3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321G.13, subsection 2, Code 2024, is
2amended to read as follows:
   32.  a.  A person shall not operate or ride a snowmobile with
4a firearm in the person’s possession unless it is unloaded and
5enclosed in a carrying case, except as otherwise provided.
6However, a nonambulatory person may carry an uncased and
7unloaded firearm while operating or riding a snowmobile.
   8b.  (1)  A person may operate or ride a snowmobile with a
9loaded firearm, whether concealed or not, without a permit to
10carry weapons, if the person operates or rides on land owned,
11possessed, or rented by the person and the person’s conduct is
12otherwise lawful.
   13(2)  A person may operate or ride a snowmobile with a loaded
14pistol or revolver, whether concealed or not, if the person is
15operating or riding the snowmobile on land that is not owned,
16possessed, or rented by the person, and the person’s conduct is
17otherwise lawful.
  18c.  A person shall not discharge a firearm while on a
19snowmobile, except that a nonambulatory person may discharge a
20firearm from a snowmobile while lawfully hunting if the person
21is not operating or riding a moving snowmobile.
22   Sec. 2.  Section 321I.14, subsection 2, Code 2024, is amended
23to read as follows:
   242.  a.  A person shall not operate or ride an all-terrain
25vehicle with a firearm in the person’s possession unless it is
26unloaded and enclosed in a carrying case, except as otherwise
27provided. However, a nonambulatory person may carry an uncased
28and unloaded firearm while operating or riding an all-terrain
29vehicle.
   30b.  (1)  A person may operate or ride an all-terrain vehicle
31with a loaded firearm, whether concealed or not, without a
32permit to carry weapons, if the person operates or rides on
33land owned, possessed, or rented by the person and the person’s
34conduct is otherwise lawful.
   35(2)  A person may operate or ride an all-terrain vehicle with
-1-1a loaded pistol or revolver, whether concealed or not, if the
2person is operating or riding the all-terrain vehicle on land
3that is not owned, possessed, or rented by the person, and the
4person’s conduct is otherwise lawful.
  5c.  A person shall not discharge a firearm while on an
6all-terrain vehicle, except that a nonambulatory person may
7discharge a firearm from an all-terrain vehicle while lawfully
8hunting if the person is not operating or riding a moving
9all-terrain vehicle.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
   13This bill relates to the conveyance of firearms on certain
14vehicles.
   15Current law prohibits a person from operating or riding a
16snowmobile or all-terrain vehicle with a loaded firearm in the
17person’s possession unless the person is operating or riding
18the snowmobile or all-terrain vehicle on land that is owned,
19possessed, or rented by the person, and the person’s conduct is
20otherwise lawful. Additionally, a person may operate or ride
21a snowmobile or all-terrain vehicle with a loaded pistol or
22revolver on land that is not owned, possessed, or rented by the
23person, if the person’s conduct is otherwise lawful. The bill
24strikes these prohibitions and exceptions.
