3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.105, subsection 5, Code 2017, is
2amended to read as follows:
   35.  a.  Seriously disabled veterans who have been provided
4with an automobile or other vehicle by the United States
5government under the provisions of §1901 – 1903, Tit.38 of
6the United States Code,

, shall be exempt from payment of the registration fee
8
 fees provided in this chapter for that vehicle, and shall be
9provided, without fee, with one set of regular registration
10plates or one set of any type of special registration plates
11associated with service in the United States armed forces for
12which the disabled veteran qualifies under section 321.34. The
13disabled veteran, to be able to claim the benefit, must be a
14resident of the state of Iowa. In lieu of the set of regular
15or special military registration plates available without fee,
16the disabled veteran may obtain a set of nonmilitary special
17registration plates or personalized plates issued under section
18321.34 by paying the additional fees associated with those
19plates.
   20b.  A disabled veteran with a service-related disability
21rating of fifty percent or higher as determined by the United
22States department of veterans affairs shall be exempt from
23payment of the registration fees provided in this chapter for
24one vehicle, and shall be provided, without fee, with one
25set of regular registration plates or one set of any type of
26special registration plates associated with service in the
27United States armed forces for which the disabled veteran
28qualifies under section 321.34. The disabled veteran, to be
29able to claim the benefit, must be a resident of the state
30of Iowa. In lieu of the set of regular or special military
31registration plates available without fee, the disabled veteran
32may obtain a set of nonmilitary special registration plates or
33personalized plates issued under section 321.34 by paying the
34additional fees associated with those plates. However, if the
35disabled veteran was issued or reassigned a set of nonmilitary

2one-year period prior to July 1, 2017, the disabled veteran may
3continue to use the plates without payment of the additional
4fees associated with those plates.
5   Sec. 2.  Section 321L.2, subsection 1, paragraph a,
6subparagraph (2), Code 2017, is amended to read as follows:
   7(2)  Persons with disabilities parking sticker. An
8applicant who owns a motor vehicle for which the applicant
9has been issued registration plates under section 321.34 or
10registration plates as a seriously disabled veteran under
11section 321.105 may apply to the department for a persons with
12disabilities parking sticker to be affixed to the plates. The
13persons with disabilities parking stickers shall bear the
14international symbol of accessibility.
15   Sec. 3.  Section 321L.2, subsection 5, Code 2017, is amended
16to read as follows:
   175.  A seriously disabled veteran who has been provided with
18an automobile or other vehicle by the United States government
19under the provisions of 38 U.S.C. §1901 et seq.(1970) §3901 –
20 3904, or a disabled veteran with a service-related disability
21rating of fifty percent or higher as determined by the United
22States department of veterans affairs,
is not required to apply
23for a persons with disabilities parking permit under this
24section unless the veteran has been issued special registration
25plates or personalized plates for the vehicle. The regular
26registration plates issued for the disabled veteran’s vehicle
27without fee pursuant to section 321.105 entitle the disabled
28veteran to all of the rights and privileges associated with
29persons with disabilities parking permits under this chapter.
30EXPLANATION
31The inclusion of this explanation does not constitute agreement with
32the explanation’s substance by the members of the general assembly.
   33Current law exempts seriously disabled veterans who have
34been provided with an automobile or other vehicle by the United
35States government from paying motor vehicle registration fees
-2-1or applying for a persons with disabilities parking permit.
2This bill broadens these exemptions to include disabled
3veterans with a service-related disability rating of 50 percent
4or higher as determined by the United States department of
5veterans affairs.
   6The bill provides such disabled veterans with one free set
7of regular registration plates or one free set of any type of
8special registration plates associated with service in the
9United States armed forces for which the disabled veteran
10qualifies under Code section 321.34. The bill requires the
11disabled veteran to be a resident of the state of Iowa. In lieu
12of the set of regular or special military registration plates
13available without fee, the disabled veteran may obtain a set of
14nonmilitary special registration plates or personalized plates
15by paying the additional fees associated with those plates.
16However, if the veteran was issued such plates prior to July
171, 2017, the veteran may continue to use the plates without
18payment of the additional fees.
   19The bill also updates references to the United States Code
20relating to automobiles provided to disabled veterans by the
21federal government.
