4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 279.23, subsection 1, Code 2024, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  0e.  If the contract provides for one or more
4severance payments, a statement that the administrator shall
5not receive such payments if the contract is terminated as a
6result of the administrator being found liable in a criminal,
7civil, or administrative proceeding for which the period for
8appeal has passed, other than a proceeding regarding a simple
9misdemeanor or a parking violation as defined in section
10321.210.
11   Sec. 2.  APPLICABILITY.  This Act applies to contracts
12entered into pursuant to section 279.23, or continued pursuant
13to section 279.24, on or after the effective date of this Act.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill provides that if an employment contract between
18a school board and an administrator provides for one or more
19severance payments, the contract shall contain a statement
20that the administrator shall not receive such payments if
21the contract is terminated as a result of the administrator
22being found liable in a criminal, civil, or administrative
23proceeding for which the period for appeal has passed, other
24than a proceeding regarding a simple misdemeanor or a parking
25violation.
   26The bill applies to contracts entered into or continued on or
27after the effective date of the bill.
