3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 414.1, subsection 1, Code 2017, is
2amended to read as follows:
   31.  a.  For the purpose of promoting the health, safety,
4morals, or the general welfare of the community or for the
5purpose of preserving historically significant areas of
6the community, any city is hereby empowered to regulate and
7restrict the height, number of stories, and size of buildings
8and other structures, the percentage of lot that may be
9occupied, the size of yards, courts, and other open spaces, the
10density of population, and the location and use of buildings,
11structures, and land for trade, industry, residence, or other
12purposes.
   13b.  A city shall not, after January 1, 2018, adopt or enforce
14any regulation or restriction related to the occupancy of
15residential rental property that is based upon the existence
16of familial or nonfamilial relationships between the occupants
17of such rental property.
18EXPLANATION
19The inclusion of this explanation does not constitute agreement with
20the explanation’s substance by the members of the general assembly.
   21This bill relates to the authority of cities to regulate and
22restrict the occupancy of residential rental property.
   23The bill provides that a city shall not, after January 1,
242018, adopt or enforce any regulation or restriction related
25to the occupancy of residential rental property based upon the
26familial or nonfamilial relationships of the occupants.
