4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. MEDICAID HOME AND COMMUNITY-BASED SERVICES
2WAIVER SERVICES — HOME DELIVERED MEALS. The department of
3human services shall adopt rules pursuant to chapter 17A to
4include home delivered meals as a service available under all
5home and community-based services waivers. If necessary, the
6department of human services shall request federal approval
7of a medical assistance state plan amendment or waiver to
8implement this section effective July 1, 2017.
9 Sec. 2. EFFECTIVE UPON ENACTMENT AND CONTINGENT
10IMPLEMENTATION. This Act, being deemed of immediate
11importance, takes effect upon enactment. However, if federal
12approval is necessary, the department of human services shall
13implement this Act effective July 1, 2017, contingent upon
14receipt of federal approval of the state plan amendment or
15waiver request submitted under this Act.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
19This bill directs the department of human services (DHS)
20to adopt administrative rules to include home delivered meals
21as a service available under all home and community-based
22services waivers. If necessary, DHS shall request federal
23approval of a medical assistance state plan amendment or
24waiver to implement the bill effective July 1, 2017. The bill
25takes effect upon enactment. However, if federal approval is
26necessary, implementation of the bill effective July 1, 2017,
27is contingent upon receipt of such federal approval.
