House File 2075 - IntroducedA Bill ForAn Act 1relating to express advocacy with respect to the filing
2of certain election reports.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 68A.401, subsection 4, Code 2024, is
2amended to read as follows:
   34.  Political committees expressly advocating the
4nomination, election, or defeat of candidates for both
5federal office and any elected office created by law or the
6Constitution of the State of Iowa shall file statements and
7reports with the board in addition to any federal reports
8required to be filed with the board. However, a political
9committee that is registered and filing full disclosure
10reports of all financial activities with the federal election
11commission may file verified statements as provided in section
1268A.201A. For the purposes of this subsection, “express
13advocacy”
includes a communication with the name, image, or
14likeness of a candidate if the communication occurs within
15ninety days of an election at which the candidate will appear
16on the ballot.

17EXPLANATION
18The inclusion of this explanation does not constitute agreement with
19the explanation’s substance by the members of the general assembly.
   20This bill relates to the definition of “express advocacy”
21for the purposes of statements filed with the Iowa ethics and
22campaign disclosure board. The bill requires a political
23committee that publishes a communication with the name, image,
24or likeness of a candidate within 90 days of an election
25at which the candidate will appear on the ballot to file
26statements and reports with the Iowa ethics and campaign
27disclosure board.
