tag
32is attached. The bill also provides that the carcass shall
33not be moved from the immediate vicinity of where the deer was
34taken, shall be moved only so far as is necessary to avoid the
35safety hazard, and shall be immediately tagged upon being so

2of the bill’s provisions is punishable with a scheduled fine
3of $25.
