2sanctions for failure to attend school.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 299.1A, subsection 1, Code 2017, is
2amended to read as follows:
   31.  Except as provided in subsections 2 and 3, a child
4who has reached the age of six and is under sixteen eighteen
5 years of age by September 15 is of compulsory attendance age.
6However, if a child enrolled in a school district or accredited
7nonpublic school reaches the age of sixteen eighteen on or
8after September 15, the child remains of compulsory age until
9the end of the regular school calendar.
10   Sec. 2.  STATE MANDATE FUNDING SPECIFIED.  In accordance
11with section 25B.2, subsection 3, the state cost of requiring
12compliance with any state mandate included in this Act shall
13be paid by a school district from state school foundation aid
14received by the school district under section 257.16. This
15specification of the payment of the state cost shall be deemed
16to meet all of the state funding-related requirements of
17section 25B.2, subsection 3, and no additional state funding
18shall be necessary for the full implementation of this Act
19by and enforcement of this Act against all affected school
20districts.
21EXPLANATION
22The inclusion of this explanation does not constitute agreement with
23the explanation’s substance by the members of the general assembly.
   24This bill relates to compulsory attendance age of secondary
25school students and sanctions for nonattendance.
   26The bill raises the compulsory school attendance age from
2716 to 18, and therefore the driver’s license sanctions of Code
28section 299.1B apply to such a person. Under Code section
29299.1B, a person who is of compulsory attendance age who does
30not meet exception under Code section 299.2, does not attend
31a public school or an accredited nonpublic school, is not
32receiving competent private instruction or independent private
33instruction, and who does not attend an alternative school or
34adult education classes, shall not receive an intermediate or
35full driver’s license until age 18.

   1The bill may include a state mandate as defined in Code
2section 25B.3. The bill requires that the state cost of
3any state mandate included in the bill be paid by a school
4district from state school foundation aid received by the
5school district under Code section 257.16. The specification
6is deemed to constitute state compliance with any state mandate
7funding-related requirements of Code section 25B.2. The
8inclusion of this specification is intended to reinstate the
9requirement of political subdivisions to comply with any state
10mandates included in the bill.
