3and fees at a regents institution or community college.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 260C.14, subsection 14, Code 2024, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  c.  Adopt rules to prohibit the community
4college from classifying a student as a resident of this state
5for purposes of tuition and fees unless the student provides
6proof of United States citizenship or proof that the individual
7is lawfully present in the United States.
8   Sec. 2.  Section 262.9, subsection 17, Code 2024, is amended
9by adding the following new paragraph:
10   NEW PARAGRAPH.  c.  Adopt rules to prohibit institutions of
11higher education under its control from classifying a student
12as a resident of this state for purposes of tuition and fees
13unless the student provides proof of United States citizenship
14or proof that the individual is lawfully present in the United
15States.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill requires the board of regents and the board of
20directors of a community college to adopt rules to prohibit a
21regents institution or community college from classifying a
22student as a resident of this state for purposes of tuition
23and fees unless the student provides proof of United States
24citizenship or proof that the individual is lawfully present in
25the United States.
