3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 15F.107, Code 2017, is amended to read
2as follows:
   315F.107  Enhance Iowa fund and appropriation.
   41.  a.  The authority shall establish a fund pursuant to
5section 15.106A, subsection 1, paragraph “o”, for purposes of
6allocating moneys to programs specified in an appropriation
7made to the enhance Iowa fund
 described in this section.
8A fund established for purposes of this section may be
9administered as a revolving fund and may consist of any moneys
10appropriated by the general assembly for purposes of this
11section.
   12b.  Notwithstanding section 8.33, at the end of each fiscal
13year moneys in a fund established for purposes of this section
14shall not revert to any other fund but shall remain in the fund
15for expenditure for subsequent fiscal years.
   16c.  Notwithstanding section 12C.7, subsection 2, interest or
17earnings on moneys in the fund shall be credited to the fund.
18Repayments and recaptures of program moneys shall be credited
19to the fund.
   202.  Commencing with appropriations made for purposes of
21this section for the fiscal year beginning July 1, 2017, and
22for each fiscal year thereafter, not to exceed a total of ten
23fiscal year appropriations, if moneys are transferred to the
24general fund of the state pursuant to section 8.55, subsection
252, paragraph “b”, during a fiscal year in an amount that exceeds
26one hundred million dollars, there is appropriated from the
27general fund of the state to the authority for deposit in
28the fund created pursuant to subsection 1, for that fiscal
29year, twenty-five million dollars to be used for the purposes
30designated in this section.
   313.  Moneys appropriated to the fund pursuant to subsection 2
32shall be allocated by the authority for the following purposes
33and in the following amounts:
   34a.  For purposes of administration, marketing enhance Iowa
35programs, expenses, and compensation of board members, two
-1-1hundred fifty thousand dollars.
   2b.  For deposit in the sports tourism program fund
3established pursuant to section 15F.403, one million dollars.
   4c.  For deposit in the community attraction and tourism fund
5established pursuant to section 15F.204, three million dollars.
   6d.  For deposit in the river enhancement community attraction
7and tourism fund established pursuant to section 15F.205, two
8million dollars.
   9e.  For allocation as grants, at the discretion of the
10board, to the department of natural resources, the department
11of transportation, or the department of agriculture and land
12stewardship as follows:
   13(1)  For purposes of improving state parks infrastructure,
14financing low head dam mitigation or removal projects, or
15funding projects under the natural resources account created in
16section 461.32 in the natural resources and outdoor recreation
17trust fund, two million dollars.
   18(2)  For purposes of funding projects under the watershed
19protection account created in section 461.34 in the natural
20resources and outdoor recreation trust fund, two million
21dollars.
   22(3)  For purposes of funding projects under the trails
23account created in section 461.37 in the natural resources and
24outdoor recreation trust fund, two million dollars.
   25(4)  The departments of natural resources, transportation,
26and agriculture and land stewardship shall submit applications
27to the board for each project to be funded pursuant to this
28paragraph “e”. The board shall prioritize the projects and
29negotiate with the departments on which projects to fund
30pursuant to this paragraph “e”.
   31f.  For allocation to the funds, programs, and purposes
32described in paragraphs “a” through “e”, at the discretion of
33the board, twelve million seven hundred fifty thousand dollars.
   344.  Moneys allocated pursuant to subsection 3, paragraphs “e”
35 and “f”, to the department of natural resources shall not be
-2-1expended by the department for the purpose of acquiring lands,
2waters, or interests in lands and waters.
   35.  If, at any point in a fiscal year, the board determines
4that demand for any one of the purposes described in subsection
53 will not meet or exceed the amounts initially allocated, the
6board may reallocate amounts from one purpose to any of the
7other purposes for that fiscal year or may carry the moneys
8allocated to any one purpose over to a future fiscal year for
9that same purpose in the next fiscal year.
   102.    6.  The authority shall submit a report to the general
11assembly and the governor’s office each year that moneys are
12appropriated to the fund established in this section describing
13the use of moneys and the results achieved under each of the
14programs receiving fund moneys.
15EXPLANATION
16The inclusion of this explanation does not constitute agreement with
17the explanation’s substance by the members of the general assembly.
   18This bill provides for contingent appropriations to, and
19allocations from, the enhance Iowa fund. The bill requires a
20contingent fiscal year appropriation of $25 million from the
21general fund of the state to the enhance Iowa fund. The bill
22provides for appropriations in that amount for 10 fiscal years,
23beginning with the 2017-2018 fiscal year. Under the bill,
24the $25 million appropriation occurs only if the general fund
25receives a transfer of over $100 million in that fiscal year
26from the Iowa economic emergency fund, pursuant to Code section
278.55. Moneys in the fund shall not revert to the general
28fund and interest and earnings on the fund are required to be
29credited to the fund.
   30 The bill requires that the authority allocate moneys in
31the fund to specified funds or accounts or for specified
32purposes. The bill allows the enhance Iowa board (board) to
33reallocate amounts from one purpose to other purposes if the
34board determines that demand for one purpose will not meet
35or exceed the amounts allocated for that purpose. The bill
-3-1provides for the following allocations in fiscal years when the
2fund receives the appropriation of $25 million:
3$250,000 for administration, expenses, and compensation of
4board members, and marketing enhance Iowa programs.
5$1 million for deposit in the sports program fund.
6$3 million for deposit in the community attraction and
7tourism fund.
8$2 million for deposit in the river enhancement community
9attraction and tourism fund.
10$6 million for allocation as grants, at the discretion
11of the board, to the department of natural resources,
12the department of transportation, or the department of
13agriculture and land stewardship for specified allowable
14purposes. Under the bill, the departments are required
15to submit applications to the board for each project to
16be funded from the $6 million allocation and the board is
17required to prioritize the projects and negotiate with the
18departments on which projects to fund.
19$12.75 million for allocation, at the discretion of the
20board, to the above-listed funds, programs, and purposes.
   21Under the bill, the department of natural resources is
22prohibited from using moneys from the fund to acquire lands,
23waters, and interests in lands and waters.
