2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 1.2, Code 2024, is amended to read as
2follows:
31.2 Sovereignty.
4The state possesses sovereignty coextensive with the
5boundaries referred to in section 1.1, subject to such rights
6as may at any time exist in the United States in relation
7to public lands, or to any establishment of the national
8government military or naval establishment.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
12Under current law, state sovereignty is subject to the
13United States’ rights to public lands or an establishment of
14the national government. This bill modifies the limits of
15state sovereignty to make state sovereignty subject only to the
16United States’ rights to public lands and to military and naval
17establishments.
