3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. NEW SECTION. 461A.10A Restrictions on acquiring
2real property.
31. The department shall not acquire real property available
4for sale at an auction for real property. The department
5shall only acquire real property from a willing donor or
6willing seller, who shall not be under any compulsion by the
7department. The department shall not acquire real property by
8donation from a nonprofit corporation that directly purchased
9real property for sale at an auction.
102. For purposes of this section, “auction” means a public
11auction or private auction, including but not limited to an
12auction by electronic means, an auction by sealed bid, or a
13conventional oral auction.
14 Sec. 2. Section 461A.11, subsection 1, Code 2024, is amended
15to read as follows:
161. The commission may accept gifts of land or other
17property, subject to section 461A.10, or the use of lands or
18other property for a term of years, and improve and use the
19land as public state parks.
20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
23This bill restricts the acquisition of real property by the
24department of natural resources (DNR). The bill prohibits
25DNR from acquiring real property at an auction. The bill
26authorizes DNR to only acquire property through willing donors
27and sellers, who shall not be under the compulsion of DNR. DNR
28also shall not acquire property from a nonprofit corporation
29that purchased the property at an auction.
