4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.492B, Code 2017, is amended to read
2as follows:
   3321.492B  Use of unmanned aerial vehicle automated or remote
4systems
for traffic law enforcement prohibited.
   5The state or a political subdivision of the state shall not
6use an unmanned aerial vehicle place or cause to be placed on
7or adjacent to a highway, or maintain or employ the use of,
8any automated or remote system
for traffic law enforcement
 9including but not limited to an unmanned aerial vehicle and any
10device with one or more sensors working in conjunction with a
11traffic-control signal or device, signal light, speed measuring
12device, or parking meter device
.
13   Sec. 2.  REMOVAL OF AUTOMATED OR REMOTE TRAFFIC LAW
14ENFORCEMENT SYSTEMS — VALIDITY OF PRIOR NOTICES AND
15CITATIONS.
  On or before July 1, 2017, a local authority using
16an automated or remote traffic law enforcement system shall
17discontinue using the system and remove the system equipment.
18Effective July 1, 2017, all local ordinances authorizing the
19use of automated or remote traffic law enforcement systems are
20void. However, any notice of violation mailed or any citation
21issued pursuant to such an ordinance prior to July 1, 2017,
22shall not be invalidated by the enactment of this Act and shall
23be processed according to the provisions of the law under which
24it was authorized.
25   Sec. 3.  EFFECTIVE UPON ENACTMENT.  The section of this
26Act relating to the removal of automated or remote traffic
27law enforcement systems and the validity of prior notices and
28citations, being deemed of immediate importance, takes effect
29upon enactment.
30EXPLANATION
31The inclusion of this explanation does not constitute agreement with
32the explanation’s substance by the members of the general assembly.
   33This bill imposes a statewide prohibition on the placement
34and use of automated or remote traffic law enforcement systems
35including but not limited to unmanned aerial vehicles and any
-1-1devices with one or more sensors working in conjunction with a
2traffic-control signal or device, signal light, speed measuring
3device, or parking meter device. This provision of the bill
4takes effect July 1, 2017.
   5Local authorities that are currently using automated or
6remote traffic law enforcement systems must discontinue their
7use and remove related equipment on or before July 1, 2017.
8On that date, all local ordinances authorizing the use of
9automated or remote traffic law enforcement systems are void.
10However, notices of violations mailed or citations issued prior
11to July 1, 2017, are not invalidated by the bill and remain
12enforceable. These provisions of the bill take effect upon
13enactment.
