4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  PARTICIPATION IN SUMMER ELECTRONIC BENEFITS
2TRANSFER (EBT) FOR CHILDREN PROGRAM — APPROPRIATION.
   The
3department of health and human services, in coordination with
4the department of education, shall do all of the following:
   51.  Immediately upon the effective date of this Act, submit a
6letter of intent to the United States secretary of agriculture
7to apply for and participate in the summer EBT for children
8program established as a permanent program under the federal
9Consolidated Appropriations Act, 2023, 42 U.S.C.§1762, during
10summer 2024.
   112.  Coordinate with the United States department of
12agriculture food and nutrition service to develop a successful
13management and administration plan for the summer EBT for
14children program, and submit the plan to the United States
15secretary of agriculture by February 15, 2024.
16   Sec. 2.  SUMMER ELECTRONIC BENEFITS TRANSFER (EBT) FOR
17CHILDREN PROGRAM — HEALTHIEST STATE INITIATIVE COORDINATION
18— APPROPRIATIONS.
   191.  There is appropriated from the general fund of the state
20to the department of health and human services for the fiscal
21year beginning July 1, 2023, the following amount, or so much
22thereof as is necessary, to be used for administration of the
23summer EBT for children program as provided under the federal
24Consolidated Appropriations Act, 2023, during summer 2024:

   26a.  Of the amount appropriated in this subsection, at least
27$700,000 shall be used by the department of health and human
28services to contract with the Iowa institute of public health
29research and policy at the university of Iowa college of public
30health to evaluate the nutritional and other health impacts of
31the summer EBT for children program.
   32b.  Any moneys appropriated in this subsection that remain
33unexpended or unobligated at the end of the fiscal year
34beginning July 1, 2023, shall not revert but shall remain
35available for use in the succeeding fiscal year for the

   22.  There is appropriated from the general fund of the state
3to the department of health and human services for the fiscal
4year beginning July 1, 2023, the following amount, or so much
5thereof as is necessary, to support the double up food bucks
6program administered by the Iowa healthiest state initiative
7to coordinate the double up food bucks program with the summer
8EBT for children program:
..................................................  $92,800,000
   10a.  Of the amount appropriated in this subsection, up to
1110 percent may be used for promotion of the programs and for
12public education.
   13b.  Any moneys appropriated under this subsection that
14remain unexpended or unobligated at the end of the fiscal
15year beginning July 1, 2023, shall not revert but shall
16remain available for use in the succeeding fiscal year for the
17purposes authorized in this subsection.
18   Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of immediate
19importance, takes effect upon enactment.
20   Sec. 4.  RETROACTIVE APPLICABILITY.  This Act applies
21retroactively to July 1, 2023.
22EXPLANATION
23The inclusion of this explanation does not constitute agreement with
24the explanation’s substance by the members of the general assembly.
   25This bill relates to programs that address food insecurity.
   26The bill requires the department of health and human
27services (HHS), in coordination with the department of
28education, to immediately upon the effective date of the bill
29submit a letter of intent to apply for and participate in the
30summer electronic benefits transfer (EBT) for children program
31made permanent by the federal Consolidated Appropriations
32Act, 2023, administered by the United States department of
33agriculture food and nutrition service (USDA) during summer
342024, to coordinate with the USDA to develop a successful
35management and administration plan for the summer EBT program
-2-1for children, and to submit the plan to the USDA by February
215, 2024.
   3The bill appropriates moneys from the general fund of
4the state to HHS for fiscal year 2023-2024 to be used for
5administration of the summer EBT for children program during
6summer 2024. The bill authorizes the use of a portion of the
7funds appropriated for HHS to contract with the Iowa institute
8of public health research and policy at the university of Iowa
9college of public health to evaluate the nutritional and other
10health impacts of the summer EBT for children program.
   11The bill also appropriates moneys from the general fund
12of the state to HHS for fiscal year 2023-2024 to support
13the double up food bucks program administered by the Iowa
14healthiest state initiative to coordinate the double up food
15bucks program with the summer EBT for children program. The
16bill authorizes the use of up to 10 percent of the amount
17appropriated for promotion of the programs and public
18education.
   19The bill takes effect upon enactment and is retroactively
20applicable to July 1, 2023.
