4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 279.23, subsection 1, Code 2024, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  0e.  If the contract provides for one or
4more severance payments, a statement that the administrator
5shall not receive such payments if the contract is terminated
6as a result of the administrator being found guilty in a
7criminal proceeding on a charge relating to the administrator’s
8official duties or a dereliction thereof for which the period
9for appeal has passed, other than a proceeding regarding a
10simple misdemeanor or a parking violation as defined in section
11321.210.
12   Sec. 2.  APPLICABILITY.  This Act applies to contracts
13entered into pursuant to section 279.23, or continued pursuant
14to section 279.24, on or after the effective date of this Act.
15EXPLANATION
16The inclusion of this explanation does not constitute agreement with
17the explanation’s substance by the members of the general assembly.
   18This bill provides that if an employment contract between
19a school board and an administrator provides for one or more
20severance payments, the contract shall contain a statement
21that the administrator shall not receive such payments if the
22contract is terminated as a result of the administrator being
23found guilty in a criminal proceeding on a charge relating
24to the administrator’s official duties or a dereliction
25thereof for which the period for appeal has passed, other
26than a proceeding regarding a simple misdemeanor or a parking
27violation.
   28The bill applies to contracts entered into or continued on or
29after the effective date of the bill.
