3   Section 1.  EXECUTIVE BRANCH APPROPRIATION REDUCTIONS.
   41.  For the period beginning on the effective date of this
5section and ending on June 30, 2017, the following departments,
6agencies, and entities, and the judicial branch are subject to
7a reduction in expenditures made from appropriations from the
8general fund in the following amounts:

   332.  The department of management, in consultation with
34the departments, agencies, and entities, and the judicial
35branch listed in subsection 1, shall identify and implement
-2-1the reductions in subsection 1 with respect to the appropriate
2general fund appropriations. Within fifteen days of the
3effective date of this section, the department of management
4shall transmit a report to the general assembly and legislative
5services agency listing the appropriation reductions applied.
   63.  Notwithstanding section 8.62, the departments, agencies,
7and entities, and the judicial branch reducing expenditures
8pursuant to subsection 1 may use moneys received for training
9and technology for the fiscal year beginning July 1, 2016, to
10implement such reductions.
   114.  In order to implement the reductions in subsection 1, the
12departments, agencies, and entities, and the judicial branch
13may adjust allocations made from appropriations that are being
14reduced.
   155.  In order to implement the reductions in subsection 1, the
16department of management may reduce a standing appropriation to
17a department, agency, or entity required to reduce expenditures
18pursuant to subsection 1.
19DIVISION II
20SUPPLEMENTAL APPROPRIATION
21   Sec. 2.  INDIGENT DEFENSE.There is appropriated from the
22general fund of the state to the office of the state public
23defender of the department of inspections and appeals for the
24fiscal year beginning July 1, 2016, and ending June 30, 2017,
25the following amount, or so much thereof as is necessary to
26supplement appropriations made for the following designated
27purpose:

29the indigent defense fund in accordance with section 815.11:

24   Sec. 4.  OPEN SPACES ACCOUNT — PARK MAINTENANCE.   Of the
25Iowa resources enhancement and protection fund moneys allocated
26to the open spaces account pursuant to section 455A.19,
27subsection 1, paragraph a, subparagraph (1), $1,000,000 shall
28be used for state park maintenance from the effective date of
29this section through the close of the fiscal year ending June
3030, 2017.
31   Sec. 5.  IOWA VETERANS HOME CARRYOVER SURPLUS —
32TRANSFER.
  Notwithstanding section 35D.18, subsection 5, from
33any moneys that remain unencumbered or unobligated from amounts
34appropriated for the fiscal year beginning July 1, 2015, and
35ending June 30, 2016, $350,195 is transferred to the college
-4-1student aid commission for purposes of the national guard
2educational assistance program established in section 261.86.

4Miscellaneous REDUCTIONS, Reallocations, and Adjustments to
5Health and Human Services-Related Appropriations
6   Sec. 6.  2015 Iowa Acts, chapter 137, section 126,

   20a.  Of the funds appropriated in this subsection,
21$26,328,097 is transferred to the child care and development

25amount, $200,000 shall be used for provision of educational
26opportunities to registered child care home providers in order
27to improve services and programs offered by this category
28of providers and to increase the number of providers. The
29department may contract with institutions of higher education
30or child care resource and referral centers to provide
31the educational opportunities. Allowable administrative
32costs under the contracts shall not exceed 5 percent. The
33application for a grant shall not exceed two pages in length.

15   Sec. 10.  2015 Iowa Acts, chapter 137, section 132,

   1821.  Of the funds appropriated in this section, $250,000

 $100,000 shall be used for lodging expenses associated with
20care provided at the university of Iowa hospitals and clinics
21for patients with cancer whose travel distance is 30 miles or
22more and whose income is at or below 200 percent of the federal
23poverty level as defined by the most recently revised poverty
24income guidelines published by the United States department of
25health and human services. The department of human services
26shall establish the maximum number of overnight stays and the
27maximum rate reimbursed for overnight lodging, which may be
28based on the state employee rate established by the department
29of administrative services. The funds allocated in this
30subsection shall not be used as nonfederal share matching
31funds.

7   Sec. 17.  AUTISM SUPPORT FUND — TRANSFER.
  8Notwithstanding section 225D.2, for the fiscal year beginning
9July 1, 2016, and ending June 30, 2017, of the $2,000,000
10credited to the autism support fund, $1,100,000 is transferred
11to the department of human services to supplement the
12appropriation in 2015 Iowa Acts, chapter 137, section 143, as
13amended by 2016 Iowa Acts, chapter 1139, section 20, for the
14state mental health institute at Independence, for the fiscal
15year beginning July 1, 2016, and ending June 30, 2017.
16DIVISION V
17MISCELLANEOUS REDUCTIONS
18   Sec. 18.  OPERATIONAL EXPENDITURE REDUCTIONS.  The amounts
19appropriated from the general fund of the state to the
20departments and establishments of the executive branch, as
21defined in section 8.2, for operational purposes in enactments
22made for the fiscal year beginning July 1, 2016, and ending
23June 30, 2017, are reduced by $11,500,000 for the period
24beginning on the effective date of this section and ending on
25June 30, 2017. For purposes of this section, “operational
26purposes” include but are not limited to state agency office
27supplies, outside services purchases, equipment purchases,
28printing and binding, information technology, marketing, and
29state employee travel. Operational expenses may also include
30a moratorium on filling vacant or newly created positions of
31employment for the period beginning March 1, 2017, and ending
32June 30, 2017. The reductions to operational appropriations
33required by this section shall be applied by the department
34of management in consultation with each department. The
35department shall submit a report to the general assembly
-10-1and the legislative services agency regarding anticipated
2reductions for operational purposes within thirty days of the
3effective date of this section.
4   Sec. 19.  LEGISLATORS’ PER DIEM FOR THE 2017 REGULAR
5SESSION.
  Notwithstanding section 2.10, subsection 1, to the
6contrary, members of the Eighty-seventh General Assembly shall
7be limited to the receipt of a per diem for expenses of office
8for the First Regular Session convening in 2017 for a maximum
9of one hundred calendar days rather than one hundred ten
10calendar days.
11   Sec. 20.  GENERAL ASSEMBLY AND LEGISLATIVE STAFF TRAVEL.  For
12the period beginning on the effective date of this section
13through the close of the fiscal year ending on June 30, 2017,
14costs for out-of-state travel and per diems for out-of-state
15travel for members of the general assembly, and costs for
16out-of-state travel for general assembly staff members, shall
17not be paid from moneys appropriated pursuant to section 2.12.
18   Sec. 21.  2015 Iowa Acts, chapter 138, section 5A, subsection
191, as enacted by 2016 Iowa Acts, chapter 1138, section 2, is
20amended to read as follows:
   211.  The appropriations made pursuant to section 2.12 for the
22expenses of the general assembly and legislative agencies for
23the fiscal year beginning July 1, 2016, and ending June 30,

27DIVISION VI
28EFFECTIVE date PROVISIONS
29   Sec. 22.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed
30of immediate importance, takes effect upon enactment.
31EXPLANATION
32The inclusion of this explanation does not constitute agreement with
33the explanation’s substance by the members of the general assembly.
   34This bill relates to public funding and regulatory matters
35and making, reducing, transferring, and supplementing
-11-1appropriations for expenditures for the fiscal year 2016-2017.
2The bill is organized by divisions.
   3APPROPRIATION REDUCTIONS. For the fiscal year 2016-2017,
4the bill limits expenditures made from appropriations from
5the general fund for certain listed departments and agencies
6and the judicial branch. The bill requires the department
7of management, in consultation with the departments and
8agencies and the judicial branch, to identify and implement
9the reductions and to file a report with the general assembly
10and the legislative services agency listing the appropriation
11reductions applied within 15 days of the effective date
12of the bill. The bill allows departments and agencies and
13the judicial branch to use moneys received for training and
14technology in order to implement the reductions and to adjust
15allocations made within appropriations that are being reduced.
16The bill allows the department of management to reduce standing
17appropriations to such departments and agencies.
   18SUPPLEMENTAL APPROPRIATIONS. The bill makes a supplemental
19appropriation to the state public defender of the department
20of inspections and appeals for payments on behalf of eligible
21adults and juveniles from the indigent defense fund.
   22TRANSFERS AND ALLOCATIONS. For the fiscal year 2016-2017,
23the bill transfers moneys from the Iowa cultural trust
24fund, the strategic investment fund, the innovation and
25commercialization development fund, the economic development
26energy projects fund, the grow Iowa values fund, and the
27federal economic stimulus and jobs holding fund to the general
28fund on the effective date of the bill.
   29The bill provides that moneys contained in the open spaces
30account of the Iowa resources enhancement and protection fund
31shall be used for state park maintenance for the period from
32the bill’s effective date through June 30, 2017.
   33The bill provides that from any moneys that remain
34unencumbered or unobligated from amounts appropriated to the
35Iowa veterans home for the 2015-2016 fiscal year, a specified
-12-1amount is transferred to the college student aid commission for
2purposes of the national guard educational assistance program.
   3MISCELLANEOUS REALLOCATIONS AND ADJUSTMENTS TO HEALTH
4AND HUMAN SERVICES-RELATED APPROPRIATIONS. The bill
5makes reallocations and adjustments to health and human
6services-related appropriations for the 2016-2017 fiscal year.
7The bill makes adjustments to four appropriations related to
8the temporary assistance for needy families block grant (TANF).
9The bill reduces an appropriation to the family investment
10program (FIP). The bill reduces the appropriation to the
11department of human services for the fiscal year 2016-2017
12for medical assistance program reimbursement and associated
13costs. The bill makes adjustments to the state match for a
14disproportionate share hospital payment under the medical
15assistance program. The bill reduces the appropriation for the
16state supplementary assistance program. The bill increases
17the appropriation to the department of human services for
18maintenance of the healthy and well kids in Iowa (hawk-i)
19program pursuant to chapter 514I, including supplemental dental
20services, for receipt of federal financial participation under
21Tit.XXI of the federal Social Security Act, which creates
22the children’s health insurance program. The bill increases
23appropriations to the department of human services for mental
24health institutes. The bill increases appropriations to
25the department of human services for costs associated with
26the commitment and treatment of sexually violent predators
27in the unit located at the state mental health institute at
28Cherokee. The bill transfers moneys from the autism support
29fund to supplement the appropriation to the department of human
30services for the state mental health institute at Independence.
   31MISCELLANEOUS REDUCTIONS. The bill makes additional
32miscellaneous appropriation reductions for the 2016-2017 fiscal
33year.
   34The bill provides that amounts appropriated from the
35general fund to departments and establishments of the executive
-13-1branch for operational purposes are reduced by $11.5 million
2for the period beginning on the bill’s effective date and
3ending June 30, 2017. The bill provides that “operational
4purposes” includes, but is not limited to, state agency office
5supplies, outside services purchases, equipment purchases,
6printing and binding, information technology, marketing, state
7employee travel, and a moratorium on filling vacant or newly
8created employment positions. The bill provides that the
9reductions will be applied by the department of management in
10consultation with each department, and that the department of
11management will submit a report to the general assembly and
12the legislative services agency within 30 days of the bill’s
13effective date outlining the anticipated reductions.
   14The bill limits the receipt of a per diem by members of the
15general assembly for the first regular session of the 87th
16General Assembly to 100 calendar days, rather than 110 calendar
17days.
   18The bill provides that costs for out-of-state travel and
19out-of-state per diems for members of the general assembly, and
20for out-of-state travel for legislative staff, shall not be
21paid from moneys appropriated to the general assembly pursuant
22to Code section 2.12.
   23The bill additionally increases the reduction to the
24standing unlimited appropriation to the general assembly.
   25EFFECTIVE DATE. The bill takes effect upon enactment.
